  1. I'll have to find out which card she actually used. With a section 75 claim via credit card, hasnt it got to be a minimum Of £100 spend? Or have I missed read/heard that?
  2. So there's nothing I can do or say, apart from another email now to say it still hasn't arrived?
  3. Nope, as of Tuesday 04th August the game has still not arrived. Nearly a week later after paying the addditional postage for 1-2 days (not to mention the additional price for the game with them instead of other places for that 1-2 day delivery option) Ash,
  4. Hi all, hope I've got this in the right section. I'm looking for a bit of advice in something regarding ordering online from Game. My missus decided to order a playstation 4 game as a birthday present. (party was sunday 2nd aug, actual birthday is monday 03rd aug) she ordered it online, albeit it was cheaper at other sites, she paid the higher price for the item as it seemed only game was offering it with the option of 1-2 delivery days at the time. she ordered is late wednesay morning (lunchtime latest) after no show of the item on thursday, friday or saturday! she decided to contact them saying something along the lines of "I chose to order my game from you as I could pay to receive the game within 1 to 2 working days. I could have paid less for the game from another site but wanted the game for a present that I needed for the weekend. I am very disappointed that my order had not arrived within the two working days after choosing to pay more just so that I could get the game on time! I now have no present that is needed for tomorrow!! I would appreciate a refund of the £1.50 postage that was paid. It would also be a good gesture for you to pay the difference of me choosing your site to purchase my game, I wouldn't have paid more if I knew it wouldn't have arrived. I would have only paid £41.99 if I had bought the game through Amazon!" they replied with: Thank you for your email. > > Looking at your order I can see that you paid for first class delivery. > > Unfortunately we are never able to guarantee delivery times as we do not deliver your order ourselves. > > I can only apologise for the delay and hope that you order is with you shortly. > > If you require any further assistance, please do not hesitate to contact us after doing a little research (although she's not actually sure if its right or anything, she tried with the following email: Hi Dan I am very disappointed with the response to my email. I have read through your terms and conditions and there is nothing in there to state that having paid extra for my game to arrive that it is not your responsibility. It is legal that from the moment a customer pays for their goods or service to the second it's delivered, the retailer - not the courier or delivery company - is responsible, as that's who the contract is with. Therefore I would appreciate the compensation that I previously stated in my email. Also compensation for the embarrassment of not having a birthday present! The game did not arrive again today! I look forward to a positive response from yourselves. they replied with: Thank you for your email. As stated in our terms and conditions we are never able to guarantee delivery times as delivering your order is totally reliant on the courier. Unfortunately this is not something that we would look to compensate. Please see our delivery terms and conditions on the below link: http://www.game.co.uk/webapp/wcs/stores/servlet/HubArticleView?hubId=690775&articleId=690776&catalogId=10201&langId=44&storeId=10151#https://newhelp.game.co.uk/websuite/en/wt#category=053bd4da-0d24-46c6-816a-a1265e4e4b55&component=faq&brand=game&answer=172121e9-b3db-4c96-859c-2547041be7fb&action=answer&faq_deflection=true&view=answer If you require any further assistance, please do not hesitate to contact us. as of now Monday 03rd August, it still hasn't arrived (5 days later on a paid 1-2 shipping method) I decided to come on here as I've always been an admirer of this fantastic community, one which as helped me out personally before. want to know. if they had paid the difference and refunded the P&P i wouldn't have an issue, but the fact they've been like this and i did have a very unhelpful person the phone earlier regarding this, i feel a little determined to try and make a point. Do we have any right to complain? or argue? refund? money back/owed? or any advice on how i can move forward with this issue? anything would be greatly appreciated and i look forward to any or all of your response. sorry for such a long post. hope you forgive me! many many thanks in advance kind regards Ash,

  6. can i get a little help and advice on the appeal to popla. firstly it give me the following options to tick (which should i tick?) I was not improperly parked. The parking charge (ticket) exceeded the appropriate amount. The vehicle was stolen. I am not liable for the parking charge. then a little advice on the reasons I'm appealing, do i just put the same as i did to the PCN company? or do i do it differently? I'm very lost and out of my depth here and would really appreciate some help or a template letter that i should send many thanks for everyones help kind regards Shads
  7. I replied via email (as i have been continuously with them) pretty much starting the quote/advice from Armadillo71 on the 29th March 2015. i received a letter in the post yesterday (27th April 2015) with the following x2 letter documents. (which i might add how poorly printed quality of their sign) what is my next step, any advice would be greatly appreciated, and i thank you all for your help thus far. kind regards Shads!
  8. hi there just received an update, and wish to have some advice on the next step
  9. I tried to include the link to the pdf but obviously I didn't quite do it correctly. *sigh* When you say attach a copy of my appeal how do you mean or how do I go about doing that as the original appeal was a little form online in they're website? Many thanks for your help armadillo, it's is honestly greatly appreciated.
  10. Hi everyone, just an update. Got a reply this morning, this is what it said The link you have sent does not work – we do not have to prove that the driver did not use facilities on site – regardless the terms and conditions are displayed and all drivers should be adhering to these. We request receipts as a gesture of good will as the car park is for customers only, drivers can provide receipts to substantiate their length of stay and confirm their use of the facilities. Please provide your PCN number and registration I will forward your comments regarding pre-estimate of loss onto the appeals department to be considered with appeal and you will be sent a full response via post. Kind Regards Customer Service Thoughts and next step?
  11. just a quick side question while i await your responses on my current draft, i just noticed that on the back of the notice letter i recieved, paying on web has a £1.50 handling charge, and paying by post has a £2.50 charge.. is that acceptable/allowed?
  12. Dear ECP The driver informs me that they were indeed in the Tesco shopping centre and eventually in the frankie & benny's restaurant that evening and I have absolutely no reason to disbelieve them. Unless you have proof to the contrary? i enclose the following document, just to prove that the car park is NEVER more than 75% occupied at any time and no loss has occurred. *insert link to design and access statment* ((cant add link now as cant post link or pictures at the mo?)) At the second time of asking now, cancel this charge notice or if you reject this challenge, send me a valid and correctly issued POPLAicon code by return. At POPLA I shall be asking for a breakdown of the genuine pre estimate of loss that the charge must represent, which might I add that since it was a free cark park, and also it was far from "at full capacity" then there wasn't a loss. Yours, Registered Keeper is this better? should i send this as the final draft for now as my reply to ECP? many thanks in advance for everyones help. regards Ash
  13. Do I add those now to the reply to Ecp or save it for popla?
  14. Is this better, something along these lines? Dear ECP The driver informs me that they were indeed in the Tesco shopping centre and eventually in the frankie & benny's restaurant that evening and I have absolutely no reason to disbelieve them. Unless you have proof to the contrary? or the second time of asking now, cancel this charge notice or if you reject this challenge, send me a valid and correctly issued POPLAicon code by return. At POPLA I shall be asking for a breakdown of the genuine pre estimate of loss that the charge must represent, which might I add that since it was a free cark park, then there wasn't a loss. Your, Registered Keeper Or still something wrong/Ammend? Thanks in advance again everyone for your help
