  2. diskmandave, thanks at the moment im looking for any advice i can get, and if old boy has any words of wisdom im prepared to listen. But listening to what someone has to say does not mean that one goes of and acts according to that. Any advice should be checked and double checked and then rechecked. However for the greater good you are right, since this is a forum any advice that is given can / might help somone else also... diceboy

  4. hi, currently living in another country (within the EU) and might be staying here for a while. My banks do have my address here however the debt agency that was harassing me back in the uk dont. Now the question that im sure many have thought about. Can i leave the debts behind and do a sort of a runner on them? (changing my address here soon again). what can happen? have herad about alot of ppl that have done similar things and got away with it. thanks diceboy
  5. hi good people, a little bit of a story about my self. my bank NatWest i have already sued successfully for bankcharges. however my creditcard is still with them and i have not sued them yet. For a good 3 months i was getting letters and phonecalls from the w-----s in morecroft. I started to pay the debt of however a couple of times when i paid with my switch card over the phone they took the payment but didnt even deduct the payment from the debt and still were harassing me for the debt ( including the couple of times that they didnt register the payment!!!!!!!!!!!!!!!!) Now due to unforseen circumstances i have relocated to another EU country and I will be here for good while, even maybe a few years. The thing is i dont want to leave the debt, morally i think its wrong (i spend the money and in the end i gotta pay for it) however these people are f***ing me off and i REFUSE to deal with them anymore, even it means not paying the debt. I have contacted Natwest to settle the debt straight with them but they referred me back to the credit agency (morcroft). Sorry for rambling before I get to the questions; 1. Can I still sue NatWest from abroad? 2. Can morecroft f-up my creditrapport in my new country of residence (if they get hold of my new address which they dont have at the moment) What would you do if you were in my shoes? grateful for any advice or info. oh forgot to tell you another bizarre surreal thing; in one week i got two letters from morecroft, the first stating that they were not dealing with my account any more and another the day after still saying that i owed x amounts of money? what kind of mickey mouse business are they running? Do they got a bunch of monkeys working 24/7 on this or what? best wishes to all of you at war diceboy

Hi guys, The battle continues here with cobbetts and thought to keep you updated; Have received their "goodwill offer" of half the money im claiming... on condition that i will keep quiet about it and bla bla, gonna write them that they can stick it where santa cant find it. further also wrote to the court about their scare tactics.... anyway gotta send of my rejection letter now and ill keep you all updated seasonal greetings to all of ya diceboy
  7. Hi guys, My fight with these ppl goes on. I filled in my AQ and dropping it of the court tomorow with the following letter regarding cobbetts crap request; The Court Manager Diceboy -v- National Westminster plc Claim no. ######## Dear Sirs, I would like to bring to the courts attention the following issues with regard to the defendants request for further information; 1.- A full breakdown of the charges with the dates that they incurred on have been supplied to the defendant previously and further also when registering the claim, which the defendants solicitors, Cobbetts, should have copies of. 2.- Since the claim has been allocated to the small claims track the, CPR part18 request, which has been made by the defendant, are specifically excluded by the part 27 unless the court requests for one. A fact that Cobbetts should be aware of. I would like the courts notices that information requested by the defendant has either been supplied previously (1.), or are not necessary unless the court requests for one (2.) I believe this manner of dealing with my legitimate claim by the defendant solicitors are intent to delay the claim and further meant to intimidate. Yours faithfully, What do you think? Should i send one to Cobbetts as with a X-mas card? (or maybe skip the X-mas card:)) Any thoughts would be great. Ill keep you all posted of the progress.
  8. Thank you guys for the replies. I have now send back a letter as you guys have recommended. I even wrote if they do continue in this manner i will report them to the Law society, now gotta wait for their reply and see how they gonna play it. thanks once again for the support dice
  9. Hi, I posted a while back and I am taking NatWest to court for £1220.00 (charges, interest and courtfees). Cobbets are asking for a CPR part 18. I have read the cobbetts thread and understand that its a tactic those b------s use to stall and scare us legitimate claimants. However reading their defence that they have put in it states that If I fail to provide proof that NatWest is in breach and if i dont identify the sections of the; - "Unfair contract terms of 1977" - The regulations of "The Unfair contract Terms in Consumer Regulations of 1999" - "The principles of common law relied upon be the claimant" (and it just goes on and on...) but the main thing is that it says if i fail to provide them with proof they will apply to the court to STRIKING OUT THE CLAM!! can they do that? Am i truly obliged to provide them with all this information or is that just further part of their scare/stall tactics. Please help because I am really bricking it here at the moment and dont know how to proceed. Many thanks, Dice

  11. Hey mupster, many thanks for the reply. It gave me some needed support in a dark hour (wrote the original post in the middle of the night;). Any way I will keep you all posted of the progress. Another question with regard to NatWest, with their credit card does the latepayment fee qualify for a claim for a refund? Any way Im thinking of printing some t-shirts with Mr Highleys face on it and some sort of slogan:grin:. Anyone have a picture of this notorious gentleman?? also let me know if you got any catchy slogans...
  12. Hello, First of all thank you for a fantastic site. After having read many of the posts and "how to" files I decided to claim back £957.00 from NatWest. I send them the preliminary letter on the 25th of september asking for a refund on. I received the following answer back from Stuart Higley; "...We believe that our charges are fair, reasonable and transparent. We consider that the ammounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff which, we are satisfied, complies with all apllicable laws and regulations. We are also commited to ensuring the transparency of the information that we give our customers about the operation of our products. Consequently, against that background, we must differ with the views yo have expressed and will not be refunding any of the charges applied to your bank account. Having reviewd your account, I can find no instance where charges have been applied when they were not properly due. They have all been associated with a lack of funds in the account at the time items were presented for payment...." Obviously not the answer I was looking for and having read some more posts here I am under the impression that this is a standard sod of letter from NatWest to whoever asks for a refund. I presisted and send them the LBA on the 10th of October and have not received anything back yet. So I decided earlier this evening that Im gonna go through with the claim and registered it with MoneyClaim online. I do appologise for rambling on here until I get to the question; Should I had waited longer for a response? Should I write to them again and let them know that I have gone through with it and taken them to the court??? I would be grateful for any advice on how to proceed from here... Many thanks
