  1. Hi I would be grateful if someone could help me with motormile. I've posted about them before as they were harassing me at work , leaving messages on the directors voicemails disclosing my name and why they were calling and sending emails threatening to visit me at home etc. etc. I've had nothing in the post from them at all just emails to an address I don't use much anymore and check now and again. The messages simply said 'Please call MMF immediately to arrange a home visit' or telling me someone would visit me as I had ignored all attempts to resolve. I replied to all the above , wrote to Rob Sands, spoke to a 'Barry'and a 'Pat' via email. I told them I acknowledge no debt to them, told them I revoke doorstep visit , accept written correspondence only and under no circumstance will I tolerate calls to work. I sent all the recommended letters by email and had acknowledgments. I told them I wanted to make a formal complaint and sent fao compliance , I was contacted by 'Pat' from 'customer relations' who said I needed to provide my full name address and date of birth so that they could 'prove my email address was secure ' I told them I wasn't providing this information as they hadn't been bothered about security and data protection when calling my boss ! and when emailing me before. I had no further contact from them. I subscribe to all 3 credit reference agencies and monitoring services . I have no outstanding debt or defaults that I am not paying or have not settled. I have 2 defaults that I am paying which drop off my file next month as my debt problems started 6/7 years ago after relationship breakdown and I've worked really hard to sort out my finances correct errors on my credit files and pay off any debts. MMF have out of the blue slapped a default on my credit file. To clarify , it's a new default , reporting started 1 July 2014 and they have stated the account defaulted July 2011. There was no previous default to the original creditor so they haven't taken over reporting. I've received no pre default notice or anything and had told them I didn't acknowledge any debt. How can I deal with this - I know MMF think they are above the law and can do what they like to try and recover money. I'm worried as I'm left with a default for 3 years which I really don't want. Thank you -advice very much appreciated.
  2. These idiots are harassing me too. Automated calls to work and leaving messages on the answerphone with just a ref number and telephone number saying 'we need to arrange a visit to your property' resulting in my employers phoning them to be then asked for me by name once the reference number is quoted. This is surely not allowed is it? They haven't written to me or called my personal numbers at any time. The only correspondence I've had is 2 emails, one stating I need to call them and one stating I owe £689.20 to swift sterling and as I have ignored their contact attempts they will be carrying out a home visit and a review of my finances ! I've sent all the necessary letters i.e prove it, harassment, even a letter I found re processing of my data from the ico website due to them disclosing the nature of the call to colleagues, they still persist in phoning. My manager rang them this morning and asked that they remove the number. I've emailed the FCA I know they can't help with specific cases but MMF could still be fined could t they . Oh they too said they are preparing a default , they said this in their first email to me, there's nothing on my credit file from 'swift sterling'

Well , emailed Scotcall , told them politely that their last email about right to revoke doorstep collector not being valid being a load of rubbish , told them I dispute the debt and will be looking to get my credit file updated and the negative info removed. As Scotcall only ever sign 'S White' or put no signature at all at the end if email and letters I asked for the name of the person that had replied to my email and for the name of their superior as I wished to make a formal complaint and explained very nicely that also would be reporting Scotcall to the OFT. Result ! They replied saying that they are closing their file and sending the account back to 3 and I won't hear from them again. In the meantime I'll be writing to 3 to try and get this cleared up.
  4. I have disputed with 3 , they say that I didn't cancel and so my account lapsed and was disconnected. This isn't true I spent over an hour on the phone to a call centre abroad (India I think) whilst someone tried to sell me a new handset . I still have a mob broadband contract with them and have never missed a payment on this. I've moved in the last few months and given 3 my new address but there's been nothing further from them about my old contract. I cant log in to my online account as i can't remember the password and to reset you need your sim no and phone to receive a text and i don't have the sim or phone and even if I did it's disconnected. They've got me over a barrel it seems as I can't prove that I cancelled. I know that I did , my contract ended on Boxing Day and rang them 2 days later , I was quite ill with flu at the time and remember how fed up I was that I couldn't get off the phone to them ! My daughter remembers me being on the phone to them for ages. I don't want to pay them money I don't owe but I would to get this resolved , it's the default that concerns me as this will stay there whatever. Did you have a default with them ?
  5. Thanks for your advice. I'm well aware of why they are calling but it's unacceptable. It is also not good asking someone to take out further credit to pay off debt and an interest free credit card is for a limited time only so you could end up worse off. All that said I've now paid them off - I always told them I would when I was in a position to do so but told them I would call them when I was able and that they we're wasting their time calling me. For a long time welcome were great , my loan rate was even quite low compared to some. As I said I was overpaying for a long time but as a single parent for a long time in the current climate I didn't have the means to settle and wasn't able to access low rate credit cards or loans. I had no end of problems with them during the last 18 months countless errors etc, it's been a very difficult time for my family as well and quite frankly I don't think I should have to put up with it. They've now closed my local office and the new office phoned me and told me the settlement - I had the funds so I paid it off. Finally free of them ! It's saved me about £150.
  6. Received an email from Scotcall threatening doorstep collector as according to their client I had made no attempt to settle blah blah blah. They say I owe an amount to Hutchinson 3G which I'm disputing as I cancelled the contract giving 30 days notice at the end of my 2 year contract. I have a default listed on my file and plan to challenge as I believe it's unfair and incorrect. I responded to Scotcall with the harassment letter and doorstep visit letter and began putting together details of why I dispute this debt. Scotcall responded within half an hour with the following. . "The case you have referred to is not applicable to your circumstances. As part of the credit agreement that you signed and entered into, you agreed to repay the full outstanding balance and that where necessary, the creditor could recover the debt by outsourcing the debt to a third party, which included by way of doorstep collection. We are entitled by law and under contract to recover monies outstanding and we are allowed to take reasonable steps in accordance with regulatory guidance to recover such monies. Please advise us of your repayment proposals " Is a mobile phone contract a credit agreement ? Plus the contract has ended and I dispute the debt. Help !
  7. Welcome Finance are really starting to annoy me . . . I have a loan with them , due to finish paying in feb 2014. whilst I have had problems in the past with other creditors, hence taking out a loan with these idiots 6 years ago) I am NOT in arrears , I did make a late payment once due to THEM not updating my bank details and they charged me and kept adding interest , I didn't know about this for several months - that is another story about which I posted previously. my account was brought up to date and later ,as soon as i was made aware, paid the charges to keep them off my back as I was accruing interest on them . This was over a 18 months ago. At the time of doing that they asked me if i would be willing to overpay my loan to get it paid off quicker. i I am aware that Welcome are no longer lending and are trying to get their accounts paid up but it was better for me to try and pay it off sooner as I'm trying to get debt free. My payments were originally £37.94 a month and I increased to £50 a month. I have been paying this every month by direct debit for the last 18 months. A couple of months after I set this up they kept bombarding me with calls to home and work and on my mobile leaving messages for me to call back. I have previously requested they do not call me at work and later wrote to them requesting no telephone contact at all. They were ringing to try and get me to settle in full and even suggested I borrow allbeit on a low rate or interest free credit card, in order to pay it off. After I requested again in writing that they stop calling I kept receiving letters requesting I call them and also settlement figures in the post supposedly responding to my written request for settlement. I rang my local office and happened to be put through to a line manager as my account manager was away from the office. He apologised and said I would receive no further contact. After a few months the calls started up again . They phone every 60 days. They also change my direct debit each month to coincide with my pay day (last working day of month) I used to pay them on 1st of the month. I got called just over a month ago by the person that had 'taken over my account' she suggested I get an interest free credit card to pay off my loan. I told her I was not in a position to do this and don't want any further credit. I told her she was wasting her time calling me each month not to mention calling at work as I am not in a position to pay it off. They have even suggested a family member pay it for me. She told me my account needed to be 'reviewed' every 60 days. I don't wish to talk to them at all and want them to leave me alone . If I had the money available I'd gladly pay it off to be free if them forever. How can I get them off my back they are driving me up the wall !! Advice appreciated ! Thank you.

Should I ask them for a list of payment dates and when they think the account actually went into default - all I have is an agreement dated 27 march - if this was a payday loan or 'cash advance' as it was then then it should have been paid at the end of April, its possible that it was rolled over but until I go and sort through a box of papers in the attic I have no idea when the first payment was missed if at all. I changed bank accounts that year sometime so it would be a case of digging out statements from 6 years ago. I did have debts around this time but paid them off, some in full and some I came to a settlement with. If I owe this money I would not expect to get out of paying it and I wouldn't have knowingly left it. They say the original amount was for £200 but the debt is £360
  10. The thing is even if I owe this money which I genuinely understood to have been cleared this is the first contact I have had in 6 years ! They obviously wanted to get in quick as this debt is surely now statute barred. If I had received any contact from uncle buck or any dca I would have responded and come to a settlement. I wouldn't want this hanging over me, it is them who have prolonged things by sending shady emails threatening doorstep visits without first disclosing what the debt is for let alone who they are. I clearly have responded to their emails as the idiot who had responded has attached all my emails to them yet states I've refused to discuss it. It's taken over a month to ascertain amounts and dates relating to the debt in question, the bit about doorstep collection and creditors being different to the postman etc makes no sense and is copied and pasted into every email sent , its obviously a rehearsed line thrown in for effect. As they have copies of my bank statements and a signed agreement (which they have attached to an email sent to me , before ascertaining I am the debtor) I am not now disputing they have the right person but is it enforceable as its been more than 6 years and I've never acknowledged the debt. I'm not refusing to pay but I refuse to deal with them under the circumstances. I'd be grateful of some help on this one for sure and any advice on what to do next. Thank you.
  11. Received 23rd April - first explanation for contact from them. They have attached copies of some bank statements with the email yet they are only corresponding by email and don't know that I am in fact the person they want. Am I right that a debt from march 2007 would be SB'd ??? I am still waiting for the letter they said they sent me on 2nd April ! I did take out a cash advance in 2007 but I thought this was paid in full and can't understand why suddenly I'm getting these emails. I changed bank accounts in 2007 so it would take some digging to check this. Either way its their conduct throughout that's unacceptable as they've never before provided a full explanation as to who they are and what they want. Here is their email :- Good Morning Thank you for your recent email, the content of which have been noted. Having now had the opportunity to review this matter, I have determined that the loan of £200 was originally issued to you by Uncle Buck in March 2007 and we purchased the debt in February 2013. We therefore legally own the debt and the current balance is £360. I have attached a copy of the loan agreement with Uncle Buck along with the documentation you supplied to them during the application process, which includes bank statements and wage slip. Should you still feel that the debt is not yours, I recommend that you contact the Police regarding this and we will be happy to assist them in any investigation they choose to undertake. Should the Police determine that this is indeed not your debt, we will of course amend our records and your credit file accordingly. Please note that until this information is forthcoming from the Police, we will continue to pursue you for the debt in your name. I feel it is important to note that to date; we are yet to be contacted by the Police or Uncle Buck to advise that a fraud investigation is underway. If you have raised the matter with the Police, please can you provide the following information so we may contact them directly: · Police crime reference number. · Name of Police officer handling the case. · Name and contact number of the Police station where you have raised the concern. · Also a copy of your bank statement showing that you have not received the monies. In relation to your notification of your revocation of the doorstep licence regarding our intention to send an agent to your home to discuss the debt. I can confirm that we are fully aware of this and we ensure that we fully comply with the OFT guidance regarding debt collection and visits by agents. You are not correct in your assertion that, under OFT rules, we can only call at your home if you agree to make an appointment. The debt is not reasonably disputed or deadlocked, and we are giving you reasonable notice of the timing of the intended visit. In law, a creditor is in a different position to a postman or a member of the public asking directions. When you took this loan, you impliedly agreed that the creditor could communicate with you to discuss repayment. You do not have the contractual right to revoke that agreement until the loan has been repaid. Yet you have frustrated our attempts to discuss the matter with us either by letter or telephone. Please contact us on XXXXXXXXXand quote reference XXXXXX to arrange a repayment plan for the outstanding balance, or to discuss a settlement. Our collections department is available between 8am and 8pm Monday to Thursday, 8am to 6pm Friday and 9am to 2pm Saturday. We look forward to hearing from you. Update : following the emails exchanged yesterday I have been sent no less than 5 email yesterday afternoon threatening court action / legal action etc etc yet the person that emailed yesterday said I had 2 weeks to respond to their letter of 2nd April that I would receive in due course. She said i would need to enclose documentation to prove i do not owe the money. i know that it is them who must prove that i do owe it not the other way round. I wrote to them yesterday and enclosed a copy of OFT's information with regards to my rights and DCA's I emailed them this morning and told them I consider 5 successive emails verging on harassment and will no longer deal electronically and going forward only deal with them by post as every time I open my inbox there are emails threatening this and that. I told them I await their correspondence. I am going to dispute the debt then CCA them etc etc in the hope that it goes back to the alleged 'original creditor' and i will take it up with them. if this is legite then it must be SB'd although i should remember ! I can't believe they are threatening court after a few shady emails ! Bring it on motormile !
