  1. Thanks for the reply DX. The ex still has the phone but the sim has been cancelled so he can't run up any more charges! The current debt is approx £200 but she still has 18 months left of the contract which is about £45 per month! If she cancels it she will have to pay the remainder of the contract plus what 'she' owes! What do you mean by the DCA's ''can be let loose by way of a letter on the actual 'user'''? If she cancels the direct debit then it will obviously hit her credit rating but as you say it may force the issue! Is there any way she can cancel the contract and pay off the outstanding debt but not have to pay the future £45 per month for the next 18 months - plus the ex still has the phone the contract was taken out for?! Any way she could contact the police to say he's got the phone that is legally in her name? Thanks for your help!!
  2. Hi guys! My neighbour stupidly agreed to take out a 2 year mobile contract with O2 for a boyfriend but in her name. He has since left taking the lovely new I-phone and left her with an outstanding bill of £200 and over 18 months of contract charges of over £45 per month. She has contacted the ex and although he has promised time and time again to pay the outstanding debt and to maintain the regular monthly payments he continues not to pay a thing. O2 have blocked the phone and have threatened with sending the outstanding debt to Debt Collection Agencies and expect her to continue to honour her montlhy contract charges. She is a single mum and although in part time employment still relies on the benefits she is entiltled to. She can't afford to pay the outstanding debt and can barely afford to continue to pay the £45 per month. She has contacted O2 who have been less than helpful and whilst I understand their position (as the ex still has the I-phone) and the contract was taken out in her name there must be something that can be done either in consultion with O2 or something that she can do to get the money (or phone) back off the ex?! Any advice would be greatly received as she is very worried about her finances and doesn't know where to turn. She is learning a hard lesson from trusting someone but needs help! Thanks!!

I agree with you dx but now worried if the same incorrect assumption was used on my mortgage application they may look at a fraudulent application - I had to give 3 months of pay slips and they clearly state that I was being paid by Westaff (employment agency) but working for another company. I can easily get proof of this fact and it was made plain and simple at the Mortgage application. As for the financial planning review the fact that the advisor selected EMPLOYED by Westaff is a confusing factor - all it was was a screen print from their computer that was from a 1 on 1 face to face interview! I made no bones about the fact that I was working at the biggest employer in the town via Westaff and that is why they asked for additional assurances such as other income protection policies and my parents as acting as gaurantors! I have spoken to the FOS and they have upheld claims coz the bank didn't record ur details correctly - i could not mislead them on this unless I was actually employed by Westaff as a recruitment consultant or in accounts etc but my payslips stated my location of work for the company. Not sure what to do but am confident that I was truthfull throught the mortgage application (which is not being called into question) and at the Financial Planning Review when the MPPI was recommended (where my employment status is being called into question). How do u suggest I go back to them on this one?
  4. Had my response back from HSBC in respect to the Mortgage Payment Protector and not what I expected - rejected! Suprising really seeing as it was for the same reasons that the Loan PPI claim that was upheld. I was working for an employment agency on a 6 month contract so the Insurance would have not paid out. However, the response says the following: "You have stated that you believe the Mortgage Payment Protector should not have been recommended to you because you were working on a 6 month temporary contract. However, the confidential questionnaire completed at the time of sale confirms that when your Mortgage Payment Protector was taken in June 2001, you were employed by Westaff as a Financial Analyst." This is not correct - Westaff are an employment agency and I was paid by them on an initial 6 month temporary contract working for the largest employer in our town. Therefore, I was not in full time employment and this was made very clear to the HSBC Financial Planning Manager who conducted the Financial Planning Review. This was the main reason why hes suggested that my parents act as gaurantors for the mortgage and that I took out all of the extra cover plans. I even had to hand them over copies of my previous 3 months payslips which clearly stated that they came from Westaff but that my place of work was for this other company. I can easily prove that I was working for Westaff on a 6 month contract but am now concerned that because the guy ticked my employment status as EMPLOYED by Westaff that they might be able to wriggle out of this on a technicality. This doesn't change the fact that I was a temporary worker on a dhort term contract with another company and would never have qualified for cover from the Mortgage PPI policy. How do you think I should respond as I think that they are just going to stick to their guns and say that you said you were 'employed' therefore it was not miss-sold.
  5. I have received my offer letter in regards to the Personal Loan Protection and I just have a few queries as I'm not sure how they got to that figure?! The PPI Premium Redress value doesn't stack up with the value or time period I was thinking. They give me no further breakdown of how they came to this figure - do they have to provide me with a breakdown i.e Monthly Premium paid, dates and months paid etc. As this loan was repaid early and consolidated into a remortgage would this value be a settlement figure that I had to pay for repaying early and the remaining was rebated? Also they did not investigate my claim that I did not receive any rebate nor did they consider interest payments incurred for any PPI carried over into the Re-mortgage. Any suggestions?
  6. DX the response that I received was very detailed from HSBC rejecting my claims against the Mortgage Protection Plan inc Critical Illness and Individual Income Protection. This was a very thorough report considering it was back in 2001 that I took the mortgage out and I must say the reasons behind why these policies were suitable for myself and my circumstances at the time all seem reasonable. However, conveniently they found no evidence of my parents being gaurantors on the mortgage (funny that - it appears on my Mortgage Contract) however, they did state that the advisor is well within their rights to ask for additional security depending on an individuals circumstances. They also go on to state that their process has built in checks and that the policies would not have been stated as compulsory with the mortgage etc etc. I will post up the full response later in the week once I have scanned it in. I am still waiting to hear back about the Mortgage Payment Protector (MPPI) but I have had my HSBC Loan Protector claim upheld so am hopeful of the same with the MPPI as it was all to do with being a temporary worker. Hopefully might have some good news arriving on my doorstep today in regards to the Loan PPI.

Update Non PPI claim (Mortgage Protection Plan inc Critical Illness Cover & Individual Income Protection Plan) both rejected! 3 Page response very detailed and accurate findings seeing it was back in Aug 2001. When I get a chance I will post the response on here for you guys to take a look and advise if there is still a chance via the FOS. Mortgage PPI - still awaiting response - nearly 9 weeks now - have phoned and they have assured me that this will be completed this week, Loan PPI - claim upheld - awaiting letter and breakdown of payments etc. I will post details once I receive the letter. Thanks for all your help so far!
  8. To all After a couple of phone calls it has been identified that there were 4 claims in total for the ex but only 1 of them is for when they were cohabiting. The 3 that predated this have now been removed from my neighbour with their apologies. However, the one that arose in 2009 she has received no previous notifications (think her ex changed his address so post did not arrive at her address once they had split up). The council have stated that the arrears were not caused by miss-payments but were caused due to the numerous changes in her circumstances during that period i.e leaving her job due to pregnancy, ex becoming unemployed then employed etc. I believe that there is Court Order but she never had any knowledge of this or any arrears in the 1st instance. The Debt Collectors have apologised for their conduct and have wiped of any extras from the debt - visiting charge etc and have agreed to set up a payment plan of £15 a month and that their will be no baliiffs turning up to collect the money. My neighbour is a single parent of 3 kids (one is only a few months old) on benefits who has had this landed on her because her (insert any swear word you like) ex has racked up numerous debts and buggered off to Poland. I can't see how this is fair and why she has to pay this and that he can't be chased for the thousands he owes on numerous things. Please advise if there is anything she can do or if because she is liable she is better off just paying the £15 a month until it is cleared. Thanks

  12. To all I am writing this on behalf of a friend and would be grateful of any help as this has become an urgent and quite complex situation. My friend's husband racked up some Council Tax arrears before they got together at a house that she never lived at or even visited. They got married in 2008 and the council tax arrears was from 2005 - way before they even met. They have now split up and the ex has moved back to Poland. Post has now been re-directed to my friends house and she has received a letter from Ross & Roberts - Civil Enforcement Agents acting on behalf of South Somerset District Council. Bailiffs have also been to visit to recover goods but she didn't let them in. She has contacted South Somerset District Council and explained that they weren;t even together when the debt was created and they said that she is liable as his debts are now theirs as they are married. Bailiffs are coming back demanding payment and a regular payment plan or to recover goods. How can she be liable for a debt that was not hers against a house that she has never even stepped foot into let alone lived in - this doesn't add up to me - any urgent advice would be grateful as this has reached a serious situation.   13. Hi naithr - sorry to hear of the complaint being rejected! Looks like they are gonna play hard ball with you - keep up the fight! I'm sort of expecting the same response in regards to the critical illness plan but I still feel that the repayment protection policy they sold you that would have provided the same cover as your employer would needs looking at again (probably why they didn't mention it) I'm sure the more experienced people on here can advise you better tho! Having read my policies HSBC do state that their advisors will only give advise on their own products and policies. As for the questionnaire that u apparantly filled out - if it was the same as mine it was a 1 on 1 chat (called a Financial Planning Review) at the same tiime as the mortgage was appplied for and THEY gave recommendations as to what cover you needed with the mortgage based on your financial, employment and lifestyle requirements - basically you need to sign up to our recommendations if you want the mortgage to get approved. Dont give up hope - I still have a copy of this Financial Planning Review Report - so maybe you can ask HSBC for that?

Quick question dx - House Insurance (Buildings & Contents) was taken out with HSBC at the same time as the mortgage at the same Financial Planning Review where I was miss-sold these MPPIs - if this was also advised that I must take this policy out to get the mortgage can I also claim for that (even thought it was needed - although not necessarily with HSBC)?
