Default Just been transfered to London Mercantile

In the roboraver vs barc case, I've just got a letter that mentions that my case has been transferred from the Bromley country court to the Mercantile court in London, no hearing date has been given yet ! I can assume that I have not been given the small claims track then............

Roboraver,

See the two threads 'Vs Barclays in the Mercantile Court' and 'Mercantile Hearing 20 Feb'.

Although your case has ben put to the Mercantile Court, I don't think anything can be ruled out at this stage. If it ever reaches the Hearing, in theory I suppose the Judge could still direct that it be heard on the Small Claims track. If you look at the thread 'Directions Hearing Leeds (7 Feb)', 95% 0f the 99 cases due to be covered at the hearing on 7 Feb were settled out of court in the days before the hearing and the few remaining cases were settled at the hearing. Look at the last few pages of that thread.

Unfortunatly not a single letter, I have been calling the court and they have mentioned that they are snowed under and my case has not even been allocated a case number yet !

Hi Delboy, yes, it was transferred to the Merc on the 7th of last month, when I rang the Merc they still have not processed mine yet, so it's still a waiting game.

I am still trying to find out if they have acknowleged yet so i am well behind you

Maybe the Courts will come up with something to speed things up bearing in mind the huge increase in cases being brought.

At last.......the missus has just called me and has informed me that my court date has arrived ! 27 th of this month, it looks like there will be a number of other cases being heard on the same day !! I've not read the letter yet but I am assuming that I should send in my court bundle ?
But I am actually flying out to germany to work on on monday until the 26th so I very much doubt that I will be contactible, I am really looking forward to going to court for full disclosure !!

Well, I wont be contactible until the 26th (when my flight lands and my mobile is turned on , am really struggling to find a way of actually getting them to show up in court, as I cant refuse the settlement on the day....hhhmmmm

To be honest, worse case scenario, they'll contact the court to advise they'll make full settlement even if they haven't managed to make contact with you, so I wouldn't sweat it too much...

Barclays will NOT want to go to court, least of all Mercantile, I'm about as sure of that as I can be of anything.

OK, I spoke to the courts, they said I should send in a CMI sheet to them and the bank, but the hearing is a small claims to give directions ??

Roboraver,

From what you have said, your hearing seems to be on the same lines as the Leeds Directions Hearing 7 Feb. Even though small claims, all the Court wanted at this stage was the CMI sheet. I have shown the standard Mercantile CPR 59 CMI sheet in the trhread 'Mercantile Court Guide' at the top of this forum which you should be able to copy from there. Also the same is in the thread 'Mercantile Hearing 20th Feb' together with an example of the answers. (Make sure yours is Mercantile CPR 59 as I believe there is a different CMI sheet for Admiralty and Commercial Courts).
