I would like to thank you all for your responses, I have now resolved the issue by talking to another of the parties involved and although some of the people involved may not be too happy about it we have come to an agreement and the car should be back tomorrow. Sometimes you have to point a few things out to get some sense into a situation. I am glad there are a few decent level headed people left in the world and lots of people willing to share good advice, again thank you for reading the post and taking an interest and sharing your advice.
  2. No this garage does not sell cars it fixes them unfortunately. It was sold by the people that work there it seems the guys have a sideline fixing cars and selling them.
  3. He has also moved the car from where we had it delivered to and has driven it also? Stealing, driving without the owners consent. at no time would he inform us of what he was doing neither did he discuss the cost of repairs or ask if we would pay for repairs. So we are very shocked about this. Not sure where the garage stands either because if was sold on their premises and returned to their and they accepted the keys and vehicle when it broke down. What a mess, why cant ppl be straight forward.
  4. Hi thanks for reading my post. My daughter wrote her car off in an accident, we were looking for a used car for her to use a couple of weeks later and went to our friendly garage to ask the guys who in the area sold reasonable cars and they told us that one of the guys was selling a car, they called him back to the garage to talk to us in the meantime we looked at the car. We were told the timing chain had been replaced and the car serviced we asked what else was wrong and if anything needed fixing. we were told it was a good car and picked the car up a week later when the funds came through. it was used for a couple of days going to work no more than 10 miles a day then on the thurs the car was taken on a 75 mile trip to a hotel at 60 miles the car lost power and cut out. we spoke to the guy at the garage and said we want it fixed or our money back, he agreed to repair it. The car was removed from the garage to another garage as this was a commercial premises where they were employed and suposibly work commenced after a couple of weeks and constant chasing and visiting trying to get the car back. We were informed after work started that the work was being done by one of the other guys and they were selling the car together. I got a phone call today to say car is now fixed and this other guy wants nearly £400 for parts. I explained that this was the first real run with the car and it was their fault if had damaged the head but this guy said if we dont pay we cant have the car back. I stated that as far as i was concerned the car was sold by the other guy as he was the one we spoke to and who showed the car and took the money and i would deal with him and he said no money no car and put the phone down. what can I do, my daughter is a single mum took a loan out for this car and cant afford the £400 as she hasent got it. When car was collected the guy who sold the car said anything goes wrong just bring it back and I will sort it out. Where do we stand. I would be grateful for any advice given. Thanks

  6. Due to to partnership breakup my house was sold by the mortgage company which left a shortfall on the original mortgage. There was also a secured loan on the property, I have no idea what has happened to that. Due to ill health I stayed with relatives in scotland and have been in scotland ever since, the mortgage company are now writing to me at their address asking for the shortfall from the mortgage even though we are both equally responsible for this. I have had 3 forwarded to me so far. I am unemployed, I have no assets, I am homeless at present and living at the good grace of others and only have a jsa payment. Please what should i do, i do not want other people to be harrassed by this, in the same respect I do not have the money to repay them at this moment in time as I left with nothing. I have read that I cannot be sued in an english court is this correct, both documents the mortgage and the secured loan state that the laws of england and english jurisdiction apply to these agreements. the last payment on the mortgage was at the beginning of the year. So far 3 letters have arrived in one month, apparently they are even leaving messages on this persons phone, which is a bit daunting. I would be grateful for any advice on what to do next as I just dont know what I should or should not be doing,

ThanksSweet Jane, I have no information on what has happened to the loan the mortgage company must have unsecured it, not heard from them, the amount added is the amount added was in excess of 12k above the mortgage, they accepted a ridiculous price for the property, far below the market value. I am having trouble as this property is in england and i am in scotland and I am dealing with a different law system here, no one want s to help. I could contact CAB in england i suppose, but i do not have any funds to offer them so not sure what they can do.
  8. After a nasty split from partner, The house was repossessed and sold which left 20k outstanding and a secured loan. The mortgage company have contacted me I am now in scotland and are chasing me for the outstanding, it was a joint buy. What can i do, I have tried talking to scottish lawyers they say i need to speak to english lawyers as different law. that is difficult now. Any advice would be welcome, I tried months ago to sort this out but the mortgage company ignored my letters. I am desperate to do something as the thought of all this is making me ill. I have no home, no money, no job so not sure what I can do. I would be grateful for any advise.
  9. Hi, Thanks to all, I have taken the bull by the horns sent someone to the company for the lasttime and insisted they hand the cheque over or take legal action. Worked, got the cheque, so thanks to all, shame some firms cant play by the rules. Thanks again for the advice.

I split with my partner which ended violently, took a couple of days a/leave, then decided that it would be impossible for me to continue working at my company as my partners Mum was a senior manager there. I wrote resigning and requesting all final matters be handled through a third party as I had been imtimidated by the family member. And here we are nearly six weeks since the letter and still no money which is in cheque form. What can I do. They havent contacted me by phone, they received the letter I know because a second copy was handed to them. I am so frustrated, surely tey cant do this. Any advice would be welcome.
  11. I have a £154K Mortgage (interest only), a £51K secured loan, the property is I am sure in negative equity by £25 - £30K at present. The mortgage is probably £2k in arrears at present, loan about £400. I have not choice but to hand the property back, it is now empty, as I left due to safety reasons, the other party has now also left. Not sure what to do, do I write to the mortgage company first and advice them that the property is empty, they the loan ppl or ????. Due the situation that arose, I have lost my job, therefore no income, the other party has also I believe lost theirs due to mental health reasons. Please can someone help with advice. Need to do something just dont know what to do. I have no funds, no job, no home.

  13. hi, I cancelled an insurance 1 month after it started due to them putting the premiums from £330 to £400 to £500 within one month of paying deposit, They say I cant cancel and then cancelled because i wouldnt pay monthly premiums. Now debt collector, what to do CCA and then tell them to go away? Any advice, I think they called it a running account but dont think i signed anything. Grateful for any help.
