Let us see the witness statement that you are proposing to use. Post the draft here and give us good time to look through it and suggest changes. So you returned a number of items using EVRi. Studio say that they haven't received them and that you still owe them the money. Is that correct? How much do they say that you owe them? What are the items which you have returned and which they dispute having received? And I understand that you have evidence that they have been returned and that they are delivered. Is this all correct? I understand that despite this dispute you went on to order more items but then cancelled the orders – and they refuse to accept the cancellation and they delivered them. I then understand that you returned the items to them. Who paid for the return? Do you have evidence that you attempted to cancel and that they refused?

Thanks for your story – but it is rather garbled and I'm trying to make sense of it. Are you out of pocket – and if so by how much. Do they say you owe the money – and if so how much? What is "studio"?

I would have thought that they were obliged to provide you with a courtesy car. Of course they will object but you may as well start the process. Probably quickest to begin by telephoning them but it would be best if you could record your call . Make careful notes about what you say and what they say and get a name and a reference number if you at all can. If it sounds as if they are refusing then I would tell them immediately that you are beginning a formal complaint and that you want to reference number for the complaint.

The best thing to do would be to make the subject access request on the telephone. You're entitled to do this although you may find that the person who you are speaking to doesn't realise this. You should insist. Get through the security check so they are happy to talk to you about your account. This will confirm your identity and tell them that you making a subject access request and you want everything that they have in any form and on any subject going back as far as they have records on you. Do this for both of you. Then confirm it by email using our SAR template except that you will start off by saying that you confirm your verbal subject access request of XXX date. Et cetera. -

If you check the website carefully, you will probably find that you didn't contract with EVRi you contracted with parcel2go. It doesn't make a lot of difference. They are all put of the same stable but anyway the claim you will be making will be against P2G. Double check that I am right. Start off by reading the stories on this sub- forum and also the pinned topics at the top. This means lots and lots of reading. The process is fairly straightforward but you need to understand what you are doing because although we will help you, you need to be confident and in control. Read lots of the stories on the sub- forum. Also have a look at this thread which has just begun involving the same company come back here when you have done the reading. I suggest at least a couple of days -
I can't remember if I have suggested that you send kinderton a subject access request. If this hasn't been done then I would suggest that you do so immediately. The reason for this is to see whether they are actually prepared to provide this recording. They won't know that you have a copy. I suggest that youse are subject access request template and send them a subject access request straightaway and let's get everything they've got.

For the benefit of other people who are following this thread, I have been past the recording of a conversation which occurred with kinderton. The telephone conversation contains identifiers so we won't be putting it up on the forum. However, it is extremely helpful. I think with this recording you will have no problem at all. Please stand by for a reply possibly tomorrow or over the weekend. I think that you don't need to worry.
