  1. Hi please see below the response from BH airlines to my delay flight claim - seems to be saying, yes the aircraft was broke but we are only a charter company so tough! Also interesting interpretation of BH holidays terms and conditions. Whats next then SC court? any views gratefully received: Thank you for contacting BH AIR Customer Service Department and thus giving us the chance to review your complaint. Thank you for your patience while the case was being reviewed. First of all, we would like to apologize for the inconveniences you faced due to the delay of your flight. We do realize that any delay could be quite frustrating and we strive to avoid such occurrences. Unfortunately, delays in aviation do happen and in such cases we try to at least minimize them as much as possible. We would like to take this opportunity to explain that your return flight was delayed due to a combination of factors which made it very difficult for the airline's ground-handling agent to predict how long it would be delayed for. We can advise that your flight was unfortunately adversely affected by a series of cumulative delays to the aircraft on earlier rotations. The root cause of your delay was a technical problem to the aircraft on a previous rotation. We naturally regret to hear that the end of your holiday was marred by the above delay. *We can advise that the track record of BH Airlines on timekeeping is very good, but unfortunately sometimes delays do occur for reasons beyond our control. As a charter airline BH Air has less flexibility than other airlines (such as e.g. Lufthansa or Air France) to replace an aircraft in order to comply with its initial schedule. Preventing this delay would have led us to making „intolerable sacrifices” in the light of the capacities of BH Air’s undertaking at the time of the flight, which sacrifices (as per the rationale of the European court judgment on Case C-294/10 (Eglītis-Ratnieks v. Latvijas Republikas Ekonomikas ministrija) we have no legal obligation to make. Evident from the above, the delay of the flight was caused by circumstances which we could not avoid even where we took all reasonable measures within the capacity of our airline. Furthermore, we would like to advise you that BH Air operated the flight on the basis of an aircraft lease arrangement but not a contract of carriage with you and the members of your family as passengers. The flight schedule announced was for reference only. As stated on Balkan Holidays website – flight timings and routings are only provisional and may be subject to change! Hence, the Airline had no contractual obligation vis-à-vis you and your family to comply with any specific flight schedule and may not be responsible for any flight delay. For that reason and reasons mentioned above, we may not honour your claim for compensation under Regulation No 261/2004 or otherwise. That being said, we would like to take this one last chance to apologize for all inconveniences caused. We always strive to give our passengers only the best customer service and so your feedback as it is highly appreciated.   3. The Notice is addressed from the Court Enforcement Centre, Morley Nr Leeds, but I notice the franking mark on the envelope is from the magistrates Court at Bradford
  4. No - Ive come home from work to find the arrest notice tonight. I tried the numbers on it but no asnwer
  5. About 1 month ago I received a "Final Steps" notice from the Court enforcement office. I have lived at this address for 18 months and never received anything previously. There was no information other than a demand for £290 and a reference number - nothing else, no info what it related to (other than something to do with unpaid parking fines which I managed deduced from the dept address), no dates etc. I wrote to them asking for more information and copies of documents requesting time to consider them, take advice and get back to them. I received no response until tonight when I have come home to a "Warning - Notice of Arrest". Apparently I have to pay £290 or attend magistrates Court on 21.8.13, but seemingly I can still be arrested at anytime before the hearing! I am one of those boring people who have never been in trouble and never had anything to do with the police. Ive never had so much as a speeding ticket. I cant afford to pay £290 even if I did know what it was for. Mine is our only income. My partner is self employed in the construction industry and has no work, but because he is s/e we get no entitlement to benefits or assistance. We are already suffering financial hardship and every month is a struggle to get by just paying our bills. We have debts everywhere and no disposable income so just paying £290 for something I don't know about is out of the question. I just don't know what to do - what my options might be. Im tempted to attend the hearing but I don't know what can happen - can they put me in jail? Im really very frightened but trying to put a brace face on it Please can someone help?

  7. Hi I have come home tonight to find a letter from Sureterm saying Im entitled to a one off refund of £83.07. They have apparently reviewed their sales procedures during 2009/2010 and say my policy was overcharged. They say the sales process that resulted in the overcharge has since been changed to stop this. They need some personal info, date of birth etc at verification, which did cause warning bells, but the contact numbers do seem to be correct. Anyone knows what this is about? Maybe they are trying to avoid "Swinton"! No offer of compo, or interest - just a straight forward refund Thanks Bluex
  8. Hi can anyone help me please? Had notice of child tax creadit overpayment due to us both being self employed at the time (Ive been back in PAYE for 4 years). We had subsequent award notices saying no payments due to previous overpayments, so assumed debt was reducing. Ive just received change of tax code which apparently means they will be taking an extra £165 per month to repay the overpayments. We just cant manage this - we are already on the edge. My salary and £80 fam allow are our only income. My partner is self employed kitchen fitter little or no work - I think he had 4 jobs last year. However we are told we have not entitlment to any benefits whatsoever and my partner is not allowd to sign on as unemployed. We already have arrears on mortgage, council tax, credit cards, bills etc I rang them today and I need to phone back tomorrow with income/expenditure etc.. They also dropped the bomshell that there are other sums we owe that they havent done anything about yet - all in all we apparenty owe around £3000 over around 8 years! We really cant afford much at all, we are just a normal couple in our 40's and 50's with a 12 yr old daughter. We have always worked and CTC is the only thinbg we have ever claimed. We dont have Sky - we cant afford it, we dont have holidays abroad - we cant afford it, we dont drink or smoke, we dont ahve central heating on and all our rooms have mold from condensation, weve tried to sell the house and cant.... Is there anything left we can do? We really are at our wits end and Im physically sick
  9. british gas enginers are salesmen who have to reach targets, and will often condem boilers using any trick they can unsafe/obsolete parts being the usual scare tactic
  10. Hi BF I have an outstanding charges claim. I didnt issue and shabbey said they would await the OFT decision. Shortly after the OFT decision I received a letter from them demanding £1000 being my ovderdraft facility they removed as I was no longer paying in £1000 per month, followed by a default notice. That was about a month ago and now gone quiet. Not sure what to do now, but if they issue proceedings, maybe counterclaim my charges? All coments gratfeully received! Many thanks Blue

  12. I intimated my claim agianst Abbey about 18 mnths, 2 years ago, but didnt issue. The COA case then came up and as you will all know Abbey did not deal, pending the outcome. I have just had a letter from Santander canceling my facilities (which I dont use - I have another bank now), and I will be receving a default letter in 15 days time. Can they default me when the account is disputed? The balance is £1061, £1000 being my overdraft they withdrew! I did get a gogw payment about a year ago, but they even messed that up - it hadnt been paid into my account when they said it had (it didnt get paid in until a week after they said) which then incurred more charges and so it spirals on and I never got the full benefit of the gogw. I am quite happy to let them issue and counterclaim or issue against them first, but I am trying to hold fire on that pending further advice from CAG. Any thoughts guys? Thanks Bluex
