  1. Thanks for the responses, I was hoping that would be it after the claim was discontinued with cabot, I was unaware they could then sell the debt on. I guess it is ok though since the debt is SB. Will see if I hear from CCS Collect and take it from there. Will send them a statute barred notice or the notice of discontinuation or both.
  2. Hi all, had a letter today from cabot stating that they have passed the account to CCS Collect and that they will contact me within the next 7 days to make repayment. So what do I do now do I just wait to see what CCS send me then send them the statute barred letter? Thanks in advance.
  3. Thanks panther12, I suppose £185 isn't bad if they are going to try to recoup 5k & I bet a hell of a lot of people contact them to make arrangements to pay after receiving the claimform through sheer panic.
  4. £185 wowzers - thought that was just if it actually went to court, so is that how much they would of paid just to get it to this stage?

  7. Hi all, today I have received a letter from restons. It says please find enclosed by way of service upon you Notice of Discontinuance. We are now closing our file and thank you for your cooperation. So is that the end of it? I have just checked moneyclaim and nothing has changed on there as of yet.
  8. Hi all, just an update to this case. Nothing to report as of yet, the only thing I have received so far since submitting my defence on the 5th January is a letter from the courts & tribunals service stating that they acknowledge receipt of my defence and a copy is being served on the claimant that if the dispute cannot be resolved informally then the claimant will inform the court that it wishes to proceed that they have 28 days to do so from receiving a copy of my defence after that time if they have not done so then the claim will be stayed.
  9. Hi Panther, yes my wife said the same thing as you, they would not respond to my CPR request as my letter was not signed but were happy to use an unsigned full & final settlement letter as proof that the debt is not statute barred.

  11. Just had a letter from Cabot in response to my CCA request stating that they do not currently have this information on file but will aim to provide it within 40 days. I suppose it doesn't matter now as I have already submitted my sb defence.
  12. Ok all done and submitted, fingers crossed that will be the end of it but we will see. I looked last night and I know for certain that no payment has been made to them since January 2008 and I have never submitted anything else to them that has been signed by myself. I would just like to say thanks to everyone on here that has helped me upto this point as I would not of had a clue what to do without you and a special mention to dx and Andy who have been particularly helpful. Will keep you informed on what happens next
  13. Thanks dx so I just put the above with the total claim in the box online where it states to defend my claim with a maximum of 122 lines? Also there is an additional details box, do I need to fill in my email address & telephone numbers? Just wondered if I did would cabot get them as they do not have my telephone number and don't want to be called constantly by them.
  14. Ok just logging my defence now so do I just input the below online where it says please state your defence in a maximum of 122 lines? The only thing I have changed is the date of the claim and the amount claimed. 1 The Claimant's claim was issued on 17th December 2014. 2 The Defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation acticon 1980. If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. 3 The Claimant's claim to be entitled to payment of £4554.57 or any other sum, or relief of any kind is denied. Also I have put the amount claimed as £4554.57 would that be correct or do I add the amount including court fee's and solicitor costs making it a total of £4819.57? Thanks
