  1. Hi all, I need some advice please. Over the past 18mths I've been fighting a battle with Vanquis over Charges on the account. They defaulted me in Nov 2019 for a balance of £280 made-up of charges (of which I actually paid to clear and is now marked as Default Satisfied) I obtained SAR from them to challenge all the charges on the account and noted ROP was charged. Queried this with themselves and they agreed to refund all charges for this + 8%. However, on certain statements I was charged Overlimit fee after this was applied. They have also agreed to refund these +8% This comes to a nice sum of £875, but more interestingly as my account would not have been in default due to this refund they are contacting the CRAs to remove the default flags. My question is, should there be any kind of award to myself for them to negatively reporting on my credit file for 18mths. This has meant the only form of credit I could get when the boiler went was a high interest loan via Everyday Loans (recently cleared via insurance refund)
  2. Hi all, My father has held a credit agreement between himself & Barclays since October 2014 (Credit intermediary is Cathedral Motor Co). He's already had a phone call from the dealer about refinance / settlement for a newer model & he asked me to take a look at his agreement and see if I could work out a rough settlement figure. However I've read the agreement a couple of times now, I dont know if its late and I'm tired but I dont think it's been worked out correctly. On the Pre-Contract Credit Information it shows that the cars cash price is £10,145.00, of which my father traded in a car for £1000 as a deposit. This shows that the total amount of Credit is £9,145.00. It then lays out the Repayments as "First Monthly repayment £259.67, followed by 46 monthly payments of £160.67 and a final repayment of £4,049.00". The total amount you will have to pay states "£12,860.16 (This includes any deposit you have already paid)" Now the conditional sale agreement shows figures as follows: Cash Price: £10,145.00 Advance Payment: £1,000 Credit Amount (less Advance Payment): £9415.00 -- There is a line of text saying "We use the amount of credit to by the vehicle from the dealer" Total Charge for credit: Credit Facility Fee: £99.00; Completion Fee: £199.00; Interest: £2,417.16 . Total £2715.16 Total Amount Payable: £12,860.16 First Payment: £259.67 Monthly Repayments: 47 repayments of £160.67 Final Repayment: £4049.00 Interest Rate: 4.65% per year Fixed; APR 10.4% fixed This is where both of us are confused.... Pre Credit agreement: £259.67 + (46 x 160.67) + £4049.00 = £11,699.49 Conditional Sale Agreement: £9415.00 + £99.00 + £199.00 + £2417.16 = £11,860.16 Conditional Sale Agreement Repayments: £259.67 + (47 x 160.67) + £4049.00 = £11,860.16 The statement from Barclays each year shows at the top right: Total Amount of Credit: £9,145.00 Total Interest Amount: £2,417.16 This of course gives the total of £11,860.16 - so why does the agreement state the £12,860.16 is payable, where has the £1,000 difference gone, plus is it 47 or 46 payments? If anyone knows how to work out approx settlement on the above info it would also be greatly appreciated.
  3. So it has taken them a year to respond - and now they have finally removed the entry from my credit report!!!! (Plus the other entry they talk about has been removed - which I find quite strange)

Thanks to the FOS, Shop Direct have agreed to refund the charges: [1] Very: A/c Written Off By Lowell - Charges: £228 [2] Kays: A/c Written Off By Lowell - Charges: £240 [3] Littlewoods: Lowell - Charges: £216 [4] Additions: CapQuest - Charges: £360 However as [1] & [2] have been written off nothing will be received. For [3] & [4] - Both Lowell (Balance £409) & Capquest (Balance £884) are both refusing to amend my credit report with the correct values/information. Lowell have stated to Experian that the entries are accurate and that: "The default refers to a Shop Direct (Littlewoods) account that Lowell purchased. We ceased pursuing the customer for the remaining balance on this account. However, this did not mean that the debt was extinguished or that the default would be removed as we are no longer collecting the debt" Lowell & Capquest have told me that they have not received any notification from Shop Direct, despite Shop Directs assurances to both myself and FOS that they have. As for the PPI - FOS has upheld my complaint. Shop Direct was given until Dec 14 to prepare an offer of settlement. FOS stated that this was not within their guidelines (as with other settlement offers Shop Direct have issued to its customers) and are now liasing with Shop Direct regarding recalculations - As of today NOTHING has been finalised!! [1] Very: A/c Written Off By Lowell - PPI: £442.25 [2] Kays: A/c Written Off By Lowell - PPI: £52.40 [3] Additions: CapQuest - PPI: £96.57 Above values are the fees paid and exclude interest. I would love to know what they originally offered, as FOS have said it must follow our guidlines of Interest Rate and also the 8% what do you think I could be looking at getting back? Shop Direct have stated to me that they will not look at refunding any monies to myself but will pass on to the relevant DCA's to reduce the balances!
  5. I have sent the following response in relation to the Charges: the guy from FOS responded a couple of hours later Thank you for your email. I will get back to you as soon as I have a response from the business regarding the impact of the PPI settlement. But I should say that what you have provided below is not sufficient for me to conclude there has been an error here. You are speaking in very general terms and have not provided any tangible figures or supporting evidence to show what has gone wrong. However, I will be in touch again as soon as I have heard back from Shop Direct with some additional information. Am I missing something? He had all the copies in relation to figures, copies of the SAR, spreadsheets showing the charges etc.
  6. Hi all need some help with this. The chap dealing with the Charges enquiry has called and said that Shop Direct do not recognise any interest is due in relation to the charges. I've stated that there was interest applied on the account as per the rates in post #132. He has stated I have to do a brief outline as to what i believe the interest is for each of the accounts and why. He's also said that shop direct state that interest was only charged on Buy Now Pay Later when these came into effect, but I dont think that this is the case. Surely they should recognise some form of interest either at account rate or the 8% I dont know what to write back to him but he want's something asap as he says "It's been going on long enough" and I'm getting the charges refunded.
  7. So since my last post.. FOS are going back to shop direct to enquire about the interest applied to the charges. AND 5mins ago I have has a phone call from the FOS regarding the PPI and they have said they are Upholding my complaint
  8. Hi All, I've received the following from FOS today in reference to the Charges on the 4 accounts. Please note as the letter states this does not include of effect the PPI claim for the accounts that was also submitted. Just a refresher on the balances of the accounts: [1] Very: (Account Interest Rate 44.90%) Balance £1080 - A/c Written Off By Lowell Charges: £228; PPI: £442.25 [2] Kays: (Account Interest Rate 44.90%) Balance £173 - A/c Written Off By Lowell Charges: £240; PPI: £52.40 [3] Littlewoods: (Account Interest Rate 29.90%) Balance £409 - Lowell Charges: £216 [4] Additions: (Account Interest Rate 44.90%) Balance £884 - CapQuest Charges: £360; PPI: £96.57 My concerns regarding this letter are as follows: 1) It does not mention the value of any interest that was also incurred along with the charges. 2) The write off - It does not take into account the detrimental effect this had on my credit report. 3) It has'nt been taken into consideration that whilst the Kays account balance (£173) was written off, the charges that they agree (not including any interest) exceed this balance.

  10. I've just had a phone call and 2 emails from these!!! its been well over a year since i heard anything from them

Then whilst we (me and brother) where dealing with our mom's one - it emerged that my mom has policies out that covered the household(life, contentes etc) I was unaware of this at the time of my claim, so I spoke to SD with this news... They paid my mom out based on this information BUT still rejected mine. I have a letter to the FOS sitting infront of me ready to be posted tomorrow.. I'm not settling for SD to say yes to my mom but no to me (despite me having claimed on the policy they can deduct that value from any award)

  13. My mother took a call today from SD, I've rang them back and they've told me their final decision has been sent out. I asked what it was and they have stated despite the new information, they are still standing by their decision as none of the information I provided regarding being covered on my mothers House insurance or the family life insurance was relevant. I asked how and the woman just said, you have different personal circumstances to your mothers??? How can they award one person but not the other in the same household covered by the same policies? Is it due to me claiming on the policy, even though it is mentioned on here and other forums that it shouldnt matter as that sum is deducted from any payout.

I got a reply back from my letter, they said "We note your comments from your letter with regards to the decision made on this case however, we can only reiterate that our decision remains the same and no refund of insurance will be given. Whilst we appreciate this may not have been the outcome you had hoped for we can confirm that this case has now been closed". Bit of a kick in the nuts. However, my brother has been dealing with my mom's KandCo ppi re-fund (I live in same house as mom) and he's successfully got them to refund 1.5k, so I rang ShopDirect and mentioned this to them, I also stated that as my mom's finances are her own I did not know that House Insurance (contents) has been paid for within a mortage deal with the Halifax in my parents name, and also that Life Insurance Policy covered the whole house hold..... They are now looking back into my claim.
  15. Do you think that the points I have made are relevant esp. the parts where she has contradicted T&C's, the way they offer the ins on the website, and the bit about other insurances & lack of checking suitability?
