Thank you Cheddar, it was my mortgage company, I'm being paid in the middle of the month instead of the begining, less than 2 weeks late in paying my mortgage and got charged £35 for the letter they sent out, had absolutlely no joy with the person who I spoke to on the phone, blimey they have a bloody nerve after scrounging to the UK Govt asking for money to stay afloat, OUR BLOODY MONEY !!!

Hi folks Can anyone tell me if the charge of £35 for a late mortage payment/letter (only 14 days late) from The Mortgage Business is to be treated the same as any other bank charges, i.e. send them a letter requesting charge be refunded and wait on the high court decision? Are these late mortgage payment letters that they charge £35 for in the same boat as all other bank charges? Thank you

I was told about 2 years ago that I had been overpaid tax credits (altho they have never taken these overpayments back) I am sure that when I was told about recovering overpayments that they could or would only be able to take about (if i remember correctly) something in the region of about 20% per week OFF your tax credits weekly until your overpayments had been paid off so that infact you would still receive your tax credits weekly albeit with the 20% taken off also. Also like someone else has stated the payments should be on up to date income, I am self employed and being paid on my last years accounts, now after having a much better year financially I am due to give these details to tax credit people by the end of this month and I'm worried about how much I have now been overpaid and god knows how long it will take to pay off.
  4. I got my credit limit with Virgin raised by £1000. I wondered how they went about deciding who gets a credit limit raise and was told by a Virgin employee over the phone that they ran regular credit checks on customers. I can totally understand why they would do a credit check when you first apply for a credit card, but are they allowed to access your credit file whenever they want to for their own business needs? The girl I spoke to on the phone said that they knew I had changed my mortage provider and had paid off another 2 credit cards, this absolutely horrified me. Surely they cannot go into their cutomers credit files and look at them on a regular basis and see what other credit you have OR CAN THEY?
  5. Hi all, I bought a flash memory for my mobile phone in argos last week and being in a rush I bought the wrong memory card. Been told by argos that these memory items are NOT part of their 16 day money back/exchange deal and I have to accept I have made a mistake and keep the memory as they will not accept an exchange for the correct one. I only wanted to exchange and did not want a refund ......is there anything I can do about this? I feel it is so unfair !!!
  6. Hi Folks, I have read the points on having to make a court action claim using Moneyclaim etc, but is it still the same rules up here in Scotland or do we have to go thru another type of process? Any help would be greatly appreciated !! Moody
  7. Hi folks, Sent a LBA to MBNA who run my virgin card, they have replied saying that they have reduced their charges from £25 to £12 and they aint gonna refund my 2 * £12 overlimit charges. They claim in thier letter it costs a substantial amount of money to deal with late payments and over limit fees. So in short MBNA are NOT refunding charges can I now launch a small claim against them and is there a template within this site to help me with it? Thanks Moody
  8. Hi Abbey customers, My good friend, over the past 5 years has accumulated approx £4500-£5000 in various charges for non DD payment to going over agreed overdraft limit etc with Abbey. My friend is one of the most disorganised people you could meet but has finally decided the time is right to get on top of his financial affairs. He has asked me to ask current Abbey customers who have initiated legal action against the bank if when they have done this have the bank taken away their overdraft facility. He has just had his overdraft limit reduced from £3500 to £2700. He at this moment in time simply cannot cope without his overdraft. His overdraft review was 2 months ago and subject to another review next year Oct 07. What are the chances of the Abbey taking the hump with him once he starts action against them and reducing his overdraft to zero? Thanks Moody
  9. Hi, I just had the £5 late payment charge from BT refunded after sending them the template available thru this website about letter before action. I also added onto the template that infact they were charging me for services NOT YET RECEIVED. BT charge you in advance for their services and the only other item on my bills are the last 3 months of calls. My £200 quartly bill is made up of about £35 in call charges (which I have made) and the rest is for future charges............................ how can they charge a late payment for services you aint even had yet? I was glad to get my £5 back anyhow !!

  11. Phoned MBNA this morning to be told that because I mentioned OFT in my letter they have passed my letter over to their legal team and under FSA rules they have 4 weeks to respond.
  12. Got a reply from MBNA this morning saying they got my letter of complaint on 6th Nov and will reply to me by 6th Dec. Is this 4 week wait acceptable?

Now that OFT have said a reasonable charge for late payment or going over limit with your bank or credit card company is £12, is that still as unenforceable as the previous £25 they used to charge. I have a £12 late payment on my card, can I still challenge this or has the OFT ruling made it untouchable?
