Is this true? - or is it really the Nationwide which is the serial abuser of its customers' accounts..

Default Silver vs Nationwide

Hi there
This is my first post but I would like to say thanks first of all to all you guys in here.I have been reading and following the threads in here for a while now.
Well,I started my procedure back in May actually.Sent off letter demanding the repayment of £1168 i think it was.I got a reply back and had £160 deposited in my bank. Then I got kinda sidetracked I'm afraid by other stuff going on.
Anyhow, got back on track in July with LBA.No response whatsoever.August 8th I put in my form N1 to the court, along with my fee excemption form.Recieved it back on 11th August with a note explaining that they needed Nationwides suffix. After trawling the net for thier suffix I ended up in the CAG chatroom where some very helpful guys, after some discussion, concluded that they have no suffix but I could put "mutual society" on the form to keep the court happy.
Went back to court on 15th,had a very nice receptionist this time (the last one stated that it is not her job to check forms) who went through the forms and even had my excemption form verified while I waited....nice lady
Recieved notice of issue on 21st August stating....
Claim issued on 16th August
Sent by post on 18th August
Deemed served on 22 August
Defendant has until Septembet 5th to reply

My question is....on the notice of issue it has the request for judgement form. How and when do i fill that in???

Thanks for any replies and thanks to everyone for this great board.

As far as I know you can only file for judgment if/when they do not pay.

The court forms helpfully don't tell you this, but the request for judgement form is the one you need if they don't put in a defence; then you can apply for summary judgement. Hopefully you won't need it.

NW will probably acknowledge the claim and say they intend to enter a defence, but on past performance they won't actually do so. It just gives them a bit more time (28 days from the day the claim was issued). After you get the acknowledgement you can start checking your bank account Once the 28 days have passed, if you don't have your refund, then you might need to request judgement - but hopefully not.
