The answer for the banks is quite simple. If the money is not there don't let people have it! and don't charge them just because they asked for it! That would be HELPING but we all know thats not the way they work Mal

It's is also worth dropping your bank a little not saying you have filed with the courts.... Don't put the case number but send it to them registered post also sending a copy to MCOL via snail mail to add to your file... This is just my understanding and I could be completely wrong. I think we need to break up the two different types of interest and call them different things because there is no getting out of the fact it’s confusing Let try it this way Interest due!? ( I.D. ) This is the interest that the courts let you charge on moneys owed, this is the 8%. Nice and easy to work out. Take the date you were charged and workout 8% APR from that date to the date of your claim. Then add it in when you file on moneyclaim Interest charged on your unlawful charges (I.C.Y.U.C.) This one is a doozer to work out because there is no real way to compute it as you would need to know what interest rate you were paying from the time you incurred the charge and then only till you were back in the black, but then you could start charging again once you were in the red. But if you were within your OD limit then it one rate and if you are over your OD limit then it’s a different rate. It has been said on the forums that only a forensic accountant could work it out! (How do you become a forensic accountant?) I believe there are some peps on here who include the interest from the statements as is within the claim and are getting the money. What worries me is you do end up in front of a Judge is would look better if you show that you did at least make a stab a working it out. I do hope this make sense ! Here we go I would say the easiest way to work it out is keep a running total of your charges and if your OD balance from your statement the charge is on is less than your total charges use your balance to work out the interest at the normal rate. But if your charges are less than your OD use the charges figure again at the normal rate, yes the banks have charged you at 29% when you are over your OD limit but think of it as a good will gesture(Lets keep that Judge happy). E.G Total Charges £244 Balance £200 OD Use the £200 Or Total Charges £244 Balance £300 OD Use the £244 Then the next time you work out your next charge use the difference between the two balances/charge or you will end up double accounting E.G. First Balance £200 OD Second Balance £230 OD use £30 Once you have worked out all your I.C.Y.U.C’s you can then add your 8% I.D. to them before you file on moneycalim If people a) understand my ranting and b) think this is the way to go I will happily knock up a spreadsheet to work it out and If I am total wrong then I’m sorry.
