Hi, i got a letter being investigated back in novemeber, ive just recieved the reply and outcome to it, ive been overpaid by 10,000, which is what ive been expecting, they have just lowered my payments which is fine. I recieved a seperate letter regarding the fine that i need to pay, its 1590, and they have split it between me and my husband so basically we have to each pay half... the thing is they have given me 30 days to pay this, and obv i havent got the money to do this, can i phone and ask them to spread the payments so i pay an amount each month etc....

Have u heard anything else? i spoke to the woman the other day and she said my overpayment will be something like 12000, for 2 years overpayment, plus they dont know about a fine yet, she said they are hoping to get them all sorted by the end of this tax year. so we will have to wait and see. well wait some more, its only taken since nov...im just wondering how much they will take back as im in no situation to have all my tax credits stop, i use them to live on....
  3. Blimey thats not good i imagine mine will be the same then, and i deffo wont be able to pay that bakc in 30 days, lol, i think u can phone and ask to repay that over a longer period, im not to sure though,i hope u can, cause i hvent got that sort of money

Hi, i phoned them the other week, but had to send in paper work from my husbands work, they got some figures wrong, my claim was at the point of coming back from the penalties team, but now they have othe paperwork to look at they said it may take a little while longer. they did say they were going to write me before any of my payment changed to let me know. How about u ???

Hi, im in exactly the same position as u, wrong income didnt know i had to declare husbands car etc... i got the letter late november and like u was worried sick, i phoned them the next day and told them that the figures they had were right and i was wrong...the woman n the phone said she would pass it on and not worry..anyway, i thought abit about the figures they had and i asked husbands company to send me the amounts for the fuel benefit/car benefit etc...she sent me the form they send off to the hmrc ever year to declare this...and on reading it, the tax credit hmrc are near on 2000 pound out each year (they are going back 2009/2010 and 2010/2011) so im waiting to hear what they come back with before i write to appeal they have the wrong figures aswell, to top it off my hubby got some letter through the other day about his tax, the hmrc have gotten his amounts for fuel etc wrong an now hes having to go on a higher tax bracket to pay back 2000 odd pound, so not only are they going to sting me roughly 9000 tax credit over payment also we are going to pay back nearly 2000 back in tax from my husbands wages......i cant see how the same place who get sent forms each year with the correct figures on them get so much stuff wrong..anyway all im saying is check that they have the right amounts etc before telling them anything. plus i still havent heard back from the compliance team about all of this, so nearly 3 months on and im none the wiser, as someone said before u are not alone in this mess, there is plenty of people in the same boat.

Dont beat yourself up about the solicitor, we all do silly thing when in a panic, but please dont part with any more money, its disgusting that he told u that u will go to prison, i have read tons of forums and tales of other people that are in the same situation, and none of them have gone to prison. they have contacted the tax credits and have just had to pay it back, i know mine is going to be a big amount but at the end of the day i will have to pay it back, i still have my family and that's the most important thing to me. u have done the right thing by writing, but as i said u may not hear back for a while, until then dont worry about it don't deal with the stupid solicitor anymore and stop panicking theres no point getting yourself ill over this.

Hi Please dont worry i am in the same situation as yourself, i didnt know u had to declare the car income my husband receives, i got the same letter as yourself, about the 24th novemeber, i to want to pay it back and phoned them to let them know that they were actually right, but do check that they have the right information as looking deeper into it, the have put 2000 pound on each year more than we got, so im going to have to tell them that they are 4000 pound over, so please do check the figures. After speaking to the lady on the phone she said u aren't going to go to prison so dont worry. 2 weeks later i phoned again to see what was happening, the lady said to me they havent even opened my case yet as they are back logged on others, She said they would work out the overpayment and they would sent a letter to say how much i need to pay back etc... but they wouldn't amend my payments until i receive the letter. she also said that if the overpayment was over 5000 they would fine u 3% of whatever he overpayment is. I know how u feel, but im ok now please dont panic, u arent going to jail, just phone them and explain things etc... and please enjoy christmas with your kiddies thats what i plan to do im not going to let them ruin it for me and my family. And just wait for the outcome of what they say, but i dont think its going to be anytime soon by the look of it.
  8. Hi, i phoned them the other day and the lady said they havent even opened my case yet as they are backlogged on others, My money should go in tomorrow so i presume it will be the same as last month

  10. It did say about a penalty on the letter but it reads, that if u comply with them and help as much as u can it will reduce the penalty or they may even decide to not charge the penalty all together, but i suppose its up to them at the end of the day. Will keep u updated

Hi Im in the same situation as u, gave the wrong income and about the company car, i phoned them last thursday and told them that it was my mistake and their info they had was correct, the lady on the phone said she was going to pass it on, but i still havent heard anything, im phoning the helpline everyday but my payments are still the same, im just wanting to know what the overpayment and payments are going to be, we only live on my husbands income and he doesnt get paid till the 22nd dec, so im needing to know when or if they are going to stop my payments so i can sort out about getting some money from somewhere.

Hi I have received a letter from the hmrc saying that they have selected my award for review and that there were some discrepencies in the claim, They have the amounts i have told them and the actual amounts they hold from 2010 and 2011 they said they are extending their enquiries to cover the earlier (2010) claim under section 20(4) whatever that is. i mistakenly told them my husbands wages were 16000 gave them the info for after tax not before, and they are actually 21000, also i didnt realise that u had to declare the tax my husband pay on his car, As i didnt realise u had to declare it as we dont actually recieve the money so why is it classed as income. so now his wages have gone up to 30,679.00 a year, This is for both years. i had the usual panic as i have read everyone has done. but phoned them the follwing day(im also sending a letter confirming this just incase they lose the phonecall) and explained to the lady on the phone all of this and admitted that it was my mistake (although its not very clear to people who dont understand tax etc). She told me not to worry, she said she would send the info on and they would change my claim etc. As i said above im still waiting to hear from them, Cp1978 have u had any payments go in since u let them know your situation ???
