  1. in process of selling my house which i didnt live in the tenant moved out received council tax bill month after but i had a offer on house so left it, month later went on holiday to usa for a fortnight, on return found a court summons letter which was held on the 4th nov the day i returned and date on letter was 17th oct i went on hol the 23rd and hadnt received the letter before i went i sold the house while i was away so i owe about 2 months max what is the notice they sould give you for a court date
  2. Yes the lawer will take it on they had to wait for the letter from the employer before taken it further he is now on the sick wirh depression
  3. as i said the day before he was told to go home and think about it he didnt but the next day ehen he went in and found nothing had changed he decided to go as the boss had told him the day before to do it and he hadnt even if he had walked off and returned home the boss should have contacted to see why he before shoving a letter though his door that night dismissing him remember its a small family firm and he had been there 26 years no verbal warnings no writing warnings nothing just dismissed
  4. he went to see a no win no fee solicitor as he isnt in a union they told him to write to his ex employer and state the fact that he thinks he was unfairly dismissed and send reg post he followed the advice and received a letter from the employers stating a tribunal will take place next tues at the office with the owners dad (who used to run the firm) and the owner he is allowed to take someone in but they need to know who he is taken and they are not allowed to ask questions or speak to the panel the dad will then decide if he has been unfairly dismissed or not if he dose not go they say that means he has accepted that he is in the wrong and thats the end of the case. he can postpone the hearing if he wishes. I cant believe that they think this is legal what are peoples thoughts
  5. my friend has worked for the same firm for 27 years and was getting bullied for the last couple he went to see the owner and told him various times that he could not work with the person involved it came to a head last week and he told the boss on the Wednesday he couldnt carry on the boss told him to go home and think about it as as far as he was concerned it was all in my friends head and if he wanted to fetch someone in he would discuss it further. he worked that day and on Thursday decided to go home after turning up for work and think about things, that night his boss put a letter through his door terminating his employment stating that he was no longer doing his job properly and he was finished. He went to see the boss on the Fri morning and the boss wouldn't see him is this unfair dismissal he was also told he wasn't entitled to anything either. do you think he has a claim for unfair dismissal
  6. started the dispute via the deposit scheme i am now claiming the full amount due to him threatening me with court action i have now included the extra damage he did when he returned to the property after his agreement ended and i was going to let the sate of the carpets go but know im claiming a percentage due to wear and tear for cleaning them. what started off as him getting some off his bond back has now ended up with him possibly getting nothing i have also reported him to the police for reentering the property and causing damage after the end of his agreement and have a crime number if it goes to court. it make me sad that i was trying to do him a favor by letting him off with some off the damage and he returns the favor by threatening me with court action. How long have i got till he has to file a action against me and if he ignores the deposit scheme.
  7. the tenant is demanding all his deposit back i offered to go to the deposit scheme tribunal and gave him the rest of his deposit back minus the floor repair he has refused and states he is suing me through the courts, i am now getting the floor guy back to give me a price for getting rid of the footprints on it that he left when he entered the property on the sat. i also contacted the police and they said it was a grey matter but not worth perusing about trespass on him entering the property after the tenancy agreement ended. can hew sue or does he need to go through the tribunal?
  8. i rented the house out for a 6 month period someone with a dog before he left i inspected the property and noticed damaged wood floor, wallpaper had been ripped and the stair carpet was a mess, also the room spelt strongly off dog urine where it had been ****ing on the wooden floorboards he agreed to repair the damage before he left, i returned a couple of weeks later and he had attempted to repair the damage the wallpaper was fine but the stair carpet hadn't been touched and the wood floor had been attempted but it meant 3 floorboards where a different colour, i told him it would have to be done professionally as it had made the floor look worse and asked him if he wanted to get the bloke in or should i, he said go ahead. I arranged for the man to come round and price the job, the tenant moved out on fri morning and i rang him to see if he was now out of the property and if it was okay for the man to come and do the floor, he said it was fine. The estate agent phoned me this morning and said the tenant wasn't happy because i had the floor repaired before he had agreed to it (which he had) and he hoped it wasn't coming out of the deposit as he expected it all back and he woulod take me to court if i don't give in, i pointed out the fact he had agreed and he had also smashed a chair and not cleaned the stair carpet and asked how did he know i had the floor repaired. The estate agent said that the tenant had returned to the house on the fri night and seen that it was getting repaired, I called into the house sat morning when the floor was getting the last coat of varnish on it this was before the above phone calls, after work i called in to see if the floor had dried and there is footprints in the varnish, someone was seen entering the property today at 11.20 and taking a photo of the floor i can only take it that it is the tenant. Am i in the right to take the cost of repair from his deposit. it is in the relevant deposit scheme. I wasnt even to charge him for the damage to the table but i might now,

  10. i have read the contract in small print they say that if i withdraw the property or they withdraw a charge of 99 pounds plus vat is payable, on the contract i didn't date it i just signed it if that's a get out clause, also the boxes stating sole agent etc are not ticked so they cant get me on that. i have put a letter of complaint in to there head office stating that i had told the manager to keep marketing the property regardless of the tenant but she ignored the request, i think its ridiculous that they can take your money then a couple of months later say we don't want to do this anymore give me some more money.

  12. had my house advertised with an estate agent for sale or rent after a month i went to another one as the first one was not doing anything and they found me a tenant within a week, i told the to still leave the property for sale as i would prefer to sell than let, the tenant moved in a month ago, received a letter today off the first estate agent saying they were withdrawn the property as i have a tenant in it and could i pay them a withdrawal fe of 115 pounds. please note i havent withdrawn it they have. i think it because the other estate agent got me the tenant. any advice given
