Hi Ericbrother Thank you for your thread. There are few questions I would like to ask please? How do I put a counter claim against the claimant? What is the process involved? Is there a time period that I need to put the claim in? I had my court hearing on 24th March 2017 What is the amount I sue them for? I also suffered ill health as my prisiosis flared up and had to go to hospital for treatment? What does KADOE contract mean on your thread 93? What does Iba mean in your 93 thread? Hi DX100uk, Ericbrother and all on CAG I hope all is well. I had my hearing yesterday. I would like to inform you "the defendant won". The claimant had no leg to stand on and claimant submitted their bundle of documents 24 hours before the hearing. I went through 16 months of misery, pain, stress, ill health etc.... The hearing did toake place yesterday, 24 March 2017 . ..and within the 16mins the case was dismissed. I would like to say thank you very much to DX100, Ericbrothers and all other on CAG who has assisted me through my case for their guidance, assistance, support. Thanks again. Few questions I would like to ask:- 1) Will I receive correspondence from the courts that the case was dismissed against me? 2) How do i find out there are no CJJ against me? 3) Can I put a counter claim against the claimant for putting me through misery, pain, stress? 4) If yes, what is the process? Hi DX Yes I am aware it’s the judge who can throw the claim out. What my question is I have written to the courts last week and hand delivered the letter asking the judge to throw the case out as I have received no documentations from the claimants. At present I have received nothing from the courts. I want to put my letter online on MCOL as I am worried why the courts have not got back regarding my requests. I don’t want the courts to say they have not received no letter from me. I have also emailed the courts and have had no response. This is what I am worried about. Thread 78 by Ericbrothers say … ”you can use control panel to ask for the claim to be struck out for failing to obey the instructions of the courts”. How do I do this on MCOL? Paragraph 5 on thread 78, ericbrothers mentions about ….Gladstones have a nasty habit of abusing the Civil Procedures Process and quote a number of claims they got torn into the same thing ….How do I find this information? Your assistance will be greatly appreciated as my hearing is next Friday, 24th March 2017. Many thanks for your assistance. Regards - IKI

Hi Ericbrother I put my claim through MCOL. I have written to the courts last week asking the Judge to throw the case out as they failed to provide their evidence as per court directions. I have had no response from the courts. I am on MCOL, where do you go to strike the claim out as you suggest? Please advice? Regards - IKI

Hi Ericsbrother I hope all is well. I have received no case paper bundle from the claimant. The deadline for this was 10th March. I have tried getting in touch with the courts with no luck in getting through to the courts via telephone. I have written a letter and hand delivered the letter to the courts and I have receipt for that . At present I have no response from the courts . I don't know if the claimant has paid the court fees? How do I find out this information. I have also emailed the courts regarding this question, but not heard anything from the courts . Where do I stand now as I have done everything that was required from me and the claimant failed to provide the information . Please advise as my hearing is next week on 24th March 2017. Hi Ericsbrother Last Thursday (9th March) I handed my papers/bundle with the witness statement to the courts in person. I also submitted another copy to the claimant solicitor recorded delivery. I have not received any documents from the claimant. I should have had them by 10th March? Even in today's post I have received nothing! I am puzzled and worried why this is so? Where do I sand with this? Can I inform the courts that I have not received any documents from the claimant? Please advice as your assistance is greatly appreciated. Kind regards - IKI

Hi DX The bundle that I am preparing for court and the solicitor, do I need to include my "Witness Statement"? Can I hand in my witness statement on the day of the hearing as I have received no documents from the claimant despite numerous requests? I do not want the claimant to know what I have written. Hi Ericbrother Thank you for getting back. My court hearing is on 24th March 2017 at 2pm (see thread 59). I need to submit my papers to the court and solicitor for the claimant 14days before the hearing. If that is the case what day you suggest that the last day I post my papers to the solicitor? Any secondly, do I send the papers recorded delivery? I am at present writing up my defence for the hearing of 24th March which I will post later on once it is complete and get feedback and advise before the main hearing takes place. Kind regards - IKI

Hi DX I'm confused what you have said in thread 65. I have submitted my N180 some time ago. Now I am in the last stage of going to court hearing. Thread 59 show the "Notice of Allocation to the Small Claims Track Hearing". I need to submit my documents within 14 days of my hearing. I have collated all the documents I have from CLAMANT, DEFENDANT and the COURT. Questions I like to ask are: 1 - Do I page number all the letters received from the CLAIMANT in one bundle and in date order? Do I also send in all the letters which I have received from the debt collection Agency chasing up the debt? 2 - Do I page number all the letters I have sent (FROM DEFENDANT) to the CLAIMANT in one bundle and in date order 3 - Do I also sent in the letters which I have received from the courts? If yes do I do a separate bundle? 4 - Do I send in my defence paper which I am in the process of writing up? Can you please get back to me on this and I need to hand the papers in by 9th March, (14 days before your hearing). Many thanks for your assistance. Kind regards - IKI
