| | Basic Account Customer | Kensington Can I Claim Hi evey 1, Just enquiring whether i can claim any money back i.e charges etc.
Had a suspended repo order on hse last year, was paying arrears of as agreed when events beyond my control took over. Youngest child rushed into hosp, emergency appendix (may). Our 17yr old neice died (june). Myself admitted to hosp diagnosed with copd (july). All of which resulted in payments being either missed or delayed. After taking stock of everything we decided to sell and start afresh. Hse sold within a week and sale progressed. We received a phone call from kensington asking why a solicitor was requiring redemption figures, we informed them that we were selling. Then the nightmare really took over, kensington went back to court and got the repo order re instated, which the judge granted. Our solicitor faxed confirmation that completion was imminent this was nov. Imagine our shock when a bailiff knocked on our door to hand deliver an eviction order for 18th dec. We were forced to pull out of sale and quickly remortgage, which we did and completed 4th dec. Nightmare Over? no far from it. On 17th dec whilst i was putting up Xmas decs bailiff comes a calling telling me that i have to be out by 11am the next day. He insisted on entering my home to put a repo notice in my window.
Now i know what you are all gonna say, never let them in. But i did and was glad to see the smirk wiped of his face when upon entering my living room, my american bulldog gave him the once over decided that he didn't like this strange man in his home, and the tone of voice he was using to me and proceeded to omit a long growl. I told the bailiff that as he had insisted on entering he wasn't leaving until this mess had been sorted. By this time he was sweating buckets.
20 mins later and im sure 1/2 stone lighter the bailiff apologised for the mix up. Kensington hadn't cancelled the repo even though we no longer had a mortgage with them.
Can i claim back charges for arrears? They put us through hell, would be nice to think i could get something back.

We have just done so with GE Money after paying them off - we had similar problems with them but it didn't get quite so far as yours. I am horrified at the way you have been treated. The letter I sent GE was similar to the bank charges one - my saga is here: GE Money Secured Loans ***WON***
Best of luck. We are waiting for our cheque and have a bottle of champagne ready!!

I put a complaint in to the FOS re mortgage charges last August and it still hasn't been allocated to an adjudicator............th ey are very busy apparently
Be prepared for a long wait! |

I know it is looking like that. I put mine in in January and I phoned them up the other day after getting anouther letter saying that they will write in 4 weeks. They reckon that they are starting cases a few months behind mine. Maybe you should give them a call to see where they are up to in relation to yours.
I completely appreciate that they are very busy bit it is kinda frustrating as we cant remortgage with these charges as we have a loan and a mortagage with these guys.
Never mind. If you do find out where they are up to let me know please.
