  1. Right then. Been out the country working over the summer and going through a divorce so haven't been on this at all. Which means of course that its all caught up on me. So, replied to original claim saying that i contested the claim and that i wanted any court hearing to be held in Bristol. This seems to have been ignored as i received a Judgement for Claimant in default stating that i owe Marlin £14265.55 (dated 28th August, because of my personal situation I'm kinda homeless/sofa surfing and on a postal redirect so things come in a week late, not handy in this situation). Mortimer Clarke straight in with threat to obtain Charging Order or Attachment of Earnings Order. N244 form seems my only response now, but looks like i could use a lawyer (legal world is making a fortune off me at the mo). Any help/advice you folks can give would be much appreciated. My work takes me out the country on a regular basis so i have to hit this hard and quickly.

  4. Oi oi. Don't go saying no one reads this anymore. I'm no facehooker or twatter so this and Fuzzbut's page are my link. I'd love to read the Crown Currency exchange article, might help in the letter to local MP who is championing ethical banking in the current climate but told me a year ago (backed with a letter from HM Treasury) that ours was a contractural matter and the government should not get involved. Just building a portfolio of press and personal stuff to drop on his desk again. Anyone else from central Bristol want to add their tuppence worth to a letter to the MP?

I've just sent a brief overview of the Access/Advent/BPF situation to WHICH? magazine, seeing as they've had success with the mis-selling of PPI for loans by the major banks, and the banks felt the sting. I've flagged it as a 2 pronged complaint, one is obviously the behaviour of BPF, the other is the regulation of the private training firms. Can I encourage more to do the same as they might see by numbers that there is a campaign to get behind.

The back of the access2 enrolment form, paragraph 2.1: "No contract exists between you and us for the supply of the Services until a completed Enrolment Form has been signed by both you and a person who has the authority to sign the Enrolment Form on our behalf." its signed by me, but not even a space for another signature. Also paragraph 10 - Termination " 10.1 Contract will terminate immediately on notice from us to you." ............... is that the notice that they ceased trading? "10.2 In the event that we make any voluntary arrangement with our creditors or become subject to an administration order or go into liquidation......" ........ liquidation
  10. Yep, got that and its signed by me, not a copy, my actual signature. Oh, and Moorcroft have sent a "notice of litigation" this morning for the first time. Am i right in thinking that by informing them that my account is in dispute and being investigated by the FOS they'll back off?
  11. My Access2 enrolment form has start and end dates filled in by the rep. However, i have noticed that the "Finance ID" section is completely blank and unsigned by me. Gonna get me anywhere?
  12. Hi all, NEWBIE ALERT Glad I found you, been fighting BPF since ACCESS 2 TRADES went down (having received no training). I've had my head down for a year dealing with this and being under the cosh for £11k has sort of isolated me. Its only the levels of exasperation and incredulity that have made me look up and find others. Got my MP involved (bristol lib-dem with a crusade against bad practice in the banking world............apparently) which got Mercers off my back, and a stern letter from MD of BPF (he offered to knock the £50 missed payment costs off my debt....nice) but not much else. Strength in numbers. As an ex Access student can i still jump in with the Advent case? same puddle as far as i'm concerned. Also, lets chat. I need 5 posts til i can get more help and exchange of info. Its been a strange mix of elation and anger reading all these posts. Again, glad i found you.
