Case transferred by judge to Mercantile Court and new charges added since

A judge recently transferred my claim against the Halifax to the Mercantile Court, London. Meanwhile the Halifax has continued charging me penalty fees, to the sum of over £1000.

Would I be more likely to reach a swift settlement if I amend my existing claim to include unlawful penalty charges added since I issued my claim? Or is it better to issue a fresh claim? I am aware of the £35 fee for amending an existing claim but the sooner I get the money the better.

Also, the delay in the Halifax's refunding my money has led me to incur a default on a mortgage payment. I simply have not had the money to pay my monthly installments, but would have done without these punitive bank charges. How best do I deal with this?

I suggest that you issue a fresh claim. It wil add to the pressure and I would expect that if they settle the first, they will settle the second at the same time.
If they want to have the two claims joined then they can apply to do so.

I suggest that you merely send them a 7 day LBA with a schedule and then issue the claim.

Thanks! Unfortunately I have already sent them an initial 14-day request for repayment and said I'll send a second LBA if I do not receive a full offer.Not sure I can go back on this now...Also, I'm out of the country till 5 Jan.
