  1. Hi Guys, one of my overseas freinds has a bit of a problem. he is from Denmark, so I am acting on his behalf. A guy in England owes him money (or a car part back, but long story!), but he has recently moved house, so serving legal paperwork might prove difficult. Is there any legal way to get the new address of the guy we want to send the court summons to? Thanks, Will
  2. So have you actually followed any of the advice you have been given, and contacted HPI and the Police?
  3. Which company did you do the HPI with? Was it a full £40 HPI with chassis/engine numbers and MOT/ log book documents check, or just a text on a phone one? If it was a bona-fide HPI by a reputable company such as HPI Equifax, you are covered upto £10,000 as you bought a car on thier information. I assume you still have the HPI certificate? Have you contacted the police and got a crime number, and the sellers details as effectivley you have been sold a stolen car. Then contact HPI and you should be able to claim assuming all the details you have given them are correct.

Incidently, the bank (HSBC) say they cannot do anything as the payment was made by myself, even though the guy is a fraudster, they refuse to help! Also, Can I claim 8% interest on this if I go through the small claims court?

  7. Hi guys, I bought a car cover for £130 off a guy on a car website in april, and it still hasn't been delivered. It was a private one-off sale, and I paid by direct bank transfer as I trusted the guy ... Now he has said royal mail have lost it, blah blah blah, but he did not insure it so cannot claim the money back. Ever since I have been fobbed off with lame excuse after lame excuse. I called the police as it has been 4 months now, they paid him a visit on the grounds of obtaining money by decepiton, but he has convinced them that he admits he owes me £130, and it is all in hand. I am loosing patience now, as I have been messed around for too long, is small claims court the way forward, as the guy is claiming he is off work due to a bike accident, so only has £60 a week. He lives with his parents, so even if I win in court could the baliffs legally enter the property to recover the debt? Any advice would be great, I was going to follow the bank charges model, send him 2 letters then file on moneyclaim online, would this be acceptable? Also can I claim the interest on the initial £130 and the cost of all the phonecalls etc?
  8. I have been out of the loop for a while, whats the score with the test cases, have they been resolved yet or looking good/bad for us?
  9. well, I have 2 succesful claims against HSBC under my belt so far, one for me and one for my girlfriend, but I sent off my Brothers subject data access request, to Barclays as that is who is banks with, and well over 40 days have passed and they have sent nothing. What are my next steps to demand they disclose the data?

Cheers Lattie, i will hang around the site as I hope I can be of some use to someone, as now I have done it twice, once with court bundle and once witout, it is much less daunting and hopefully I can pass on some confidence to other claimers ... The court process will continue until payment is recieved, I am sending a letter to the court informing them that HSBC have offered full payment, and I have accepted, but I will halt legal proceedings on the condition that they pay up and not waste any more of the courts time
  11. I am writing a letter to the courts at the moment telling them that litigation is to be halted. However, is it worth me including in the letter to ask them to ask for future cases for bank to provide thier defence before the claimant, as it will save a lot of court time due to the bank never defending, and simply using the courts time as a scare tactic?
  12. well then guys, a BIG BIG thankyou, my girlfriends full offer came through less than a week after submitting her court bundle!! Typical, but worth the effort for £2830!! Now, I have my litigation details and my girlfriends litigation details to add to the list, and a big thanks again to people who have helped, especially lattie:D . Next, what is a reasonable amount of hours to claim for in the wasted costs claim? i was going to go for 12-16 hours, and also charge 5p per copied sheet (approx 560 sheets!), and £18 for postage costs, is that a reasonable amount to reclaim?
  13. To be honest, He needs a dose of reality as he is a plank, but i don't want to see LBL take him to the cleaners... My main concern is that they will add on the repairs/ removal to his final bill, which will be considerably more than his inital loan of £1000!! The APR is 370.4% ( is this legal???!!) and the final reypayment figure at the end of the 58 week term is £2132!! At that APR, I cannot ever seeing him paying it off. The plan was if I can pay off the debt on my credit card, ( he recons that they want £1500 to finish the agreement) I will have the car and repair it ( can do my own work on the car) then sell it ASAP to get ny ££ £ back... I have not told him this yet, but it is just an idea, do they HAVE to accept full payment even on the day of repossession?? The only other thing I have noticed is that on the bill of sale, the guy who sold my brother the loan has signed the witness section himself, will this give us any legal standing at all?.. cheers, wil

  15. Ok then guys, just wondering if any of you could give me a bit of advice, my Idiot brother borrowed £1000 with a company called logbook loans, against the security of his car. Of course, being unemployed he has not kept up reypayments, and the have issued demand, final demand and on monday they are coming to re-posses his car ( a V reg Ford focus). Now is there anything he can do to stop them re-possesing it, ie make a small payment towards his arrears, then will it start the "repossession clock" again? My main concern is due to the state of the car, ie its been poorly repaired post accident,and the clutch is completely gone, so the car will not move, is that they will recover the car, then sell it/ repair it, and the cars sale at auction will not cover his debt, so It will continue to rise at a shocking rate. The APR is 59.6% :o , so he needs to do somthing sharpish...... Any suggestions please? :idea:
