  1. Yes, they were defaulted between 06-2011 I think. Was a considerably larger amount: over 20k and they were all unenforceable agreements where they even existed. These are what I consider my second wave of credit. Never again....
  2. Thanks Is that just regarding address change?, I think I've done all these. This was sort of my thinking. I did unfortunately have issues in my early 20s and defaulted a load of stuff, regretted defaulting them over a few years so were defaults on my credit report for 11 years in total due to stagger, I should have learned but I guess easier said than done. There were some with unenforceable agreements so I spent a lot of time reading and started to understand a bit about how they work. I just wish they'd all defaulted at once rather than struggling to pay a few of them for a few years. Are they required to default me straight away even if they accept my £5 a month?, what I don't want is to be paying them and 3 or 4 years down the line them default, would rather get all 6 within a couple of months. I believe Bristol and sutor are bailiffs?.
  3. They all know I've been struggling and all have been in agreements but tbh its not really helped. I think I'm really looking at needing at least 6 months of paying them next to nothing. I will write to them though as so far its been by phone or just agreeing to a plan on phone app. Yes makes sense. Aqua, Vanquis, Capital one, Argos, Next, Jacamo. Upon checking there are only 6. Jacamo is actually 6 months in arrears and they've only just sent a default notice. All taken out in the last 5 years. Only Bristol and Sutor which is the council tax arrears.
  4. Hi everyone. After 10 years in relatively good finances in the last 6 months I ended up giving up my rented flat and moving in with brother due to things really hitting the fan. Below is a basic idea of my finances. I'm self employed with no dependants or mortgage etc. Priority debts Rent, c tax, bills, food etc paid direct to brother, has been flexible till now but thats sort of part of the issue. £400 a month so can't argue it but its been a bit £50 here and there and tbh I want to be giving him solid payments. Council tax arrears from last year with Bristol and sutor. Only £280 remaining and they are accepting £15 a week while Cv19 going on. Roughly £1200 income tax arrears from a few years back, have heard nothing in a while but am aware that will be going up. £600 owed to accountant from last year. No national insurance paid for a good while. Car currently off the road as needs money spending for mot etc but still paying £18pm insurance unsecured debts I have about 7 totalling roughly £3500 owed to various creditors, all but 1 are 2-3 months+ in arrears. Jacamo will default on the 16th of April unless I pay £160 which I can't see me managing. I'm seriously considering letting these all default, maybe keep the Capital one card with £400 limit. I'd say in the last 12 months I've had 15 default notices and on each occasion I've found the cash at the 11th hour yet all are still maxed out. The record must be Aqua with 4 notices yet it sits £300 over its limit despite not being used. I just wondered what peoples views are on me just letting these unsecured debts default asap so to hopefully freeze the balances and repay them as a set amount rather than chasing the balance constantly?. Maybe keep the Capital one as it has the best rate. I want to be paying off the priority stuff and get paying my brother on time + get my car back on the road and put some money back into the business. I just can't see any way out of the unsecured debts. I think it would cost maybe £600 to get them all up to date which is honestly out of the question. I fully intend on repaying them and from past experience debt collectors will be more flexible. I think also from a psychological point it would be good for me but I just want some opinions on this. I realise my credit report will be thrashed for 6 years and I can live with that, I can't see me getting through 6 years anyway without defaulting atleast 1 so figure best do them all now.
  5. Ok update and a request for more advice if possible. Payment was made on 17th of jan and feb, £300 taken from balance and the deduction from the council for the time I wasn’t in the property. Balance down to £350. Yesterday a letter from B & S again headed Notice Of Enforcement with a balance of £425. This time stating I couldn’t sell anything I owed etc. Requesting payment of £40 a week. Presuming this to be a mistake I called them(I know not to call but I thought this was just a mix up) and apparently because I didn’t contact them in the week after the 17th they were enforcing and had added the fee. I thought this was added back in December when they first took over the debt which I pointed out to the lady on the phone and she said they could add it as the debt was their’s now and not the councils. Im confused here as I thought the only fees per debt were roughly £75 immediately when the bailiff makes first contact. £235 if they visit and more if they remove goods etc Now I did agree to £150 a month followed by the £75 which I can afford now however are they playing fair here?, is there a scenario where they can add 2 x £75 to the original council debt.

  7. That makes sense. Totally off subject but this might be of interest to some others. I called up EE to discuss moving or cancelling my home broadband as I have 9 months left where my brother has 2. Because my brothers house hasn't got the faster fibre set up by BT yet they will cancel the contract with no charge as they are unable to supply what i'll be paying for. I was expecting 9x£35. I don't know if thats a general thing or just a company policy but was a nice surprise.
  8. Thanks for that. Sorry I didn't spot your reply yesterday. Amazing I've got somewhere, this morning I went to meet my brothers housing association contact who told me that I was effectively homeless and that my brothers house is overcrowded with 2 of us in as 1 room is classified as a study even though its big enough for a bedroom so I'm now high priority for them to get me my own place and this towns growing at a new estate a month right now so she thinks its well worth doing. Back to the council, I rang them and said I'm making myself homeless and that there is no way I can pay £300 friday. After a few condescending questions a bit of a lecture she finally realised I was genuinely skint and they were not likely to find much here. She asked what I can pay, I said £150 friday and £150 in a month then the rest spread over 2 months at the end after its been recalculated. Amazingly it was accepted. Funny thing is she said and I quote "I need to have a word in the back office", is the back office Bristow and Sutor?, this is Stratford council and its very close to Redditch. Then as if by coincidence my landlord rang me asking about the arrears, decided to mention I was going to put in my notice, at which he said I can leave this month if I want and we will square up after. This will mean I can knock two months off the due amount of council tax also.
  9. Its definitely headed as Notice of Issue. The £235 is just on the back of the letter, not actually in the main wording but it does say the debt will be "referred to an enforcement officer who will send a notice of enforcement". I presume at that point they add the £235?
  10. The liability order letter came from Bristow and Sutor before christmas. It stated that if contact was not made within 14 days the debt would be referred to an enforcement agent and a further £235 added to the debt hence I contacted B&S before christmas to try and avoid the £235. There was a letter from the council a few months back with a court date which was the last from them.
  11. They've got the liability order but I think its still at the compliance stage. I just don't think I can afford to prevent it going to the enforcement stage. The only letter I've had so far is a Notice of Issue of Liability order which I've responded to and agreed and unsustainable repayment plan. I guess that was stupid but it was the 23rd of december and honestly I had things to do. In fairness it was either accept her offer or it goes to the next stage. I know from past experience if you miss a payment by 1 day you break the agreement and it goes to the enforcement stage.
  12. Due to a change in circumstances i.e. self employed and injury affecting earnings I managed to get 2 months in rent arrears with private landlord and have £800 council tax owing from 2019. After careful consideration I've decided to go and live with my brother for a bit, he has a house on the housing association and we get on ok + association are ok with it. Splitting all bills my outgoings drop from £1150 to £350 a month Im sure the landlord will be ok, we have a good relationship despite the arrears, with the deposit there will just be a few hundred pounds owing which I'm sure he will be fine with me paying over a couple of months. The council tax though is now with Bristow and Sutor. I spoke with them before Christmas (I know not to make a habit but it was the last day before they threatened to take it to the next stage and it was 3 days before christmas so no way a letter would get to them) I tried to agree £150 a month but they said it had to be clear by the end of march so about £270 a month. I told her it was too much but ended up saying ok but its clear now I won't have £270 by friday when the payment is due. I plan to move on the 25th of February so will be clearing out and moving to his, plan is to sell a lot of what is here because I there isn't the space at my brothers and b theres no need for 2 of everything. I guess what I'm wondering is, if I don't make this months payment I presume this is where it passes to the enforcement agent and the extra fee is added. Im not ok with it but understand that is how it is done so no point arguing it. What sort of payment is the agent like to accept?, will this be treated as just a debt and less urgent?, I can reasonably pay it off in 4 or 5 months but the woman on the phone was pretty unreasonable and laid down the law. Don't they think id have paid it already if I had 3x the due amount spare? Should I tell them I'm moving, could it strengthen my defence?, but at the same time I don't want my landlord having to deal with bailiffs. Is it fair to say I've moved and I'm sleeping on a friends sofa then not giving the address?. Obviously thats going to be registered with council in a few months. should I pay anything or make any contact with them or just wait? Can I still sell house contents presuming nobody has been in and listed them?(nobody will get in here, 4th floor up and 2 looked doors + intercom. Tbh I don't answer the door unless expecting someone anyway. I don't have a lot, tv and an old mac pro + a few bits of vintage music equipment and some records. My cars sorn as it needs work for mot but they can have that.
  13. Its a hire agreement regulated by the consumer credit act 1974. Ive drafted a CCA request to send. My stance at the moment is that I do acknowledge the debt and wish to make an agreement to repay however i'm pretty annoyed at them adding 18%pa interest because I have tried to arrange repayment with them only to receive generic scripted responses. Seems EAME are PB's in house collections, can't find any info online about them.
  14. Right default and termination received and they have now passed to a debt collector. Seems the default notice was not served under the cca, unsure if this makes any difference? They are adding interest at £70 a month. I did try and arrange with them the other month but they were just making no sense to my emails. Something that does confuse me, if they have terminated the contract then can they keep adding interest?, seems they state its commercial interest although this is not mentioned in the agreement just by the debt collector. It states the following in the terms of the agreement. "If this Agreement is terminated for any reasons during the Minimum Period you must pay to us all amounts already due to us including any Interest payable on those amounts together with any expenses and costs incurred by us due to your failure to keep to the Terms of this Agreement plus all Rentals which would have been payable by you for the duration of the Minimum Period. Where you fail to pay us any Purchase Power sum on its due date we will charge you late payment interest calculated on an average daily balance basis at a rate of 0.0497% per day compounded monthly and also a late payment fee of £12 each time you pay late. Other Charges: The following Clauses set out details of other charges that are or may be payable by you under this Agreement Clauses 3.3; a.l [d]: a.2[bl and 10.3." 8.2 You will (a) have a period of up to 25 days, from the date of your statement which includes the transactions charged to your account, to repay the full outstanding balance of the account. The full amount must be paid in a single payment; (b) Transaction Fee for Meter reset is £6.84 per Meter reset. © Where you fail to pay us any Purchase Power sum on its due date we will charge you late payment interest calculated on an average daily balance basis at a rate of 0.0497% per day compounded monthly and also a late payment fee of £12 each time you pay late. 8.3 If this Agreement is terminated, your Purchase Power arrangement will be cancelled automatically. Any amounts due by you to us under the Purchase Power arrangement will become immediately due and payable on cancellation. .8 If this Agreement is terminated for any reasons during the Minimum Period you must pay to us all amounts already due to us including any interest payable on those amounts together with any expenses and costs incurred by us due to your failure to keep to the Terms of this Agreement plus all Rentals which would have been payable by you for the duration of the Minimum Period less a discount at the rate of 3% per annum from the date each payment would have fallen due to the termination date. However surely once they terminated the contract they lost the right to charge that?. Any advice would be much appreciated.. Ps I should point out that I've not done a cca, I am just using the agreement I signed and scanned back, infact for this reason I can categorically guarantee that they only have a scan of any agreement. Is it worth me doing a cca?
