Thanks DX He actually said to me he'll come round if I don't make a payment, and I don't want that hence why I want to send a letter in as he ignored most of what I said and tricked me into admitting the debt. It is for a card I had and last payment was a year ago. They have sent a few letters since, I lost my job and am working now but earning a fraction of what I was so can't afford the fee he quoted me if I rang up their office and I am more than happy to pay on my terms but don't want another house visit or phone call again. I will send a CCA request too.
  2. Hey there! Thanks for your reply! Oddly enough he was quite an old man I thought he worked for a survey company or was collecting for a charity or something.. .. I shouldn't have even answered the door. He said "I guess you are (name)....." and I said can I ask who it is please. Should have just said no and told him to go away. .. really big mistake doing so. Debt will be on CRA file but not sent em a CCA request, in fact have ignored all their correspondence until now. If I send a letter saying that I only want to communicate in writing will that make the calls and house visits go away. CP
  3. Hi there! Have read some of the excellent advice you guys have given here and have read on here about the scare tactics that this company use. Yesterday I had a house visit from one of them for a debt from Barclaycard, this was after all the pre-court letters etc they have been sending. I said that I wanted to deal with the matter in writing but the way the guy spoke to me tricked me into agreeing all of the debt (when there is some of it I dispute) and he wouldn't leave until I agreed to give him my phone number and to discuss with them about setting up a payment plan. I live with my parents and don't want him coming around again as I might not be there and it causes them unnecessary stress. I said to him on the phone earlier I only wanted to deal with the matter on writing and he gave me Moorcroft's number to speak to to set up a payment plan and to stop "gobbing off at him" when I quoted "In the event that you intend arrange a Doorstep call by your Employees or your Agents, please be advised that under OFT Rules, you can only visit me at my home if you make an appointment and I have absolutely no wish to make an appointment with you. There is no need, as written communication is quite acceptable in Law. Please note, there is only an implied license under Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore, take note that I revoke license under Common Law for your Employees, or your Agents or your Representatives to visit me at my property and, if you do so, then you will be liable to Damages for a Tort of Trespass and Civil Action will be taken. The Police will also be called." before saying that I admitted to the debt as that's what Moorcroft wanted me to do. Any help would be appreciated, I want to only deal with them in writing. Is the next step to write to their head office recorded delivery and quote this. I don't mind paying for the debt of course but seriously don't want intrusive debt collection from bullies who legally can't do anything anyway unless they take me to court!! CP
  4. Hi, In March 2005, I was involved in a car accident. Although it wasn't my fault, it went knock for knock because it was in a country lane, with no road markings. There was a Motor Traders policy in place at the time but they found a technicality not to pay out. For years I have had the Motor Insurance Bureau and other Debt Collection agencies send letters asking for £7,000 for what was originally a £13,500 claim from the third party. They have just called me again today, and I hadn't heard from anyone for over a year. I have told them to put it in writing and not call me, but I am worried that this isn't going to go away. Can they enforce this debt? If so why haven't they done this already and given a CCJ? Does Statute Barred apply as it wasn't a credit agreement, and the £13,500 debt is from 2005. I am not one to bury my head in the sand, I want it dealt with but I am in no position to pay it. Please can you advise? Many Thanks. L
