  1. I am getting bombarded with calls and home visits at the moment as I'm around 9 weeks behind on my loans. I'm currently negotiating a possible payment plan or even Debt Relief Order. Someone mentioned you can request 28 days relief while your dealing with debt, is this correct and is there a template letter I could use for provident at all to help ease the stress, would appreciate any help Many thanks

Here they are, I folded out the bit that has name and adress printed at the top, it basically says Credit Agreement regulated by the comsumer credit act 1974. the agreement is behind us, Shop Direct Finance Company Limited. whose registed office is at Aintree Inovention centre pack Lane, and you the consumer described below(where name and address is printed)... I missed a bit of their address off but you get the idea.

  5. Its Lowell, the agreement has name and address on it at the top and the date issued on the bottom. there is no account number or signature on it. its for just over £500 originally with Littlewoods
  6. Hi There, Been getting chased for an old debt with a well known catolougue company, sent the signed agreement request letter, after a couple of weeks I got a letter back today basically saying. "your original creditor has provided us with the attached reconstituted copy of the credit agreement you entered into with them, which they confirm you would have signed prior to the granting of credit to you". Under 77/78 of the consumer Credit act of 1974, we are not obliged to send you the exact copy of your signed agreement. We are permitted by those sections of the consumer credit act 1974 to provide you with a reconstituted copy of the version you would have signed" Anyway not sure what my step is here, they have not supplied me with a copy of the signed agreement, what should my next move be?? Any help much appreciated regards
  7. Hi There, Like a lot of people these days I have gotten into a pickle with these sorts of companies. I am currently on sick leave and had set up a payment plan arrangement with this company for £20 per month. I was shocked that a couple of days ago that two payments left my bank without being part of the payment plan agreement and for more than what we agreed to as well. I rang my bank and informed that I am in a payment plan and please stop future payments which was marked on my account. Than today I was shocked to see that my account has been cleared out virtually to a penny for almost £300(basically money I am supposed to live on for a few weeks) I phoned my bank again this morning and they informed that it is actually pending but they cant do anything until its been paid where they can look into it and dispute it. This payment is to ARISTE HOLDING LTD which after googling I can see is Cash Genie. I am gutted as I actually have a new bank account now where I was supposed to get all my money paid to avoid this type of thing but this was not updated in time. I am a bit disappointed that Halifax are saying they cant do anything even though it hasn't actually been paid yet. Any help and advice would be most helpful here??

Good Luck, if you have other loans you might want to think about opening a new bank account and getting your funds transfered there, thats what I did so at least I know my money is safe why I try and deal with the mess I have. I am lucky a couple have accepted full and final settlements and I have a payment plan with a couple but minicredit and Capital Finance One are two of the worst Payday Companies and I strongly advise people to steer clear of these two companies as well as payday express.

That is a tactic a lot of these companies use now as they know people are desperate and will pay a fee to have instant cash yet in reality a cash transfer between UK banks is pretty much instant now. I don't understand when they say it will take 3-4 days for he money to come if u don't pay for quicker payments
  10. I have told them my circumstances and offered a payment of jut over £100 in full and final payment. As I will soon lose my job. I am tempted to complain about them as ignoring emails and making it difficult to contact them is a joke when interest is still be added
  11. I had a loan from them for £100 but like you I only actually got £80.50 in my bank. Struggled to pay and again like u they don't reply to any email or calls. I sent a letter by recorded delivery now as the debt is now over £500 and that is just with being 5 weeks late. Shocking

Hi There, I have about 4 debts with different DCA and I have been making an effort to write and offer them amounts that I can afford to pay as full and final settlement. the response I got "we refer to your offer to pay a sum in settlement of your liability for your account. we can confirm your offer is accepted provided you pay on time. wehave reduced the amount due to the sum you agreed to pay. Once this reduced amount has been paid, your credit file may be updated with the credit reference agencies as "partially settled". If you fail to honor this agreement the original amount will be become payable in full. Do you think I should accept this or if I push them I will be able to get it changed to settled and maybe get the default removed??? I feel a bit uneasy with these terms
  13. I to took out a loan with this company and have not been able to make any repayments yet due to being sick from work. I was shocked to see the amount of interest that has been added cince I took the loan 3 months ago. I got this text yesterday and was going to respond as it seemed like a good deal but thankfully I saw this thread. I also at one point applied via money majesty and relised when cash was taken from my account they are part of CFO. In fact I get a few text from weird names which I think must be linked to CFO. They should not be allowed to do this. thankfully I contacted my bank and told them to put a block on any payments going to CFO as I did not authrise any. Anyway I am a bit stuck as to what to do now, if anyone has any suggestions please let me know. so this resolve offer is definitely a fake promise??
