  9. thanks - it is for council tax. as far as the council are concerned my account with them is clear and they tell me that they have told rossendales this (twice). they first visited a couple of months or so. for some reason i still dont understand, we were under the impression we had paid it off, but couldnt find proof, and their visit was the first inclination. i think they also visited just after the time i THOUGHT we'd paid it (back in october) but i think i thought it was just a crossover in the information chain so ignored it. and maybe another time (just going from memory here!). ugh, my memory sucks.... anyway i've kept their letters. we managed to scramble the money together and paid it direct to the council online (just wanted to get it done and sorted). i call them to confirm and asked them to tell rossendales. i called rossendales first, who said the council have not informed them that the account is clear, so i called the council straight away who said they did tell them but would do so again and that as far as they were concerned my account with them was "clear". it may well be for the charges as i didn't add that in to what i paid to the council - although they havent said anything about outstanding fees still to be paid. i understand i have to pay their fees and that's fair enough (well...) but i just don't think they should be able to claim them if they didn't bother to knock, and just slid a letter through the door before running away. we could have sorted things out there and then if they'd knocked, and saved additional fees. the more i think about it, the more dubious i think it is. thanks again for your help though PT
  10. can bailiffs still charge you fees even if they didn't knock on your door - ie. pushing letters through your door. rossendales have been round about 5 times and i've been in every time - all except one time i wasn't actually in (the other time i just didnt open the door!). i've actually paid off my debt direct with the council but they've visited twice since. both times i've called and told them the debt is paid but they say that the council hasn't informed them. twice i've rung the council and they say they have. if i owe fees, i owe fees (although they havent stated how much and i believe they overplay it too, but i've kept copies of everything and am prepared to put in a complaint if necessary) but i am trying to find out if not knocking is fair. basically, if they knock then i have an opportunity to pay, but the fact that they don't means they get to visit again, so that has me wondering. thanks in advance c ps sorry could have worded the title better i know :S
  11. okay.... yesterday i received back (albeit a couple of days late) a photocopy of the CCA from littlewoods... signed by me... i guess that's it now, huh? :S
  12. okay i see this is the standard letter, just what i thought. had a look at the consumer credit act thread but after several pages just got a bit of a headache. i get that basically they've failed to provide what i asked for and assume i can go ahead and send the form letter saying that i basically deny the debt until they can produce this....? anyone know where i can find an example of the full story on this? cheers

  14. well littlewoods and capital one have not answered so will be moving to next stage with them. j d williams (as "Reliable"), however, wrote back just in the nick of time so i'm not sure what to do next! the gist of it is: account opened in may 2003, info about credit charge amount, how many payments made and the total of that. current balance with arrears amount. then they list the terms at which they are prepared to receive payment from me. the important bit i'll type as they have: "in relation to your request for a copy of the executed agreement under section 78 of the consumer credit act 1974, under regulation 3 (2)(b) for the consumer credit (cancellation notices and copies of documents) regulations 1983 there is no requirement to provide a photocopy of the agreement bearing your signature, it is sufficient that we supply you with a "true copy" of the agreement setting out the terms and conditions to which you have agreed. a "true copy" need not bear the debtor's signature or, in our case, the date of the agreement. we are therefore enclosing a "true copy" of the credit arrangement that was sent out to you when the account was opened." does this mean i'm stuffed? i'm assuming the answer to this question does lie elsewhere on the site but if anyone is able to point me in the right direction (although naturally i will have a look again) i would really appreciate it. thanks
  15. interesting reading although unfortunately in my two (or is it three?) situations they are saying the benefit overpayment was my fault for what sounds like not telling them i was working. which is daft because if i was working i wouldnt have signed on. my problem is after all this time (we are talking 7-10 years ago here) how do i prove anything? anyway, probably not appropriate to go into it right here, but interesting reading anyway. i'm going to scratch my head for a while...
