The FAQ's says you can claim daily interest at a rate of 8% and then shows you how to work out what your interest would be on the amount you are claiming back BUT on my statements of charges there is sometimes an Interest Charge underneath the charges!! This is what I want to know if I can include in my claim as sometimes this amopunt is quite high.

If you don't have an overdraft on your account, then the interest that is displayed on your statements you can add to the amount of charges you are claiming back from the Alliance & Leicester. In the preliminary letter look for the paragraph that says: I calculate that you have taken £[total sum of charges], plus £[total sum of interest displayed on your statement] which you have charged me in overdraft interest for the sum which you have taken. Total £[total sum of charges and interest] If however you have an arranged overdraft on your account, then things are not that simple as you would need to calculate the difference between the interest charged on your authorised overdraft and the interest charged on your unauthorised overdraft. Most people with an overdraft don't usually bother, as it is time consuming, complicated and doesn't add up to that much anyway. Also, people often take the view that the Bank can keep the interest as a "compensation" for them having incurred the charge in the first place. If you do have an overdraft on which you are charged interest, then you would need to know the rate at which you were charged interest, on the amount that you had gone overdrawn by on your overdraft. That amount of interest would have been variable and the only way to find out what the rate is would be to ask your bank. With regards to the 8% interest, this is added once you decide to submit a claim via the small claims court. You must use the spreadsheet in the library as it calculates interest from the date the charge was made to your account. This means that a charge of £39 made in August 2000 will attract more interest than a charge of £39 that was applied to your account in February 2006. So in a nutshell there are 2 types of interest that you can claim 1) The interest charged if your account goes overdrawn and you have no agreed overdraft - or if you have an agreed overdraft, then it would be the interest charged on the amount that exceeded your agreed overdraft. 2) The 8% interest you are entitled to when you submit a claim. Does this help to clear things up for you?

Been away for a few days, just got home and had received a letter from a Jason Johnson saying that my letter of 22/5/06 (My prelim) has been passed to Sarah Watson to investigate and respond.
It says she will send me a FULL RESPONSE by the 9th June, but my 14 day deadline was yesterday the 5th!!
What shall I do? Shall I wait to hear or just go straight ahead and send my LBA??
Please help, getting a bit scared as they are probably going to take me to court!! |

You gave them 14 days to respond to your Preliminary Letter, you now need to follow that up with your 14 days LBA - show then you mean business. |

I am disapointed to note that you have chosen to ignore my request for a refund of the unlawful charges you have applied to my account. Then follow on with the rest of the "standard letter". Final paragraph should say something like, I have already made my position quite clear in that I will not settle for anything less than a full refund of the charges made to my account, which total xxxx. I require a full repayment of this money, and you have until the xxxxx , which is 14 days from the date of this letter, in which to comply. If you do not comply fully within 14 days, please be assured that I will begin a claim against you for the sum of xxxx + 8% interest + costs. Hope that helps!

WHAT DO I DO NOW???!!
I sent off my LBA on 6/6/06 for the full amount of 3870.50 and on Saturday 10th June Nationwide credited my account with 490.00 and I havent heard a word from them no letter nothing!!!
Do I now go ahead and start court proceedings or do I send another letter accepting the 490.00 and requesting the rest of the charges?? Thanks Guys Juicy |

You say that you sent your LBA on the 6th June giving them 14 days (I assume!). Your 14 days are not up until Tuesday 20th June at the least. You count 14 days from the day after you send your letter.
It's up to you if you want to acknowledge the payment of £490.00 or not. When you write to them just tell them thanks for the money, but you will be pursuing them for the rest if they do not pay up before the deadline of your LBA letter.
That's all you have to.
No need for you to panic yourself and everyone else on here! Jeez!

Thanks Juicy | Don't send another LBA. You can write to them (IF YOU WANT) and tell them thanks for the cash, but your original deadline for a return of ALL sums stated in your letter dated xxx still stands. |

I received a letter today from Sarah Watson saying that they have refunded 490.00 and as I have had a refund of charges in the past they are unable to make any further refunds.
I contacted her today saying thanks for her letter but the refund I had in the past at my local branch I had actually accounted for and this was not included in my final claim. She was quite short and to the point and just said that is all Nationwide are prepared to offer so I told her I had sent an LBA letter to Charles Bacon.
What should I do now? Do you think I should write another LBA saying thanks for the 490.00 and also explain that the refund of charges I had received in the past I had accounted for and they were not included in my final claim?

I had a thought shall I just send a letter to Charles Bacon thanking him for the 490.00 and saying I had not included the refund of charges I had 2 years ago in my final claim and that my LBA letter of 6th June still stands along with the deadline for a full refund by the 20th June.
What do you think?? |

Don't send them any more Data Protection Act letters. I suggest you do this.
File your claim online on the 21st June.
If you haven't already sent the Nationwide a list of the charges (with the refunded ones highlighted), then I suggest you fax or send them a recorded delivery letter telling them you have filed a claim with the courts. Make sure that the letter you send them includes a breakdown of:
Charges Applied
Charges Refunded
Court Costs
8% Interest Charges for each individual charge
If you have used the spreadsheet contained within the library then you already have the information to hand. Obviously you should not have added the refunded charges to the excel spreadsheet.
