I'm Due In Court On The 24th January, As I'm Claiming 1800 Pounds Off Barclaycard. Does Anyone Know If They Still Settling Out Of Court And How Long Do They Let It Go Before Making An Offer. I'm Willing To See Them In Court But Don't Think They'll Have The Guts To Show There Faces.

Cobbets must be just offering half of the amount due as the norm. I was offered 1900 for my claim of 3800( off course told the to go forth) I'm waiting for a court date after filling in my allocation form.

I'm in the same position as i have sent 3 dpa letters asking for statements for the period 2000 to 2004. Each time received the same letter in reply. If i do estimate an amount and take barclaycard to court they will have to send the statements to disprove the amount. As the court cost are 120 pound and the cost of the statements would be 144 pound, even if the case goes against me i can then use the statements to take them for the correct amount. Can't see why barclaycard would go to court as i can prove they haven't provided me with the statements i have asked for.

I Have Tried 3 Times To Get Barclaycard To Release The Statement But To No Avail. I Have Informed The Ico As Each Letter States That Barclaycard Will Take No Further Actions. Don't Know Whether To Claim An Estimated Amount Or Just To Claim From 1/5/4 To Present Date And Go Back Later And Claim Again When I Can Afford To Request The Statements.

i Have Received 2 barclaycard Both Refusing Any Statements Before May 2004. on Monday I Sent A Letter Stating I Was Taking Them To Court For The Charges On My Account. I Am Going To Work Out What They Have Charged Me From May 2004 To July 2006 And Then Estimate Back To May 2001. I Don't Know If I Can Apply Interest On The Estimated Amounts. If The Estimated Amount Is Wrong Then Barclaycard Will Have To Prove That In Court And Disclose The True Amount. If Anyone Has Previous Done This, Please Posta Reply Thanks
