My disabled wife ordered a new car and it was agreed with the sales man and the sales manager that the car would have premium paint which would cost £450 extra however the salesman said if she signed the sales contract she would get the premium paint free of charge . A deposit was paid and a Contract was then signed by my wife and the sales manager which clearly stated the car was to have the premium paint . A few weeks later when she rang to inquire about a delivery date she was told by another salesman that the contract had been altered without her knowledge and the car was to be supplied in standard paint can they do this or is it breech of contract

Here's the link: http://www.change.org/p/rt-hon-david-cameron-mp-rectify-a-major-injustice Here's why it's important: In 2009 I made a complaint about the solicitor engaged to handle my late father’s estate. The solicitor quoted 30 hours to do the work but eventually charged the estate 131.9 hours to do the work. Should the public be ripped off by those in a position of trust who are supposed to act in our best interests? I made a complaint to the solicitor and he declined to respond to my complaint because I was only a beneficiary of the estate and not his firm’s client. My complaint was escalated to the Law Society after those acting on its behalf assured me that I would not be liable for any costs. The complaint has ended up costing me over £108k most of which has gone to the solicitor I complained about. My wife and I nearly lost our house and were almost made homeless because of the ruthless way in which this solicitor sought to enforce the cost order he obtained against me. My story was covered on BBC North West tonight on 24 March 2014 and again on BBC Rip of Britain in Series 6 Episode 18 on 8 October 2014. The matter was brought to the Government’s attention at Justice Questions on 12 November 2013 and again at Prime Minister’s Questions on 9 April 2014 by my local MP Mr Simon Danczuk. My MP described the solicitor as “The Solicitor from Hell” and the SRA described his behaviour as “Morally Reprehensible”. Clearly the system for regulating solicitors is not fit for purpose and the Legal Profession is unwilling or unable to deal with such corrupt and fraudulent practices. How can a profession whose members are supposed to be trusted to the ends of the earth act with such a complete lack of integrity? This matter has been taken up with the Prime Minister who promised that his Justice Minister would look into the remedies available to me. The Minister says the Law Society is responsible yet solicitors acting for it say I have no claim against it. Clearly in UK law I do not have any remedy to reclaim the losses suffered from making such a complaint. I call on the Prime Minister and his Government to act with integrity in this matter and rectify the injustice which I have suffered. It cannot be fair and reasonable that someone making a genuine complaint must bear such a heavy cost for investigating it. You can sign my petition on the link above.   3. A number of years ago I had a BHS sore card issued by a bank based in Leeds ,how can I find out the name of the bank , my account number and how far back can I claim back PPI payments I do not have any account details, the account ran for a couple of years then I cancelled the card

I am writing this letter as my formal complaint and to inform you that I reject your discontinuation of this product. Your conduct in abandoning the cover, which I have had with you for X years, is a breach of your FSA obligation to treat customers fairly. It is also a breach of contract. The terms in your contract that entitle you to terminate the policy are being operated contrary to the requirements of good faith and in a way that is detrimental to me, and are therefore invalid under the Unfair Terms in Consumer Contracts Regulations 1999. Breach of Financial Services Authority Regulations The FSA Handbook, which regulates your activities, contains as one of its binding principles, a rule that requires you, as a regulated firm, to treat your customers fairly and to have regard to them when making decisions. Not only is this a statutory duty, it is also implied in the insurance contract and forms one of the terms and conditions that exist between us. Breach of Contract At the outset of my lifetime insurance policy with you, there was an implied term that you would provide cover for any conditions that came into existence after the initial commencement of the policy. As you fully realise, I will be unable to seek new cover with any other insurer for pre-existing conditions if you do not renew my policy. You or your underwriters, for your own economic reasons, have made a unilateral decision to terminate your program of lifelong cover and this leaves me in a position where I am unable to insure my dog for any existing conditions This is despite the reasonable expectation that you created in me when you initially marketed the product and persuaded me to enter into a contract with you. Unfair Terms in Consumer Contracts Regulations 1999 The UTCCR say that when there is a non-negotiated standard-form contract, and a term in that contract is operated contrary to the requirements of good faith to the detriment of the consumer, then that term is unenforceable. For the reasons above I reject your termination of the insurance cover and I am writing to inform you that I am fully prepared to continue the insurance cover on the same terms as before. I should point out to you that I am not interested in the fact that your underwriters may have changed their minds about providing the insurance policy as that is your issue. My concern is merely with your contractual obligations towards me. I require an immediate response to this letter. You should understand that if you have not provided a satisfactory response within the next 14 days i shall send you a letter giving you a further 14 days in which to reflect before I commence legal action in my local County court, either to enforce your contractual obligations or to seek compensation to provide for lifetime care for my dog. The County Court is the only route I will be taking if we cannot arrive at an agreement and I therefore advise you to forward this letter to your solicitors if you are not prepared to meet my demands. You should also be aware that I am sending copies of this letter as part of a complaint to Trading Standards, the OFT and the FSA. Yours faithfully
  10. i am using the template letter to send to the halifax ,the template letter refers to lifetime cover extra my cover was not the extra would the template letter be ok if i delete the extra ?

  13. i have just been informed that my pet insurers Halifax are pulling out of the pet insurance market and my accounts have been transfered to another insurer. The problem is that all existing conditions to my pets are not covered by the new insurers as they will only insure any new condition which occours from the commencemet date of the new policy . They could argue that any condition which occours within the next months or even years had started to develop before the insurance commenced,this will mean that it will cost me money through the Halifax decision to quit the market Has anyone any comments or advice
  14. well it was worth it,i received this morning a letter from the halifax confirming that they paid my claim in FULL .This was after i had rejected their first offer of half the money they owed and the commencement of court action.Anyone reading this posting and contemplating court action should not be afraid to do so and MUST follow the instructons in the library templates

I have arrived at the stage when i am taking the halifax bank to court ,but i cannot remember when i first opened the accont ,what should i do or does it matter?.The reason i ask is that in the guidance notes it says that when you write to the court you state the date the account was opened By the way halifax have offered half of my money back but i have declined their offer
