    Tax credit fraud!!

Hey i'll keep watching for up-dates. I read somewhere once where people rarely revisit threads once their problem is sorted but i've no intention of leaving you in the lurch! lol. I'd much rather see everyone happy. when i first came to this site 2 months i too was in a panic, had lost weight, couldn't sleep and thought for sure HMRC would make an example of me and jail me and although i could barely believe things would work out okay for me, here I am 2 months on knowing that i owe a lot of money but happy! I'm sure you'll be okay. G xo

    Tax credit fraud!!

Hi they didnt ring me they just sent a letter. My letter to them was sent at end of March and they didn't reply to me until 11th April, but my initial investigation started on the 8th March! It might be taking a little while because everyone is renewing their tax credits and they are probably busy. I know its easy for me to say try not to worry but like ECB49 i also owe £13,000 and its just great to know its nearly over, well except the repayment amount which i'm gonna dispute! G xo
  4. Hi Although my situation was different to yours, I had no proof that my husband didn't live with me as the person he lived with claimed benefits and wouldn't allow him to say he lived there. Anyway, my husband did come back to live with me in 2010 but we were not reunited as a couple. I had many personal and health issues that i needed him to help me with and he was very depressed following personal circumstances of his own. Anyway, i also got the dreaded letter for the years 2010 - 2011 and 2011 and 2012 and to cut a very long and stressful story short, I wrote to them (with the help of CAB) and outlined my circumstances. to be honest, i don't think they really care what your circumstances have been and if they can link you and your partner/husband financially then as far as they are concerned you aren't entitled to claim as a single parent. I also waited weeks and weeks on a reply and finally received a letter asking me to pay back £13,000. I have recently contacted them and they want £100 a month off me for the next 10 years (or something) and i am due to ring them back with a list of my expenditures so i can haggle with them about reducing the amount I'm expected to pay. I was also concerned that they'd go back over years and years but they didn't. they just stuck to the years on the letter. try not to worry as soon you'll see light at the end of the tunnel.

Hey jadeybags i'd forgotten to reply to stripey02 as her situation is different to mine, so it was good of you to reply and offer support. Kizzy1972 i also hope you and me and everyone else who's in the same boat get all of this out of the way so we can all get on with life and stop feeling like criminals!

    Tax credit fraud!!

hi kizzy1972, in reply to your question, I didn't ask for a joint claim and i still haven't as i know that me and my husband aren't entitled to claim since the recent changes have been introduced with regard to earnings. Basically i've received the letter telling me my award has now been cancelled and i am now waiting for them to contact me re paying back the overpayment. there's no point making any phone calls to the normal HMRC helpline coz they can't deal with it since its at an investigative stages. I think once you know what you're up against you could ask about a joint claim and i've also read in previous posts about notional offset (i don't know much about this so look at old posts for further info). You obviously have reasons as to why you and your partner decided to live together again a year ago and i'd write it in the letter and tell them why you didn't make a joint claim at that time.

    Tax credit fraud!!

You know that i am only going by my experiences and also old posts on here, but i believe that they are only looking for the years stated on the letters. As i said they could've gone back further with me too but they didn't. i had no proof of my husband living with his mother. I had some proof of us splitting up but that only accounted for a couple of years. id give an honest account of your circumstances for the year(s) in question and that's all. someone i work with got found out living with her boyfriend and she was interviewed and the outcome was that the £20,000 she owed was to be taken out of her house IF she ever sold it. obviously she wont ever sell her house so basically she was lucky! Def go to CAB as they are good, though i had to see 2 different offices before i was happy with the outcome. Gonna go to CAB again when HMRC get back in touch re how i pay them back coz i wana make sure ALL my outgoings are taken into consideration, including the likes of union fees! kizzy1972, its hard to feel positive and you'll have a long wait before you hear anything but i honestly think they just want to claw back as much money as they can. worriedtodeath71 i think just concentrate on the years mentioned in the letter.

Please believe me when i say i felt they same way you are feeling now. I also would've been looking at years and years, but they are only looking at the years stated in the letter. i went to CAB and with their help wrote to HMRC and told them exactly when my husband came back to live with me and they have just written to me telling me how much i owe. that was it. write a letter and tell them when your partner moved back in. okay you'll def have an overpayment and maybe lose your award but its worth it for your sanity. don't think jail is an option. if you look back over old posts you'll see it hasn't happened. i've a friend who's an ex prison officer and he assured me that they won't do this as they would rather recover the money owed than jail anyone! I also lost weight, couldn't sleep and thought the worst. I felt ashamed and could've gladly thrown myself under a bus for my stupidity. I also had no proof of where my husband had been living and most people who have posted on here have said the same. Now though i'm just waiting to hear back about how much i have to pay them. it seems to take them about 6 weeks to get in touch. I got my first letter at beginning of March, rang them by a specified date, sent my letter at end of March and then they wrote to me in April saying that i'd been overpaid etc. Please please try not to think the worst. look at the old posts on here for that glimmer of hope you need

I'm glad you've got an appointment with citizens advice and they will keep you right. I think they will only look at the year they have stated on your letter. As I said i was worried they would go back further but they didn't. I know how you feel, I really do. I felt ashamed also and i think if you read back through these forums, you'll find most people feel this way. I also should have "come clean" when my husband moved back in but to be honest we've had such an unstable marriage I really thought he wouldn't have stuck around for very long. Now that its all sorted i feel as if i can start afresh and soon you'll feel the same way. HMRC seem to be using experian credit checks so obviously something has been flagged up at your address for last year. By the way I also took the advice of 2 different CAB offices and I'm glad i did coz the second time round i got some fantastic advice! Gildo

    Tax credit fraud!!

Hi, first of all I want to tell you not to worry. I know this has come as a shock to you and believe me I've been there. Okay my circumstances were a little different but the end result i'm sure will be the same for you as it was for me. My husband was living with me but we weren't reunited. He returned to look after me and our children due to personal circumstances. I then got a letter from HMRC saying they had proof that my husband was living with me and they would be reviewing the years 2010 - 2012. Like yourself I also had been claiming for several years and was worried that they would go back further. I contacted them and waited on them ringing me but they didn't. I wrote to them (with the help of Cit Advice) and up-dated them about my circumstances. After many weeks of worrying, losing weight, suffering sleepless nights and worrying i'd be jailed, they finally wrote to me and advised me of how much i needed to pay back (£13,000). I contacted them again recently and asked them could we organise a repayment plan but they basically said someone would be in touch soon. So please please please try not to worry. I know of other people on this forum who have had someone from HMRC ring them but it seems the dreaded telephone call isn't as bad as everyone thinks its going to be. Just try to get on with things and definitely go to Cit advice and ask them to help you with a letter. Okay i'm sure there's the possibility of a fine and MAYBE an interview but it seems most people on here have only had a phone call and an agreement for a payment plan to pay back what is owed. Please try not to worry for the sake of your own health and the sake of your children who always seem to know when something is wrong! Gildo
  12. Hi, I just got my letters telling me how much i owe for 2010 -2012 ... a grand total of £14,000. Unsure what i'm supposed to do next. Can anyone help me with this. Was reading on another thread were someone was fined as well as having the overpayment. Do I contact HMRC and ask them to agree a repayment plan with me?
  13. Hey there, yes i've been in touch with payplan but they can't help me out until i hear back from HMRC because the overpayment will have to be taken into consideration. Also, the debt consolidation company i'm with currently have put me in touch with another company who claim back PPI. So I've got that one covered as well. lol. Good news is my mum has agreed to help me out and so that rules out the need for a loan now. woo hoo! Good old mum!
  14. I appreciate all advice and i know you're not judging me. Wouldn't touch payday loans with a ten foot barge pole, as i'd be no better off. Might just write to the catalogue and suggest a reduced monthly payment whilst assuring them nothing more will be ordered. I'm not on a free DMP. I pay a monthly fee which i'm glad to say has just been reduced because I threatened to go elsewhere. I can also request to increase my working hours and if that's not possible I could apply for a 2nd job with my current employers. I know my mum could probably get the loan for me and i could set up a direct debit to pay her back. A loan would definitely reduce monthly payments and at least i'd see light at the end of the tunnel! thanks for replying to me
  15. Hi everyone, Just wondering does anyone know if i can apply for a loan whilst i am in the middle of a debt management plan. I need the loan because i ordered some furniture and other items from my mum's catalogue and now they are charging high interest rates on my monthy payments. As I am no longer in receipt of tax/child credits and I am also waiting to hear back from HMRC wit :-(h regard to how much i must pay them back for an overpayment, i need to cut down on my monthly expenditures. All advice gladly accepted!
