  1. Thanks once again to both of you - really appreciate your time and extremely helpful and reassuring advice!
  2. Thanks. On a side note I didn't disappear, I was firstly waiting for the ntk which took ages to arrive and then I fell seriously ill. I also did read as much as I could but not all of the stories were exactly like mine so had doubts
  3. Sorry for sounding daft, I read the sticky and the post but just wanted to confirm I got the message right. Would it be appropriate to take the chance now and not respond to the NTK? So just ignore all communication until I get a letter from a legal entity (court)? Thanks again and apologies for asking
  4. Hi DX, This finally arrived in the post ... see attached. Any suggestions/comments? All the best and thanks as always NTK.pdf
  5. Thanks so much for replying. Sure, apologies for not completing before as I stupidly just uploaded the documents without completing this info: 1 The date of infringement? 01/12/21 2 Have you yet appealed to the parking company yet? [Y/N?] YES (uploaded previously in initial post) ; I told them I had a valid ticket for that time paid for with JustPark app and using the parking code I saw on the parking meter nearby. Has there been a response? YES ; They paused the "14 days half price" until they replied recently and said, unfortunately the charge is for parking in a staff only car park and the £40 half price was now counting down in terms of 14 days. I had no idea, it was raining, there was construction underway ... Have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] NO What date is on it? n/a Did the NTK provide photographic evidence? no mention of any photo evidence 3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] The response to my appeal mentioned POPLA and gave me a code 4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? [it is well known that parking companies will reject any appeal whatever the circumstances] NO 5 Who is the parking company? CP PLUS on the PCN ; appeal was replied to by GROUP NEXUS 6. Where exactly [Carpark name and town] did you park? NORTHAMPTON GENERAL HOSPITAL
  6. Thanks! in your opinion do you think I should ignore communications until I get a letter of claim? Or would it be best to just pay the £40 (even though it pains me to say that)
  7. Hi All, Recently I have had 2 issues related to customs. Off the bat I will say that I agree with customs charges to some extent but my situation relates to no commercial transaction or private benefit of any sort. Case 1 - (TNT) We have some relatives who are residents in Portugal (EU) and who are very old and frail with numerous illnesses such as diabetes and dementia. As they were flying to the UK to visit us (we are British and residents in the UK) they decided to send 2 packages (which were under a single shipment) containing items of theirs that were for their own personal use and that they would either consume whilst here (due to their strict diets) or wear whilst here, using the Fedex service and thus taking the strain off of their travel since they have limited mobility as well. So to break it down, the 2 packages in this shipment had: 1st package - contained personal items of clothing ; This was mostly their used underwear, pyjamas, socks, jackets and some shirts. They own all those items and have used them for years and subsequently left with them again. 2nd package - contained some food that they consumed whilst in the UK. Again due to their illnesses they needed to eat certain food and decided to bring food they normally eat in Portugal and consisted of some cheese and dried meats. Both packages contained personal items of theirs for their sole use, nothing was being given to anyone else or left behind. In terms of the values of these 2 packages, for insurance purposes each package was set to 100 EURO mainly because they were not shipped in the normal cardboard boxes but these were in suitcases and some of the items were hard to replace hence those figures. The actual values of the contents of each of the packages at most would amount to £35 or less. I asked a few times how a value of £75 duties was calculated but all I got back was a poor response saying the calculation is correct. No justification why the charge is there, or response to my descriptions above, or anything of that nature. All subsequent questions I had were ignored as I have to date received no other comments. I was never told exactly how the charge was calculated. I was never told why I was charged for both packages. I was never told why this charge was even applied as the items were for personal use by the senders. The items were not imports, nor were they gifts, nor were the goods purchased. these were not imports. They were personal items for use by the sender. Used personal clothing they own for use while visiting family and the other had some items for the sender to consume (food as they are on a strict diet due to their age and health conditions). Case 2 - (Royal Mail) A family member in Greece sent me some hand knitted items and a few pairs of socks and chocolates as a little Christmas gift for my kids. On the customs form they put a value of around £45. I then got a form asking me to pay a customs fee of: £1.45 to HMRC (I dont have a problem with this) plus a couple other fees around £18 to Royal mail for admin and other activities So in essence I paid £20. Surely there is something wrong here. How can they by default charge these admin fees, without any other alternative and only giving less that 10% to HMRC. Is there no regulator? If anyone can point me in the right direction please I would really appreciate this, it's really not on and these people are taking advantage of everyone under the hat of "oh, you got an item from abroad then you have to pay ... and pay a lot!" Thanks! Chris
  8. Hi All, Recently I had to take a family member for the first time to Northampton Hospital for an appointment. It was raining and there was construction underway in one of the carparks so somehow I ended up in a car park where it was not clear but apparently it was a staff car park. I had no idea and used the JustPark app to pay for parking as there was a pay meter right there. When I got back to the car I saw a yellow love letter on my windshield with a PCN. Oblivious to this being a staff car park I contested the PCN (...I know .. ) Weeks later I got a reply from the heartless case worker who basically said too bad, you have 14 days now to pay the reduced amount of £40. Attached are all the files, is there any advice you have for me? Should i just pay it? It's sad that even though I paid for parking in the wrong section and I had a letter showing I was in the hospital attending an appointment, that these devils still want to grab money. Thanks for reading and any advice would really be appreciated! Regards, chris reply-to-appeal.pdf receipt-for-parking.pdf windscreen pcn.pdf
  9. Hello All, Sorry for bringing up this old post again but there has just been a new event ... over a year later. So yesterday, I get this letter in the post along with the letters and images sent to me by Napier over a year ago. I'm not sure what to do, do I ignore it or do I reply with a letter saying I have proof of ticket etc etc. Any help/suggestions would be so very much appreciated! Thanks bwlegal.pdf
  10. Thanks @renegadeimp, So I should just make an appeal then in order to get a POPLA code right?
  11. Hi, This is a Parking Charge Notice Reminder received via post and evidence by ANPR for parking 14 minutes over the 90 minute free parking limit. I did not see the signs stating there was a time limit. As mentioned before, My daughter was ill so I stayed in the car while she was sleeping and then I went to Asda, making a purchase in cash. I will look for the receipt which should hopefully be in the car somewhere. ......................... .... 1 Date of the infringement ==> 08/07/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] ==> 13/07/2017 3 Date received ==> 30/07/2017 ( I was on holiday and only saw this in the post on the 30th ) 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] ==> Yes 5 Is there any photographic evidence of the event? ==> yes 6 Have you appealed? {y/n?] post up you appeal] ==> no Have you had a response? [Y/N?] post it up - no correspondence from my side yet 7 Who is the parking company? ==> Parking Eye 8. Where exactly [carpark name and town] ==> Glyn Square, Wolverton, Milton Keynes For either option, does it say which appeals body they operate under. ==> BPA Doc1 (1).pdf
  12. Thanks! In your opinion, should I appeal it or ignore them until I get a letter from a court?
