Is the dismissal letter legal?
dumbmum replied to dumbmum's topic in Employment and minimum wage problems
Yes he is appealing, but we dont believe that it will be overturned. It started with him being investigated for an incident that had happened at work, he was suspended on full pay and asked to attend an investigatory meeting the following day which he did. the minutes of the meeting show that he was advised thatthere would be 2 possible outcomes:1.Called back for further investigation2.No further action 3 days later he recieved a letter asking him in to a disciplinary meeting and stating the reason for the disciplinary, the day before the meeting another letter arrived adding additional reasons for the disciplinary. he attened the meeting and gave evidence against the original matters but not against the additional ones as he felt that he had not been given long enough to prepare. 2 days latter he recieved the letter telling him he was being dismissed on the grounds of gross misconduct. The original investigatory meeting never stated anything about disciplinary proceeding and he has never been given copies of an evidence against him nor have any witness statements been produced. Then to top it off the dismissal letter is PP,ed by an admin clerk. The whole process has been an joke. -
Is the dismissal letter legal?

Hi Honeybee,I have already compiled number of issues where they have not followed their own process and was wondering how the eventual ET would view the letter being signed by a junior administrator rather than the MD.If nothing else it just seems rude and flippant of them to allow the letter to have been sent out this way. -

Point taken, it just seems like another point in a process that has been handled so badly by them. I am sure by the time it goes to ET it will seem insignificant in the scheme of things. -

Thanks Brigadier2JCS,Yes he could appeal, but we are not happy at accepting the letter with the signature of a junior member of staff. If it is ok for a dismissal letter to be PP'ed, anyone could write one. Surely it is just good manners for it to be signed at the correct organisational level. -
Hi i am looking to find out if the dismissal letter that my husband has recieved is legal, as he is a senior manager his dismissal meeting was conducted by the Managing Director but the letter dismissing him was PP'ed by an administrator, is this allowed or should we ask for one signed by the director himself?
