Default Neil vs Nationwide **WON**

Just putting together the info for my claim against NW. Have spent ages reading threads & info on here so I hope I'm doing it right. Recieved details of my statements & charges back from them yesterday, so now to add them all up and get the relevant letter sent off. A quick total looks like about 1200 pounds.
Here's hoping. I'll keep you posted

Just had a thought.... Although I'm claiming back about £1200 from Nationwide I also have and index linked ISA saving account with them. Its doing OK and holds a few grand and is making a bit o cash for me for the long term future.

Are they likely to try and close this if I win my case against them?

I've only sent my prelim leter so far and (heard nothing back) and i'm waiting to send my LBA.

The rules on ISAs are different. If they retaliated by closing your ISA they would have effectively taken away the opportunity for a proportion of your tax free investment for the relevant year. This could dump a whole heap of problems on their laps if you felt like making an issue of it. I think that even Nationwide would baulk at this.

thanks. just have to wait and see what happens if i'm successful.

personally i think they'l be in deep doo doo if they try touching that account. I'm not in debt to Nationwide and the money in the ISA has been invested over a period of 7 or 8 years.

I don't think you need to worry - it would be a huge can of worms for them to open!

No reply from my Prelim request so LBA went off on Friday by Recorded, Signed For delivery.
I'm still using my branch address. Is this ok? Most of my correspondence has previously come from them

They have only said they are closing my current account, not even mentioned the esavings (although I know that will go anyway), I have a savings account with them but they have not mentioned it.

Moneyclaim day in 2 minutues!!!! That's my job for tomorrow night!
I've read lots of threads on her and I'm pretty confident I know what I have to do.

I can just file the claim online cant I, without actually having to go down to my local courthouse?

I didnt send my prelim letter by recorded delivery but I did with my LBA.

Have tried looking on the ROyal Mail website and it claims the information is not available online yet. I sent it over 2 weeks ago though!

I would hold off until you find out if they recieved LBA an if they did immediately start your court proceedings either via MCOL or posting N1 form to local SCC don't know what to suggest if they haven't recieved it other than to send it again.

I'd wait for the 14 days to run from the LBA until MCOL - I didn't hear a dickie bird for either although I could track and trace with royal mail online - so I knew they had received them. If they have received the LBA, wait the 14 days as that is that you gave them to respond

14 days has passed since my LBA which is why I am keen to crack on and claim what is rightfully mine.

I will go into the post office tomorrow and see if they can find out if it was delivered.

That is strange - you can usually find out whether it was delivered within a couple of days on the first page and then have to wait to see a signature if there is one on a further link. I would have thought that it should be showing by now though

so far I have had 4 recordeds that have done this. When you call to file a complaint they check another system and for all 4 of mine they showed there.

Try calling them and see what they can find.
