Default CCA or S.A.R - (Subject Access Request)

Hi i have bridging finance with my bank and have lost my copy of the agreement, the bank is saying it was arranged for 6 months when it was for 12, and asking to me make payments. I have a letter from them which states the facility (payment break) may be required for 12 months, but when arranging the finance i told them it WILL be required for 12 months.

They are contacting the estate agent that is selling my property and is also telling me i have to lower the asking price and trying to get information regarding offers etc from them (is this legal).

To get the information from them do i send a CCA request or a Subject Access Request

Thanks
David

Hi David,

I don't know whether it is legal for them to be in touch with the estate agent - does a bridging loan operate in the same way as an additional charge against your property?

Not sure on the cca or S.A.R - (Subject Access Request) (sorry not being much help am I) I thought there was a limit of £25,000 on a loan under the CCA, but this may be the old rules - why not cca them in the first place as it costs less - and then SAR them if that doesn't provide the info you are looking for - I have to say though that dependent upon the bank they don't class letters etc as being part of your data so you may have to push for these - have you tried going into your local branch and asking over the counter?

Hopefully someone will be along soon to give you some proper advice.

Jody
