  1. he is being very heavy handed and using every trick in the book including lying and being threatening to frighten you into paying. He may be nice and say ok but may I just come in to use your phone to call my office etc .Don't let them in! When he comes do not open the door even a crack on the chain. Talk through the door. Tell him you are in contact with the Council ( mention the name of the person in Rates dept) tell him you are arranging payment of the debt and that you will be sending an immediate payment of £.. Then go upstairs until he is gone. If he persists and makes a scene or threatens you in any way ask him for his office number and tell him you are going to make a formal complaint about him . Try to have someone with you to give you confidence. Whatever you do, do ring the Rates Dept and insist on speaking to a manager or head of the debt dealing with your rates. Ask specifically for them and get their name.DON'T give them a load of old flannel or excuses. just apologise for the delay in paying say you have had some recent financial difficulties but you would like to make an immediate payment today of £170.00 followed by 2x further payments of £170.00 on 7th December & 7th Jan Next ring citizens advice and do ring the National Debtline first thing this morning.
  2. National Debtline England & Wales, for FREE CONFIDENTIAL and INDEPENDENT ADVICE call 0808 808 4000 contact these people Lil they are very helpful and will send you a info pack and talk to you on the phone. Never ever let the baliffs into your house. They have no legal right to enter providing you do not let them in. If you invite them in under any condition they can seize your possesions or make a list called a walking possesion which means they can take them at any time, The Council can make an agreement with you but you need to try to get to speak with a dept head or manager of the collections dept not a junior admin clerk.
  3. I would advise you contact the Solicitors without delay and ask for a 2 -3 week deferrment of the action to give you time to take professional advice prepare a defence and assess your finacial circumstances etc. This will give you a short time to negotiate with them. They bought your debt for a % of the original amount and would probably be prepared to settle for a lot less if you can offer them a reasonable settlement or alternatively work out a sensible repayment program with them. Be honest about your financial circumstances and don't agree to a unrealistic payment program. That will just put you in a worse situation. Don't whatever you do ignore this and let the hearing go ahead. You will then have an undefended action with a determination of the full amount plus fees, interest etc . Plus a bad credit rating preventing you getting financial help in the future. I have negotiated payment of dozens of debts that I inherited when my business went bust due to F & M I have repaid them all over the past 4 without a single court hearing or judgement. I would recomend that you contact citizens advice right away and get some free legal advice. You could consider taking out a personal loan for say £2000.00 over 3-4years and offering them an immediate full and final settlement of say £2000 They would probably accept that amount because they know its more than they are likely to recover if they take you to court. This will allow you to get instant relief from the debt and give you much lower monthly repayments than you would be likely to get from the Solicitors. Typical repayment of a £2000 loan at A & L over 60 months is £49.00 a month!
  4. Apologies for the delay in responding to your advice barracad It wasn't my intention to be disparraging in my reply I was grateful for your input, however on the basis of your reply above I quite reasonably assumed that you didn't appreciate my circumstances. It is not possible for my company's fees to be paid into a personal account because fee payments are issued in the name of my company Re the basic business account , as I said in my initial post I have already made an application for a business account which had been refused. That is my dilemma. I have in the mein time submitted an appeal and hope to receive a favourable outcome. Thank you for all your help everyone
  5. I think you need to understand the difference between a basic business account for say a partnership or sole proprieter and a Limited Company business account which has to be a limited liability company registered with Companies House with directors secretaries and a whole world of painful forms ,returns, PAYE, corporation tax, dividends etc etc It takes 4 weeks to open a Ltd Co account and every signatory has to be verified by Solicitors etc
  6. Yes I purchased instant access to my credit history and even Experian say its fine. The recruitment company will not pay any money unless its into a limited company bank account. These are completly differant to any other bank account . If they would pay into a personal account I could give them dozens The money isn't mine technically it belongs to my Limited Company of which I am the sole Director. I pay myself wages and dividends
  7. Hi All first post so go easy on me lol Lloyds have just closed my Limited Company business account a month ago because I requested an investigation into unfair treatment by my Business Banking Manager. Consequently I am now unable to receive my weekly fee from my employers . Because the recruitment company that employ me (through my Limited Company) insist on paying only by Bacs transfer into a limited company bank account I have not been paid for 6 weeks . Can't last much longer without going bust. Can anyone suggest a solution please. I submitted a application to A&L bank for a business account and after 5 weeks they came back and said no. They claim it was due to something on my Experian credit history but that is a s clean as a whistle. How can I get paid ? any ideas please?
  8. Hi everyone. What a welcome find this is. I have been with my high street bank for over 5 years and they have hit me very hard with charges because I am self employed. Its the classic case of irregular payments from customers and clients often leaving my accounts a few pounds overdrawn . Recently I have been incurring 3 charges of £35.00 in a single week ! Looking forward to reading all your sucess stories and swopping advice
