  4. Would that be a new N1 claim form. Sorry Im a bit confused on this.
  5. Thank you for the reply. Thats what I cant understand with them. I thought they might withdraw it again. Would he use the fact that they had discontinued the last claim in his defence? Or is it best to contact the DCA and see if they will discontinue? We have emailed them but they havent replied. Is the AQ the next stage?

  7. Wonder if anyone can offer any advice please. The whole sorry saga of this college course goes on. As said above it was dropped at the AQ stage nearly two years ago but then passed on to a DCA. After a letter informing them the case had been dropped he didnt hear anymore then out of the blue (a year later) he has received the N1 claim form from Northampton, same DCA. He has contacted the local court where the original case was going to be heard and they have said they will send him the letter. He has said he will defend the case on the N1 claim. The problem is he is going abroad for two weeks and he hasnt heard anything from the DCA, who emailed to tell them the case had already been heard and cancelled and no letter yet from the local court. What should he do next? Any advice would be really welcome. If he doesnt do anything before next week they will get judgement by default wont they? Thanks for your help.
  8. Thanks Pinky. The court has let the solicitor deal with it. So I have to let the solicitor decide when they have had the I@E and then if they dont agree or I dont agree on the amount we can apply back to the court. I always thought it was the judge who decided but in this case he let the solicitor as I lost the case.
  9. I have a ccj from an unsecured loan. The court order said I had to send in an Income, expenditure and assests written statement within 28 days. I have done this but the solicitor has written back enclosing their own I&E and they want to know just about everything, bank details, pension details etc. If I have complied with the court order by sending in a written statement do I have to fill this form in? It does say on the order that "The parties are to agree within the time for payment by the Defendant to the Claimant of the sums identified in para 1 & 2 above, failing which each party has liberty to apply. So if I didnt complete their form just sent another copy of the one I have already sent them plus a payment could they do much about it?
  10. I wonder if anyone can help me with the following. I have been trying to keep going with my business but the costs now outweigh the profits. I have been living on my savings to pay the mortgage and now that is more or less gone. I have been told I can apply for JSA income based and also get help with my mortgage interest. The thing is does anyone know how much you can earn (I get about £60 a week) and if I do get the help with the mortgage after 13 weeks I realise it is for the new rate of £200,000 (my mortgage is for £130,000) I will be 60 just at the end of the 13 weeks and can then apply for pension credit but will the £200,000 help with mortgage costs continue or will the 2 year time limit apply (under the new rules) and it will go back to £100,00 pension credit limit? I would appreciate any help as it is so confusing and I desperately need to sort my finances out before it is too late and I end up on the street.

  13. I have finally recieved a reply from the cca request to Link. I have sent the SAR to mbna but nothing yet. I sent the cca request to Link months ago. They have sent the cca it is for Abbey MBNA card from 2002. It is signed and dated and it does say on the front page about "a summary of the Financial & Related Conditions for each product is set out overleaf". I have uploaded the front and back of the cca.
