Do I raise my head above the parapet?
ComingHome replied to ohitsonlyme's topic in General Debt Issues
I'm always mystified how the DCAs can get court paperwork served when you are no longer at that address. Many years ago, when I was on the other side of the fence & chasing people for money owed to my company, I would get a letter from the court saying sorry, he's gone away. If you find his new address we will re-serve the summons for you. -

Don't you have Caller Display? If so, why do you answer? Don't enter into a conversation with them.- 87 replies

"Time is of the essence" One of my favourite legal expressions and written on all orders where I require something urgently by a given date. If the goods are not supplied by that date then that constitutes a breach of the contract. In your case you have obviously paid extra for the express service. See what their response is but by the sound of things they may wriggle.

OK, thanks dx.

Ah, ok thanks. Sorry to hijack the other thread, I just thought it followed on from the OP's experiences. Can anyone help re: the time delay for taking out a CCJ?
-
Hi dx, Still trying to get a grip on my own "6 years" timeline. How long after initial negotiations for the debt (ie default letter, demands, token payments, etc) have stopped can a creditor apply for a CCJ? Then does the 6 years start from the date of the CCJ or the original default? Cheers.

Ok, tanks. It's really just any CCJs I'm worried about. Is there a central register where I could check for these?

Back again. Been very busy for the past few months. Just watching the clock ticking down now as things must be hitting the 6 year anniversary almost every week. Had a look at the credit report sites but not sure what to put for my addresses for the last 6 years as I haven't had an official address. It's been either with a mate or house sharing with nothing in my name. Also don't want to put my current address down to have the report sent to me here. Any way round it without causing other people problems by using their address?

Yes, two bank loans with the same bank. The last one was early 2008. Oh, just remembered there was also £1k due after I returned a vehicle on HP and this was the shortfall which was immediately sold-on to a DCA again early 2008). I've had a look at trustonline. Is it safe to give payment details on there? (I'm still at the stage where I don't like cars parking outside the house lol).

Thanks BB, dx. Can't get on to Noddle - not sure if the site is down? Not tried to get any credit - phone is PAYG. Mostly credit cards & couple of bank loans. Really getting to the point where I can't remember exactly, but cards (3/4) were maxed out up to 10k. Maybe 20K on one loan. Cards probably from 2000 & loans from 2002/3. I use an address, but it's not "my" address.

2008 I suppose..... The finger in the dyke finally gave-way and everything hit the fan. I have no idea what the state of play is at the moment, but there were some big loans which the DCAs are probably still chasing. Iam only now looking at things as next month sees the first "6 year" anniversary with the first problem. I had contact with lenders, DCAs, door-knockers, etc throughout that year before finally dropping off the radar and disappearing to another part of the country. I was fortunate that I had left an old bank account dormant for 20 years & I have been able to continue to use this. Other than that I don't put my name on anything. No idea which claims proceeded past demands or if any made it to CCJ's (which I believe scuppers the 6 year rule?). I would like to move back to my own part of the country but don't know where to start to see if the all-clear will sound next year........
