  3. CAN ANYONE HELP? HAVE A CAR FINANCED WITH BLACK HORSE. HAVE PAID 1 YEAR OF A 5 YEAR AGREEMENT, AND CIRCUMSTANCES ARE CHANGING VERY FAST. WE ARE LEAVING THE COUNTRY BUT CANNOT AFFORD TO PAY OFF THE CAR BEFORE WE GO. CAN WE - -ASK TO HAVE THE CAR REPOSSESSED AND LET THEM CRY, WE WILL BE OUT OF THE COUNTRY AND MAYBE THEY CANNOT PURSUE THE ISSUE IN ANOTHER JURISDICTION there is no plan to return in the immediate future.
  4. i had the same situation with first trust and was informed by the court that 1 they have until midnight on the reply date and this can be done by fax 2 the court can have a backlog of disputes to be logged onto their system. the court rules say that they have 5 working days to clear any backlog 3 their is also something about a return date on a weekend, they will accept first post on monday i applied for a default decree, and the dispute was on 2 days later. my default application was returned
  5. interest can only be added when you are filing to court. ulster will pay as soon as you have filled in the court form, it is at this poiunt that they know you are serious
  6. michelle, if they don'y answer by 30th you have won. but UB haven't gone this far before, they normally pay up very soon after the claim has been filed, they then make people sign confidentiallity clause. this is why you do not read to many success stories from the NI big4. they are so afraid that everyone will start this, you know what this place is like, when 1 person gets a few quid everyone wants some
  7. ulster bank will pay up in full but you have got to be prepared to go all the way. to the best of my knowledge they have not been in court yet, but have settled beforehand with a confidentiallity clause. this is why you don't see to many success stories about NI banks.
  8. it seems that they either make you sign confidentiallity clauses or they come to your house in the middle of the night and make you disappear. they do have a couple of cases that have been in court but they sought adjournments. there seems to be a couple of cases to be heard in November
  9. the fees and charges applied in ROI are a lot smaller than up here. there may already be something in place to keep the charges down
  10. the return date is the date by which the bank have t respond to a claim otherwise the claimant can apply for a default decree. the court can have a backlog of disputes to be entered on to their system of up to 5 days, so what may seem like no response, can have a dispute logged afterwards. even if the court office is up to date fully, the bank can apply by fax until midnight on the date.
  11. go for it BMT decide on a timetable and stick to it because they will stall you at every opportunity. get wife to do up a letter authorising you to operate on your own, this may save her going into court. be prepared to go all the way, and you will win
  12. nikki is 100% correct. get your SAR away now. it took them 38 days to give me a response. you will have 5 weeks to read the whole site. check out also the possibilty of placing your account into dispute and paying no more until the dispute is resolved. check this out further but i think there is an option there somewhere
  13. ulster have paid out cases in the past, but they will only pay once you have filed a claim. they are not going to roll over and play puppy-dog, but they will pay up. i know of at least 2 definite success stories, and of no-one who stuck at it and failed.
  14. read, read, read. the more that you read on this site, the more savvy you will be very quickly. you will gain confidence that you will succeed, so forget about nerves and just get reading
