hi all , iv received a letter from the claimant sol. today saying without prejudice as to save the cost. our cliant has taken the view as, in the ligt of the costs incurred to date and the balance outstanding, it is prepared to discontinue the claim againest you on the basis that there is no order to the cost. if you are agreeable to the claim been concludeon the basis please signed and return the consent papers. any advice what i should do. you guys have been wonderful to help me and keep me intact, there will be good donation going to this site for sure once it has been sorted. many thanks to all.

hi. just to let you know the latest progress i have received the letter from the claimant sol.after emailing them, saying they are seeking instructions from their cliant and will revert shortly.

ok mike halk ill do that tomorrow but can i claim the cost which i paid to claimant when i went to cort hearing to set the case put on side. the judge asked me to pay the 440 to the claimant. plus the court fees.

there was definatley no financial gain was for me, only stress and wory mike hawk. but will ring on monday and see what they say.

also received papers from the court,it says; before the proper officer sitting in the county court. upon hearing the solicitor for the claimant and for the defendant. by consent. it is order that 1; in order that the parties can obtain handwriting experts report paragraph 5 of the order dated 28 november2013 be further varies as follows ; a; each party shall serve on every other party the witness statement of fact upon which it intends to rely. there be simulaneous exchange of statement by 4.00pm on 27 june 2014. 2; there be no order for cost between the parties in connection with this order.

hi. iv received the report from Dr. Giles the signeture expert today.it says, SUMMARY OF FINDINGS ; 1. the limited guarantee bearing the question in the name of mr xyz. is attached to a waiver of legal advice, also bearing a signature in this name. i have taken his signature on awaiver of legal advice into consideration in my examinations. 2. the questioned signature on the guarantee and that on the attached waiver of legal advice appear freely written. the signature show similarities one to another and are superficially similar to the signeture of mr xyz. provided for my examination. however, these signatures differ in detail when compared with mr xyz.s signature. 3. the number and nature of the differences observed lead me to conclude that there is very strong support for the view that the signature on the guarantee dated 21...2009. and the attatched waiver of legal advice are not genuine signature of xyz. but are attemtps to simulate his genuine signature. 4. the questioned signatures on the guarantee and the waiver of legal advice show some similarity to the signature in the name of aa bb cc.on the deed . the degree of the similarity observed amount to positive , albiet it weak, evidence to support the view that aa.bb.cc. made the signatures in the name xyz.on the questioned guarantee and the attatched waiver of legal advice. what shall i wait for the claimant solicitors reply. many thanks.
