UKCPS ongoing parking 'charge' - ** WON AT POPLA **
jules153 replied to jules153's topic in Private Land Parking Enforcement
Hurray !!!!! POPLA verdict came through today: "The Appellant appealed against liability for the parking charge. The Assessor has considered the evidence of both parties and has determined that the appeal be allowed. The Assessor’s reasons are as set out. The Operator should now cancel the parking charge notice forthwith. Reasons for the Assessor’s Determination It is the Appellant’s case that the parking charge notice was issued incorrectly. The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were. Accordingly I have no option but to allow the appeal." So it has been overturned. UKCPS did not even submit evidence..... interesting. So really they didn't have a leg to stand on and they knew this when the ticket was issued... Anyway I've learned a lot from you guys on this forum - THANKS VERY MUCH INDEED ! Jules. -

OK, I've made the appeal to POPLA with the wording given by DragonFly1967 above and uploaded the ticket I bought on the day as evidence. Now wait for the decision I suppose... -

I put the code into the POPLA website but there's no details of the the expiry date (?) I'm planning to scan in and submit the actual ticket I bought on the day to POPLA and then use this appeal wording: "My reasons for appealing are as follows. On ##/##/2014 I paid the full amount for my day parking ticket and it was displayed correctly and in full view on my dashboard. I was given a £100 penalty charge (reduced to £60 for early payment) which I have not paid. I understand that by law UKCPS can only charge me for any 'loss of earnings' and since I paid the full amount there is zero loss of earnings and therefore the penalty charge should be cancelled." Any comments? Many thanks Jules. -

Hi Guys, Received a letter yesterday, 29th Oct (though it's dated 24th Oct) as follows: They have included a 10 digit code starting '876' so I presume this is the POPLA code though it is not specifically referred to as such. So now I should appeal to POPLA on the grounds on 'loss of earnings'? Does anyone have a typical format that I could use as a basis of my appeal? Thanks again. Jules. -

Perhaps they were wanting to save the ~£27 that it costs them to get the code?? [see JoeyJoeC's post] -

Thanks again everyone I've double and triple checked the letter and (apart from UKCPS's own 7 digit 'Issue Number') there is definitely no 10 digit number. I'll therefore write to UKCPS, using registered post, and ask for a POPLA code. -

Ok, what format does the popla code take? E.g. 3 numbers + 5 numbers etc. Thanks -
