  1. They are a Private Limited company which incorporated in 2013. They operate on an industrial unit which isnt too promising but that have a lot of cars and their company accounts suggest that they have these on credit. I dont know if that affects how quickly they could go out of business?
  2. Yes, unfortunttely I found a tumour in Septmber and that took pretty much all of my focus until January otherwise I like to think I would have got this sorted sooner. I do want to get this settled and get rid of the stress though. I have attempted to enter in to correspondence with the other side but they have not repsonded so I am happy to write up a letter of claim which I will post. I am also happy to raise the claim but I am concerned that the company will "disappear" and not pay me, it is another £400 to riase the claim due to the sum. Thanks for you advice, I will get the letter done wither today or tomorrow.
  3. Afraid not. It has had 4 previous owners and there are no MOTs in 2014 or 2016 and only 700 miles were added since 2015. I asked about this and was told that is sat in the drive as it was owned by elderley people, guess I am the mug!

Volvo have given me photos of the ECM showing where it was interfered with and the invoice from Volvo states: "...Further investigation into ECM unit found that the ECM unit had been aprt previously and the unit had been resealed. UNsure as to why the ECm was previously dismantled but it is evident that the module has been aprt in the past." I have a copy of the invoice from Volvo to Polo Motor Company in July saying that there is a ECM code stored. My previous invoice from Volvo states: “It was clear when working on the vehicle that work had been carried out on the vehicle at a previous date. All four injector collet sleeves were missing, meaning that the injectors were not making a complete seal. When we reassembled the injectors and road tested the vehicle codes were stored with EGR fault. The EGR would have been faulty for a long while, it was only until we carried out the correct sealing of the injectors and intake manifold that the fault showed.” They (Volvo) are being very helpful and I may be able to get more from them.   5. Thanks for the quick repsponse. The dealer is Polo Motor Company in Gillingham, Kent. The solicitor's letter (Attached) is from Stormcatcher solicitors (I have removed my address etc) I bought the car for £4450 I have spent £1466 on repairs which I am asking for back. The largest repair invoice was £801 for the engine leak that I described above and which the solictors letter refers to. StormcatcherVOLVO.pdf
  6. All I bought a car (2008 plate) from a dealer in June 2018, on the way home the check engine light came on and I crawled home. Spoke to garage who said to bring the car back, I was unable to do this until the Monday so in the meantime took it to a local garage for a look. They gave me a list of problems (including a leak at the top of the engine) and advised me to return the car to the dealer. I took the car back to the dealer on the Monday 25th June and they had the car until the 20th July. Once I picked up the car the check engine light came on again before I got home and on the 23rd July I took the car back. This time they had it until the 20th August. In this time I was told that the car had had two new injectors, a new turbo, an air filter and an ABS module. Once I got the car back in August it never ran properly, would stall easily and smelt bad. I didn’t have any concrete with which I could go back to the dealer though so resigned myself the fact that I am stuck with this car. I never trusted it enough for any long drives. In January this year the service light came on in the car and I took it to the main dealer (Volvo) for a service. They checked the car and told me that there was a leak at the top of the engine and that it was clear somebody had been there before and the workmanship was poor, part of the injectors was not replaced. They replaced this, a gasket and a hose but when this was done it uncovered an EGR error and they replaced this. about £800 worth of work plus the cost of the service. Volvo wrote on the invoice that it was clear somebody had worked on the car before and told me that it would not have run correctly since I owned it, At this point I wrote to the dealer asking for help with the costs as the leak at the top of the engine was identified in June 2018 and because the problem was caused by a poor job on the injectors, if they had done the work properly then they would have uncovered the EGR issue and had to fix that. I got a solicitors letter in response saying that they will not pay. Shortly after that the car started to lose power and I took it back to Volvo. After replacing another hose and a switch that had been damaged they diagnosed an ECM fault and advised me that it was not worth doing any further work as that would cost me around £1000. They showed me that the ECM had been tampered with at some point, it was sealed with silicon and the tamper tape had been removed. They also found an invoice from July (when the dealer had the car)where they (Volvo) had fitted the used turbo and noted on the invoice that an ECM code was stored on the Vida. I spoke to Which legal help and the solicitor suggested I have a good claim here . I responded to their solicitor saying that I have evidence that the ultimate problem was present in July and therefore when they sold the car to me, I also told them that I have the statement from Volvo saying that these issues would have been there when I bought it and the report form my local garage noting that the leak as present 3 days after purchase and had not been fixed as I thought it had. I asked for a refund for the car and for the repairs and asked them to take the car back, I have broken down the costs into five sections corresponding to different repairs. I gave them two weeks which is up on Friday and haven’t heard anything yet so tomorrow I will be logging a claim. It is a long back story but any advice about going through and writing the claim would be welcomed. Also any other opinions on my chances. Thanks

Hi all, I bought a car from a dealer in June2018 and had issues with it right from the start, so much so that I didn’t actually get the car in a drivable condition until 20th August because the dealer had it back for repairs. To cut a long story short, in Feb I took the car to the Volvo garage for a service and they found a lot of faults with the car that they said must've been there since before I bought he car. I have asked the dealer to pay for these repairs but they refused (Via Stormcatcher solicitors) as I have had the car over six months. I understand what they are saying but as I didn’t actually have the car until August does that six month period get put on hold? The situation has moved on since I asked for the money for the repairs and Volvo have told me that the car is not economical to repair, they have however found evidence on their system that the dealership were aware of this issue when investigating the car for me in July. I will soon be asking the dealer to refund the car and the cost of the repairs that I have done. The question above about the six months might be critical to whether I can get this money back. Thanks

  9. Hi my wife recently received a parking charge for being "Observed leaving site" when parking at a Shopping Centre. She did leave the site to visit the next door university library (Where she is a student) before coming back on site to shop. I informed the company of this before i read any advice to ignore correspondence from them but they declined the appeal. However, we can prove that she returned to do shopping as she has receipts. I have since ignored correspondence but IF they decided to take this to court would they be required to prove that she left site or would we be required to prove her innocence? (Surely they need to prove that she left and didnt return?) Does this mean that they photographed her? She strongly values her privacy and would be quite upset by this! Thanks

  11. Hi I have a leasehold flat that I am in the process of selling for £115,000. The lease will have 68 years remaining on the 28th of march this year and the landload wants £12,000 to renew it. I was more than a bit shocked to discover this and feel that it is far too much money. I have a few questions if anyone can help: 1/ Is this a normal amount to renew a lease? If not what is a normal amount? 2/ Is there anything I can do to get a lower price? At the moment I am tempted to keep hold of the flat for the next 68years and rent it out. The Lanlord only bought the Freehold in Dec 2005 and is obviously looking for a quick return. 3/ The alternative I gues is to purchase the freehold with the other leasehodlers. Who sets the price for this? Would it be the landlord again? I feel very trapped here as i can not sell the flat unless somebody is willing to take on the lease and nobody will with a cost of £12,000 to renew it. If I pay the £12,000 it wil not considerably increase the value fo the flat. Help!

  13. Hi I have an ongoing problem with my flat that I have detailed below. Can anyone offer any advice? I purchased a flat in 2003 without getting a full survey (I have learnt my lesson there!). Soon after moving in I noticed that the plaster was dimpled in places, I thought that this was just a bad plaster job. When I went away in August 2003 the ceiling in the kitchen collapsed because a joist had rotted and fallen on it. I had this repaired for £2000, £1000 of which came from buildings insurance held by the management agents. I was informed verbally by the management agency that there was previously a leak on my flat roof that had since been repaired; this damage was a consequence of that leak. As time passed the condition of the plaster inside deteriorated and I realised that the previous owner had skimmed the walls before selling the flat to hide a serious damp problem. I contacted the management agency several times and they sent people out to make minor repairs to the roof and to get some blown render replaced (another £1000 out of my pocket). I had sections of the flat decorated inside as I thought that the damp had been eradicated but after a few weeks the damp repapered through the new plaster (More money wasted). By this time I had a new account manager at the management agency and he arranged for a survey of the roof to be performed, however, this took months to happen and when the results were returned the agency would not do anything as the lease was up for auction and they would not be managing the property afterwards. This resulted in a period of 4 months without any movement and the damp continuing. The new management agents have taken over and have been very helpful but things have still gone slowly. I moved out of the flat in April and the roof was finally replaced in May/June. After the roof was repaired I removed all of the damaged plaster from the external walls and replaced the windows (one was wooden and had rotted, the others were double glazed but had been damaged by continual damp). I then had the walls re-plastered and the interior decorated. This was completed in September but we then discovered a leak in the roof that is still ongoing that has damaged the new plaster. Although I realise that this is my fault for not getting a survey I cant help but feel that had the first management agency down their job correctly I would be around £10,000 better off! Is there ANYTHING I can do to claim some of this back from them? Can I claim on the buildings insurance for something like this or will they just say that it is caused by wear and tear? Can I claim retrospectively for the work that was required inside to repair the damage? Thanks in advance Kieron
  14. Hi I opened a current account with Alliance and Leicester and at the same time opened a Savings account to take £50 a month from my account. There was a glitch transferring my salary and it was not paid into the new account, I was charged for going overdrawn when the savings account money was withdrawn. I cancelled the transfer of my salary as I was upset and the NEXT month the same thing happened. I wrote to them and they refunded the charges and gave me their apologies. HOWEVER, they recorded me as being in arrears by 2 months on my credit record. This was last updated in September (Odd how they were quick to regsiter arrears but not to remove it). I wrote to them around 3 weeks ago to ask them to update my record and preferably to remove the information as I had never used that account. This letter has been ignored. Does anyone have any suggestions of a way to get them to notice this request? Something similar to a Data Protection request that they have to respond to (I know the DP act is not applicable here). Hi I dont have any defaults regsitered on my credit record but I do have two settled accounts that have had three payments missed and a few accounts that have arrangment marked on them (I think this looks bad when i want to get credit?). These accounts are all marked as settled and have not been updated by the companies since settlement. The reason for these missed payments was because I got hammered for bank charges two months in a row and did not have any money left to pay the bills. Well, the bank have given me these charges back but i am stil left with the black or (should I say red) marks on my credit record. I can occasionally get credit but it is very hit and miss and of course, every failed application leaves another search on my credit record. I would like get the entries for this period removed from my file but the companies will not do that even with a nice begging letter. I have read through this forum with interest but I am unsure of one point. My credit record shows that the companies who I want removed (Halifax CC, Littlewoods and Orange) from my record have not updated the record since the date of settlement. Does this mean I have to write to them first or is the data only being held by the CRA? I am not sure if the data is there because the companies are still holding it or whtehr it is there because the CRA will keep it there for 6 years form the date of settlement.
