Hmmnn I wonder if these big businesses will be paying at any peak rate times...lets face it many of them already get a discount as they use so much...they should be paying more, perhaps a sliding scale lie tax would be better I:e you pay a very small charge for the first 2000 kilowatt hours, then the next 1000 kilowatt hours you pay more anon anon anon....that would be a more productive way of encouraging savings as well as helping the less well off as the basic cost should be lower than it is now...

Deposit was paid in april...the rest was paid via building society counter check, the terms of the company were monies paid on completion as person ordering work lives in london house on south coast had to leave the check, with tennent, since the fitters did not have job sheet ect no signatures were made to the effect job was signed of... was not till fitters left that noticed the defects noticed ect, they did try to stop counter check.. explaining to branch that issued check within hours of work done...branch would have none of it....several phone calls and faxes sent to them as well...but no satisfaction. contacted company left answerphone message and sent email informing them if they cashed check would be fraud given work not completed ect..who at first were appologetic and all that flannel...had not then cashed the check..said they would put right the wrongs...but looks like its all flannel...they have since cashed it knowing full well it was for the wrong amount..I:e £300.00 charged for templating servise that was not done, plus other omissions total cost almost £2000.00
  3. Deposit £400.00 goods supply and fit...not all the goods were delivered, on the fitting size one worktop smaller than specified size, and a join across the tap hole on a belfast sink...on the hob side join where one should not be needed. goods came to approx 60percent of total cost...
  4. I sympathize with you in my time being on benefits since 2000 full time and part time that is for over 18 months the three years preceding as could only get seasonal jobs or employment agencies. Took me over fifteen months in2004/5 to get any housing benefit paid during that time I was living on credit card, and for the first year had deductions made from my incapacity benefit for allegedly not notifying them of payment of a ill health pension despite them producing documents to a tribunal clearly showing they knew of this six months before they claim to have learnt of it, notwithstanding it was a Local government pension, so they should have informed them under that act passed in 200 to prevent benefit fraud. Excuses given to lgo have ranged from flooded building to staff off sick, only just receiving information in post this morning not receiving paperwork from me (in many cases no such paperwork existed) or it had been sent to another department and not been returned. I have been taken to court for nonpayment of council tax and at the same time had all my benefit stopped as It was claimed I did not notify them of my change of address, I have been sent the letters telling me They would commence bankruptcy proceeding against me, as well as visits from bailiffs even had two arrest warrants taken out (when I presented myself at the police station to be arrested was told to go home as they had to ask for action on them) the saga goes on. since again having to move as landlord previous died and his wife decided to sell, and at my present address I am not liable for tax since the owner is paying it I have still been presented with a taxbill inckuding arrears for the past three or four years that I have not paid but have put in several appeals against but have not been heard. So take heart some of you as there is someone that is slightly worse off than you, :confused:
  5. Long and short of it, had new granite work tops fitted(well supposed to be fitted. The initial deposit was paid via credit card, and the rest by counter check, since day one have been in dispute with the firm as they did not carry out the work to the specifications of the contract. have had several discussions both on the phone and via email to get the matter resolved. Following on from the latest contact it seems the firm are not going to put things right, is there a template letter that I can send to the credit card company to have the money refunded. How much correspondence should I include with this letter.. see my user page for other details, if it helps

Just marking as have a case, where the firm of solicitor that was supposed to be advising me about a benefits claim and possession order, brought my flat from me the week before it was due to be repossessed...woolich who were the mortgage holders took over five years to bring the case to finish, using two different firms of solicitors, as after the first hearing they did not turn up so the case was stayed they then restarted it with a different firm, they were criticized by the ombudsman (woolwich) whom I had already complained to about payments made by them to the freeholder despite knowing I was in dispute, and mot informing me beforehand.

  8. As welsh man says forming your own company may be considered a conflict of interest, and could be grounds for dismissal...

As below I'm no legal expert...either Employment Rights Act 1996 (c. 18) is a link to your employment rights, and as you have been with my employer for almost 3 years, you come under the scope of those acts. now to your initial points and my thoughts 1. Starting my own business based on the fact i have no contract and it does not interfere with my daily work commitments and is done in my own spare time. Since you do not at the moment have a contract it should make no difference, but bear in mind if the boss does draw one up he is liable to add a provision that you cannot conduct a business of a similar nature to that which he he employing you with, whilst employed by him or/and after you cease for a period of (x) years after, think the standard is about a year. 2. Do i have to change my hours how my boss insists. that's a tricky one, yes if the request is reasonable, but he has to give notice well in advance, and I think also enter into negotiations, to take into account one parent families, carers ect (in larger firms this would be with union representatives) looking at the hours mentioned that would be classed as reasonable so doubt if you could argue that out in a tribunal, should you use "constructive dismissal " your boss is starting to single you out and treat you unfairly compared to other employees. It may be prudent to start keeping notes of instances where he has done this to cover your back so to speak. 3. My holiday pay and how to approach my boss Think you will find holiday pay is covered in the contract of employment 4. My employment contract or written statement of terms. Again, see answer to 1, but also there is a term used called "custom and practice" which I feel would be relevant in your case, I:E if you have been doing the job a certain way for a period of time, he cant all of a sudden say, he would like it done this way. Up date...visited Building society, first thing yesterday, to confirm they had received the note (included copy of counter cheque) and requests as per Also the persons who own the account the amount on the countercheck was debited from had phoned them, and was informed that it could not be stopped. Following phoning up Granite r us (who seem fairly amicable) who by then had read the email I had sent to them and listened to my phone message, and a reduction to the bill was reached... exert below from email I requested confirming he would not be presenting countercheck for payment "We will be more than happy to resolve the problem of fitting the hob and also perform the drainer grooves at a convinient date . We will need to accept full payment of £1482.00 by credit/debit card before these works can be carried out as im sure you can appreciate we have installed the granite worktops in your home and have paid out labour etc." I again visited the building society this morning to confirm the countercheck had been canceled, as I was, informed that the only way it could be stopped was if the payee declared they were not interested in the cheque, I had visited the building society, with a copy of the email, along with The person who the account the monies were debited from had sent a fax, last night and phoned the branch this morning and had not been called back, and was then given the brush off reason being i was not on the account the money was due to be debited from (well it had already been debited to a countercheck) but presume was still earning interest for the B/S . also the peyer should contact her local branch, despite the countercheck being issued at the branch I was visiting. Has any one any knowledge on, law regarding counterchecks along with liabilities, As it seems to me the B/S has failed in its duty of customer care at the very least. Should a letter now be sent to the head office of the B/S, if so is there a template anywere with the acts of parliment I should be useing as a club.

Ok bit of a long post, Decided on kitchen improvements changing wooden worktops for quartz saw this BLACK STARLIGHT QUARTZ 30mm with mirror fleck Quartz surfaces special offer 3 lengths of 3.0 m £99 per/ M Fully fitted £1399+ VAT.. contacted Granite R us filled in the details, sent some photos, and a price was agreed, the day before fitters due 17april, get a phone message saying the fitters would neither remove the old worktops or touch plumbing or electrics. So removed the old worktops disconnected the taps and hob, ready for the fitters... yet on the website...this is shown We are able to attend to plumbing, cabinetwork, electrics etc, should this be necessary, thus avoiding extra charges for other tradesmen having to be present at installation of worktops the day came fitters turned up then decided they could not fit the work tops as there was no place to cut and dress them to the specs agreed. We have received a deposit of £400.00 (with thanks) for the following order: To supply and fit Black Star Galaxy in sizes: 2600 x 630 2500 x 650 2 x upstands 1 x Belfast sink cut out 1 x Tap hole cut out Drainer grooves 1 x Hob cut out Delivery included Based on a one day fitting service Total: £1,782.00 inc vat Fitting date: Thursday 16th April Balance payable on completion: £1,382.00 inc vat. also was some confusion as to the upstands, the client meant pieces between the fridge and washing machine supporting the worktops.... the fitters said they would have to template the kitchen and cut at the workshops for which a additional charge of £300.00 would be needed following a couple of phone calls and emails a new price was agreed, and a new fitting date given (two actually the first being bank holiday Monday in may) today the fitters(different from the last ones) turned up, with three pieces of undressed granite, but were not aware of there being a template but agreed they could proceed with the work as a place was available to cut and dress the granite. they spent the day, fitting the worktops, made a slight change to the newly agreed upstands from three to two, after cutting the three deciding not enough space to fit three down to two... confirming the need for drainer grooves, remeasuring the hob cut out twice. on completion of the job, i had been left with a counter check issued by abbey for the new amount(the one that included template) which I had thought about withholding as terms stated money to be paid on completion, and i was not the person paying was just here to let them in and answer any questions ect, I wrote with reservations on the back of the cheque, as they said they were not leaving till they got payment there being three of them and only me. I then wired up the hob, fouynd found the cut out was to small to accept it, I also then noticed only one upstand was in place and no grooves cut for the drainer. I immediately left a message on the firms answerphone as it was after 5.00 pm when the fitters left, and posted a note through the building society's door asking them not to pay the check either to cancel it or withhold payment as its for services rendered that have not been rendered then sent an email to granite r us, informing them of the uncompleted contract, reminding them should they try to cash the cheque it would be considered fraud. Am I right in thinking this, what should my next move be, have I not done something i should
