  1. No we haven't done that, my partners Mum lives an hour away from us, doesn't do Internet or telephone banking and she's been back and forth to the bank enough as it is... We may have to look at this as an option if Marston continue to refuse our evidence of payment.
  2. After the documents were sent, the bailiff called my partner still claiming the money was owing. We resent the documents and heard nothing until today's visit. I have a copy of the bank statement upstairs, I will go and check it now. I have emailed/written and signed off as him with his approval. He isn't very good at dealing with things like this I'm afraid. OK - looking at the paperwork and bank statement now. There is a 6 digit reference on the bank statement - the same for all 3 transactions, but I cannot see a corresponding reference on any paperwork from Marston. The reference must be correct as the initial payment was taken by debit card, over the phone by the bailiff.
  3. That's what I figured but the bailiff says they can't find the payment and despite it showing on bank statements it's still payable.... Just to add - I have emailed both Marstons and the court explaining the situation.
  4. Please bear with me here as this is a bit of a long story.... My partner had a court fine from 2009, before he met me. He didn't pay. In November 2014 he received a further steps notice from the court. I wrote to the court offering £5 per week and set up a standing order immediately. We heard nothing from the court and the £5 per week was paid without fail. Early June 2015 a bailiff let herself into our home insisting on full payment. My partner paid £200 on his debit card, my partners Mum paid a further £220 on her debit card over the phone. Later on that month when my partners mum received her bank statement, she didn't recognise the transaction by Marstons and requested the bank claw the payment back. The bank re-credited her account on the 3rd of July. She then remembered what the payment was for and asked the bank to re-issue the payment - they did so on the 6th of July. A month of so later, Marstons claimed my partner still owed them £220. I obtained copies of the bank statements proving monies out/in/out and sent them to the bailiff. Today the bailiff has been on my doorstep claiming this £220 is still owed. She has seen the bank statements but doesn't accept that evidence. Apparently she is coming back this evening with 'removals' What are my options since they won't accept the evidence I have??
  5. I set up the standing order there and then, I also sent a letter stating my intention to pay and the rate I was paying. I heard nothing back after this. The bailiff this morning said she visited because the payment plan had fallen into arrears - this is wholly untrue. I can infact account for 3 more payments than they are claiming I have paid.
  6. Having spoken to the court, the payments made have gone to Marstons. I have just gone through my internet banking and I actually have proof of £150 of payments. No defaults. The original fine was £250. We have paid in total £570.

  9. A little background: When I met my partner he had some debt that he hadn't been dealing with. One of these was a court fine. Bailiff and court letters started to come through the door. I set up a standing order direct to the court for what we could afford - £5 every week. I also wrote to the court informing them. Now I can't remember if we heard back from the court service or not but the letters stopped coming and the payments have been going out every week no problem. Today while my partner was home alone, a lady from Marstons Bailiffs has entered our home and demanded payment of £420 or our goods will be levied. She told my partner the payment plan has defaulted - it has not, I've checked. We have had no prior warning of this whatsoever. My partner has paid the amount demanded, the bailiff has left and left no receipt, no paperwork, nothing. He has phoned the court and they have said he has to speak with the bailiff - the lady at the court said she can see £135 in payments. I have not checked this amount against my records. What should our next move be now? Have we any chance of getting back what has been paid? Thank you in advance.
  10. There has definitely been no order to attend for questioning, also, there is a supposed warrant number on the letter, is there any way of checking if a warrant has actually been issued?
  11. Oh and the letter was hand posted, no envelope, just the one sheet of paper folded and put through the letterbox.
  12. Hi there and thank you for your response. I shall type up the letter for you. It is a photocopied letter, with the Her Majesty's Court Service logo top right. Under this is a blank box and my name only has been hand written here. Top left are lines for claim number and warrant number, both filled in by hand, amount owing £449.36 written underneath this. The rest of the letter reads as follows: NOTICE OF COMMITTAL TO PRISON Re: United Utilities Water -v- Yourself TAKE NOTICE THAT A WARRANT HAS BEEN ISSUED TO ARREST YOU AND DELIVER YOU TO HM PRISON STRANGEWAYS / STYAL. THE COURT HAS THE POWER TO SUSPEND THE WARRANT. IF YOU WISH TO AVOID YOUR COMMITTAL TO PRISON YOU SHOULD ATTEND THE BAILIFFS OFFICE IN PERSON ON 20/3/13 AT 10am If you are unable to attend on the above date you should contact the County Court Bailiff on ********* between 8am and 10am or on ********* after 10.00am. MR MORGAN County Court Bailiff Parts of the letter have been filled in by hand. Parts of the letter have been amended by hand before the document was photocopied. It doesn't look to me like the sort of official letter that should be sent in a serious matter such as prison, butI didnt tthink bailiffs were supposed to misrepresent in this way?
  13. A little update that I need a little advice on please. I haven't yet got round to filing to have the ccj varied, but now I'm afraid to go into the court unless they arrest me..... today I have recieved a notice of committal to prison. Apparently, tomorrow morning I am to be arrested and delivered to hm prison strangeways/styal. Really? Over a ccj to the water company? Is this a new thing? Any thoughts?
