  1. Thanks for your help Wizard, by the way our letter from them also looks like a copy! Our letter to them is in the post. Will let you know. As a footnote, my solicitor is very helpful and approachable and tells me that it looks like they are already admitting liabilty so a couple of carefully worded latters should get them to stump up, he says we shouldn't need to get solicitors involved!
  2. We too have had one of these letters. I am about to word a letter to them demanding compensation for their incompetence and the inconvenience distress and worry it has caused us. They surely are responsible for ensuring any information they hold is secure under the Data Protection Act. Does anyone have access to properly worded letter for a case such as this?

  4. Just to underline - she had actually paid for a ticket which she had in her possession but did not have the railcard to support it!
  5. When approached on the train the inspector asked for her I.D. which, as previously expalined, had been stolen along with her wallet and railcard some 2 weeks earlier. All she had was a bank card with her name on it and nothing to support. She was not asked at this stage for her name and address. The inspector simply took the details from her bank card at this time. No PF notice was given to her, the inspector told her that as she had approached the barrier it was assumed she was leaving the station to avoid paying the fine and because of that he would not now issue the PF notice. My daughter, although intelligent, is not very street wise having spent her life until now in sleepy Devon! Up until this point, and being unaware of the system, she had assumed that as he had her bank details that they would be used to collect the fine. At no time did she intentionally attempt to avoid paying the fine and in fact made efforts to do so. She is still unclear if she was actually arrested, she felt so intimidated that all understanding went out the window! As we have no paperwork/reference numbers etc. who do we write to and where? and how do we reference the incident?

My daughter - only been in London a couple of months - had her wallet stolen with her young persons railcard in it together with I D documents, anyway having got a crime number she was told by the ticket office she could still buy a young persons ticket while she waited for a replacement railcard and to quote the crime number to the guard/inspector if asked. Yesterday travelling on the train from High Wycombe to Marylebone she was asked for her ticket and duly showed her purchased young persons ticket and expalined about her railcard. She was told as she did not have the railcard she would have to pay a penalty fee of £20. She did not have £20 on her and the bank card she was carrying had funds of only £16. The inspector took the details of her bank card. She asked him if she could phone me to place some money into that account and she would pay. He told her it could be paid when she reached the station. She assumed that he waould take the payment via her card details. Having reached the station she approached the barrier and to her shock was manhandled by the inspector who then accused her attempting to leave the station without paying. He read her rights to her cautioned her and although she pleaded with him to allow her to make the call to me so she could pay the penalty would not allow her. She was frightened and upset. Does anyone know if she is taken to court and found guilty is it a criminal offence? I think however she has sufficient grounds to appeal. Help anyone??

I have today received a reply to my initial request for refund which includes the following as follows: 'After careful consideration of your request, we're sorry that we can't agree to your charges being refunded. Only in exceptional circumstances do we refund charges and on this occasion we feel it would be unfair to other members who find themselves in a similar situation and whose charges still remain.' Be fairer if they refunded everyone then I think!! LBA on its way today.... Amount: £830 SAR 13.04.07 Statements received 29.05.07 Request for refund sent 29.05.07

Sent SAR 13.03.07 Received statements 27.03.07 Sent request for payment 27.03.07 Received reply 30.03.07 - saying they would look into my claim and reply in 15 days - didn't wait - Sent LBA 12.04.07 Received letter 20.04.07 - saying our charges are fair blah de blah but without prejudice & admission of liability they would be sending a cheque for £230.00 + £50.82 interest within next 14 days. If it arrives in time I will not do moneyclaim! Will let you know.......
  9. Can anyone help? I am looking at a friends business account statements. Each month he has unauthorised borrowing fees etc. but also under 'interest' it itemises the authorised interest seperately from unauthorised interest. Can he claim the unauthorised back?
  10. To be honest as RM haven't bothered to get the signature that I have paid them to get I have pushed my luck and claimed anyway. They have no proof that they have delivered. Once they cheekily asked me to contact the recipient and ask if it had been delivered! I told them that is what they are paid for and not my place to check up!
  11. Seems this Royal Mail service does'nt work very well! I have 5 items sent this way which have not been signed for , therefore Royal Mail can't prove they have been delivered! Don't forget there is a £34.00 compensation for non-delivered items payable by Royal Mail included in this service - easy to claim the form is on their website! Have claimed on all of my 'no signature' items and they have paid. If more of us claimed the compensation R. M. might buck their idea's up!
  12. Hi Scotty, I just used the 'request for payment' template in the library and changed the wording from dd & overdraft fees to 'late fees etc.' Worked for me I have had all my money back fron 4 different GE accounts. Good Luck!
  13. We (hubby & I) both sent initial request letters 20.02.07. Hubby got an offer last week £1700 (£90 less than claimed) and has accepted. They haven't replied to any of my letters so sent LBA 7th March. Think they are bogged down and won't have noticed your duplicate!
  14. Congats! Having got mine back we are waiting to hear about my husbans charges, also having a go at NatWest. Capital One (husbands), GE Money( husbands), Nationwide and Creation Finance. My GE Money is settled £501 My RBS settled as you have seen. Husband has an offer from NatWest £1700 (£96 less than claimed) he is going to accept. Waiting to hear about the rest! I can't wait for the post each morning!!!!
