  1. Black Horse should only default you if the agreement ends with arrears on the account. If you was in reciept of the car from May 09 - November 10, black horse would have expected you to pay every month untill the agreement was closed- in this case by the court. You would have then claimed this money back in the November as losses. I am at present going through a complaint with black horse and the financial ombudsman for a slightly similar case I voluntarily gave my piece of rubbish car back to them in May and they have still expected me to make the last 4 months payments! however I have so far managed to get the default taken off after offering them full and final payment for some arrears i owe them. My credit file for black horse now shows as delinquent - I asked them if they would also remove the delinquency in return for the full and final payment and they said yes and also put this in writing -however they now say cannot take this off my report untill the ombudsman orders them to (turns out the advisor I spoke to doesn't know what a delinquency is and just said they would take it off to get payment from me)...they have however offered me compensation for the distress this has caused and the fact I was given the wrong information. My next step is to claim back all the default charges and interest they have charged me and see what sum of compensation they offer me. I also intend to get all my evidence to the ombudsman so he can tell them to take the delinquency status off!
  2. Hi I was just wondering how you got on with this? I will be negotiating a 2 month (or 60 day) payment plan this month on the 25th (payment is due 28th), I have called them to ask if this will be marked as a default on my credit file and the advisor has told me that they will not mark a default within the 1st 120 days of the due date, if you have not settled within 120 days they will default me, it will just show as late payments untill then so I should be fine. However you say they marked you as delfault after 90 days??? This worries me! Did they remove the default for you in the end? My plan will be as follows £500 28th Sept £500 28th Oct £270 28th Nov So as you can see it will be settled within 2 months of the original due date.
