  1. Thanks for the reply Steve. Yes, shared house with shared facilities. Landlady lives elsewhere. I paid deposit on 11/9/14 which was also to hold the room. This is equal to one months rent. The same day she confirmed receipt of this and the room was mine and she would send agreement to my old address. I paid the same equal amount again on 25/11/14 (the day before I moved in) which covers the first month. But, in reply to your last paragraph, the very latest I should receive confirmation about the TDS is 30 days from 25/11/14? And even if I haven't signed any paperwork the deposit should be in a TDS? Thanks
  2. Hi, I have recently moved into a new room with a private landlady. I paid the deposit on 11/9/14 via bank transfer as this would also hold the room. She acknowledged this via text and confirmed the room was mine and said she would send a tenancy agreement to my old address. I have now moved into the new place but have still not received anything after several texts requesting and her saying she would send. I have read that a written tenancy agreement does not have to be in place, but obviously I want one as was promised. Also I am unsure of where I stand in regards to TDS. I have read different information about this. The sticky at the top of the page says I need confirmation of this within 14 days, but another website says 30 days from the payment of deposit but only if a tenancy agreement is signed. Can somewhere advise where I stand if the landlady just never sends me a tenancy agreement, b) what date I should receive confirmation that my deposit was paid into a TDS., and c) if i don't sign a tenancy agreement is it correct the deposit doesn't need to go into a TDS. Thanks
  3. Hi, another question pls... I have just received a letter from the court with an actual date of the hearing, and getting a bit worried. I assume the court sends the same letter to Cobbetts, and i am hoping that they will now offer me a new, full settlement. Is this normally the case? It has been nearly three weeks since I last heard from them and they offered me around half the amount I was claiming for and I declined. And is it possible to stop/suspend the court date is I want if I do not hear anything from Cobbetts before 28th March (the date of the hearing)? Thanks.

Ive recieved a copy of the Allocation questionnaire for the small claims track from the court, and in section G Other Information Cobbetts have written: Case Management directions cannot be proposed until the Claimant servces a Reply to the Request for Further Information which was die on 27 Decemeber 2006. In light of this, the Defendant may amend its Defence or apply to strike out. Im not sure what this means. Is this standard because i told them I wasnt going to respond to their CPR part 18 request? What does apply to strike out mean? Thanks?
  6. Ok, thanks. I get paid this week, so may as well just pay the £100 now i think. And just to clarify, it says in the guide to the questionnaire to tick that you dont want to delay by a month...if i continue and then Cobbetts make me an offer is it easy to stop the procedings? Thanks
  7. I received my defence from Cobbetts on 13th. I sent back the response to the CPR part 18 request that i found in a separate sticky thread at the top of this page, and I included my Schedule of Charges. I havent included any response to there defence. Do I need to send any sort of reply to that, or will my schedule by ok on its own with a covering letter and the copied text from the CPR part 18 sticky thread? Also I last night received a letter from my local court with the questionnaire and am unsure on how to proceed. Would you advise to postpone any further action for a month, in the hope that Cobbetts will make me an offer. I did speak to Cobbetts yesterday to confirm they had received my schedule and they said they had and would contact me within a week or two. Also i am unsure whether the £100 i need to pay to my local court will be refunded. If I pay the court and then Cobbetts offer me my original amount on the Schedule of Charges, this will not include the £100. Will I be able to claim this back either frmo the Court, or Cobbetts. ANy help is much appreciated.
