  1. The court were reluctant to tell us specific details - but anything that comes through in the debtors name is usually put to one side in the hope that he'll turn up one day to collect it. It's possible they were therefor sent - but not opened. I'll sit tight and see what happens with the complaint - should be interesting to see them defend their thuggish collectors behaviour.
  2. Thanks for this reply - the amount is £500 - having read the link it says the value of the goods (which I presume means the transaction) must be under £100. Is this still an option?
  3. Sadly it was a debit card payment - had it been credit I think we'd have had the option to do a charge back
  4. Good morning A bailiff attended my mother in laws address to retrieve payment of near £1200. The debt is owed by her step son for driving offences. We only know this much because we read about it in the newspaper. The step son used to live at the property over 2 years ago - and hasn't since. The family no longer speaks to the son, and the bailiff visit came as a bit of a shock. The bailiff was rude, arrogant and happy to shout out repeatedly that he was going to take goods if she didn't pay - making a scene presumably for effect - he even threatened to ring the police... My step mum was frightened and didn't know her legal rights - and reluctantly paid £500. It was 7am and she had work and just wanted them to clear off. Just under 2 weeks previously, they had posted a leaflet with a contact number on - which father in law called and explained to the bailiff that the debtor was no longer associated to this address - and hadn't for some time. We have since contacted the courts - and they have told us that we shouldn't have paid. The court also told us the bailiff had a Warrant of Order - and should not have threatened to take stuff or call police once informed the debtor didn't live there. From what I have read up - this is the typical bullying behaviour that Marstons are seemingly licensed to employ. I have contacted Marstons and been fobbed off with an email address to complain to - interestingly they did tell me that their agents wore body cams - however I'm betting that this agents probably 'malfunctioned' during this visit as he certainly did not conduct himself appropriately. Where do I stand with this? The likelihood is now that they have had a payment - they will return for the rest. Is there a way I can challenge their initial visit and reclaim the money paid - purely because of their threats rather than culpability? Any help is greatly appreciated. Cheers
  5. Good Morning all, My partner received an official 4 page court letter from United Utilities today. We usually pay monthly, and have missed the last 3 payments. We have had trouble accessing the online account to set things up from there - however it displayed an old address. We had intentions of ringing up and setting the DD up but it was forgotten about. We have received no reminder letters, or any 3rd part debt collector letters in the meantime - if we had, we'd have setup and paid up - as it's only a small amount. The Form we have received says Claim Form, and we can respond to it using moneyclaim.gov.uk ? The problem we have is my partner is a student nurse - and it's her name on the paperwork - we are worried about her getting a CCJ as this will show on CRB's and could jeopardize her career. We have rang UU - and they have been arrogant and unhelpful - and have been told we'll end up with a CCJ regardless of us paying it or not now. The claim is seeming for missed payments (which isn't even £100) upto March of next year. Then there are fees of £50 (Legal rep) and £25 (Court fee) Are they playing fair? We can pay the missed payments without a problem in the next week - but they seem hell bent on going to court? How should I reply to this letter - and how likely is my partner to get a CCJ?   6. Hi, We recently bought a vehicle from Carcraft. We had the usual Mis-haps with being called back to sign paperwork they'd forgotten etc - but that's not the issue. We recently had the car MOT'd at their Radcliffe branch, and there were a few advisories. Some of those indicated rust, and also a leak (I think transmission fluid?) The car has been used for a month since this, and then - yep - you guessed it, engine management light came on. I pulled over immediately, and contacted them. They wanted me to take it to Radcliffe - which is a fair drive - and I wasn't prepared to do this given the dashboard was screaming at me to check the engine. They reluctantly agreed for me to take it to a Halfords - which was mercifully less than 1 mile away. I made it clear that I wasn't going to be able to pay - however when I got there it was £49.99 for the diagnostics test. Later that day we picked the car up - the work hadn't been completed as Halfords weren't sure if the repair that was needed was included in the warranty. After a few phone calls they agreed to pay for the work as a 'goodwill' gesture. The whole experience from start to finish has been dreadful. I'm not sure what a 120 point inspection is, but I was assured that the vehicle I'd been sold was roadworthy and reliable. The car is 2010 - and I'll be paying for it for the next 3 and a half years. Given the difficulty in getting a simple warranty repair done, and the number of faults that seem to be creeping up with this car - I'd rather like Carcraft to have it back. It's done less than 4k miles since we bought it. I doubt the previous owner/victim of this car had the greatest of driving credentials - as we found Cannabis in the doorwell. Bottom line, the outstanding on the car is: £5,500 I've spoken to the finance company - if they take it back we'll still owe £3,000 So sounds to me like I've been well and truly shafted. The total I'd pay if I keep the car is in excess of £10k - for a car that seems to now be valued at £2k. Carcraft won't budge on this matter - is there anyway I can force their hand?
