I guess the list is extending; I'm number 50 on it, and everyone above is on my list too. Do we have any idea how many times there have been attempts to go Mercantile court, only to have all the cases settle before then? On my list of 50 cases, 2 are already listed as settled. The accompanying letter acknowledges that "some of these cases may have recently been settled and if yours is one it would be appreciated if you could write and confirm this".
Is there any point in sorting out this CMI sheet, or should I expect a settlement offer well before needing to?

I'm glad I'm not the only one confused by the sheet...far too technical for me!!! I'd give the court a ring if i were you, they had told me about the hearing before i'd got the official letter.

Hi Jonm.. It says in the letter to send the sheet at least 7 days before the hearing, so it would have to go in the next few weeks, I am trying to put mine together just incase, but i am hoping I wont need to rely on it. They could let it go to court, i want to be prepared if they do.

OK J.barton that PDF document you posted up for CMC has me a tad anxious.
Are there any peeps out there that have compiled all this stuff and put it into plain english?
i'm sure we'd all be very grateful.
Its the middle sections especialyy Disclosure that are double speak.
Any templates or copies of previous submissions available?

Got a letter last week saying we were transferred to Mercantile Leeds.Rang court today and they said our case v Yorks bank will be heard by judge Kay on the 7/2/02 and he will be hearing the cases one after the other on this date. they said some letters giving date of hearing are still to be sent out.

stansfield, we are in with the big boys here. The legal system does not normally use Mercantile for litigants in person, especially those without legal training, so they are not geared up to help you PROactively, like the Small Claims court. They expect you to know it all from the start.
However I am sure they will be helpfully REactive, if you ask them for information or assistance.

Hi Stansfield, I did'nt get mine from the courts either, if you check this thread there is the original which i posted b4, also a completed one.
If you cut it and paste it it'll work fine.

Capital One have paid me the charges levied on my account but not the interest. They say they have paid me the courts statutory interest rate at 8% but they haven't.

My question is, how would I adjust the cmc sheet above to reflect that fact?

I am claiming contractual interest by the way.

Hi Too Strong.

I am not sure about that, The hearing is about the bank charges, not the interest...You might have to contact the court...or hopefully someone more knowledgeable can answer.

Just send a note to the judge explaining that they have part settled your claim but have so far refused to pay interst - (or fixed costs?) and so you want to reduce your claim accordingly but that it is still a live claim.
