  1. I can assure you I have been MORE than stern with them. I have logged it as an official complaint, and marked it as such, and informed them that it will be referred to the ombudsman, consumer direct and trading standards. Consumer direct themselves told me that i should give them the opportunity to repair the vehicle, which i did, after 3 weeks they failed and then consumer direct told me i can reject the vehicle. It IS a HIRE PURCHASE agreement yes and i understand it's their car, and how the law works regarding that aspect of it. The point is, all the above in theory is fine, but when the finance company just keep responding with "we cant accept rejection" then i now need to go down an alternative route. If that means getting an independent report that's fine, but then what..... TFC are a joke quite frankly and completely going against what consumer direct have told me are my legal rights.
  2. It was in with a ford garage for 3 weeks, they couldnt find the issue with full diagnostics. Basically at speed all the lights on the dash will start flashing and the car brakes on its own, chugs, coughs and splutters, the handbrake/abs/traction lights go crazy, at 70mph on the motorway if you have a car behind you to them it's like youve slammed the brakes on, it's unbelievably dangerous. Ford could not find the problem and said all they could was "clean some connectors" but otherwise they couldnt find the issue. My concern is if 3 weeks with ford cant resolve it, what can.
  3. Thank you, although i was under the impression 3 weeks with the vehicle would be sufficient to repair the vehicle. The fact that it was returned to me having gone in with 11 faults, and came back with 9 faults still present, after 3 whole weeks, is a bit of a joke to be honest in my opinion. The car is an absolute lemon and i have an email from the garage when they took it originally openly stating they dont actually know what the problem is with the main issue, or how to rectify it (electrical). How can i have any faith its going to get fixed.
  4. Well, bit of an update on this. Finally had a response from TFC stating the following. They have said that they want the car returning to be repaired (by the same garage that took it in the first place, and brought it back to me still with all the same issues present) and that they CANNOT accept rejection of the vehicle, and that they have now closed the complaint and that's the end of the matter. Where do i go from here? They took the car for 3 weeks, didnt repair a single thing, and i dont want it anymore i just dont trust it or them any further and this has been 8 weeks of hassle so far from day 1. Many thanks

With respect, i'm aware of how to reject a car on finance, and i'm not sure what the point of having a forum is if the response to question is a google link..... by that reasoning let's scrap the forum and just get everyone to ask google their question? The point is, i can send as many rejection letters as i want, but when they're getting signed for and ignored with no response, i'm at a loss.
  6. Thank you DX, However, getting a response from them in any form whatsoever is proving ridiculous. They do NOT respond to emails. They do NOT respond to letters. There is never anyone available to speak to, they will always call back. Not sure which route to take to get this sorted when the finance company are clearly ignoring me on the basis of they know i want to reject the car. Many thanks
  7. Hi All. I recently purchased a Ford Focus from Stoneacre using finance from The Funding Corporation. After 1 day of collection, a whole host of issues appeared, which were as follows: 1.) ABS/Traction Control/Handbrake lights would randomly start flashing on dashboard. When they did, the car would become very jerky and not drive properly (much like kangarooing) - when on the motorway at 70mph and this happened the car would be extremely dangerous, braking on it's own and hopping around for want of a better explanation. If a car was behind you it looked to them like you'd braked! It is seriously a major fault. 2.) Car won't go into reverse gear. It results in crunching/grinding. I've been stuck in parking spots for 15 minutes before trying 50 times to get the car into reverse and each time it feels like it's in and when you release the clutch just grinding and crunching. 3.) When braking lots of juddering, shaking, doesn't brake straight and true. Steering wheel shakes violently upon braking. 4.) Loud tapping/rattling/knocking/whining noises coming from engine bay. And many more... I complained and Stoneacre took the car back in, saying they would require it for 1 week. After 3 weeks the car was returned to me and at this time, i received a letter from The Funding Corporation stating the following: "We have heard from Stoneacre who have told us they have rectified the issues with the car, on that basis we cannot accept the car returning/rejecting and therefore this is our final response on the matter". Now, that would be fine, however... The car came back with not a single issue fixed, infact, only 1 day after it returning to me the Engine Management Light appeared, the car went into limp mode and wouldnt do over 20/30mph. Then fault codes starting flashing up on the dashboard, and now, when the car is started (it's push button start/keyless) more often than not it will NOT turn off when you've reached your destination. You push the button to shut the car down and it does nothing. You literally have to stall the car to turn it off. I have an email from Stoneacre openly admitting they are not sure what the issue is relating to number 1.) (the main dangerous issue) but they "tried a few things" and it should be fine. Just to clarify, not 1 of the issues that the car went in with has been fixed, it's just come back with more. I just don't want the car now, i bought it 6 weeks ago, i've had the car for 2 of those 6 weeks and it's a complete Lemon. Am i now within my rights to reject the car? The Funding Corporation are nothing shy of useless and to respond saying "that's the end of the matter" is a bit of a joke quite frankly. The problem at the moment is, i really do need a car, and not sure how to go about resolving this. Any advice much appreciated.
  8. I have been contacted by Scotcall (Debt Collection Agency) on behalf of Lowell Group (Debt Collection Agency) stating i owe £190 from a contract with 3 Mobile from 2007. I have never in my life had a 3 Mobile contract or mobile phone, so i asked them for a copy of the agreement or any other documentation to show that i took out this contract. They responded via email stating they have no agreements, no contracts, but will continue to pursue this debt. I completely dispute it, and i'm absolutely baffled as to how these companies can get away with pursuing an alleged debt with absolutely no documentation. Essentially, that would mean anyone can apply a debt to anyone else and have a debt collection company pursue them vigorously for said debt with absolutely no grounding. Where do i go from here please because i know nothing about this debt (it's not as though it's a lot of money, if i owed it i would pay it) but it's sat on my credit file and i refuse to pay for something that i've never had.   9. I have a CCJ from 2009, ive just got credit report from all 3 major agencies, including a multi-agency report, and all court records are showing as clean! I've checked trustonline and the CCJ does show, but as i say, all the credit reporting agencies dont show anything.... I'm not complaining obviously but just curious as to how this could happen!?

Basically, long story short, a claimant (individual) issued a CCJ against me, i didnt know about this because i didnt get the papers due to not being at the address, it only came to light when i applied for a mortgage. I applied for judgement to be set aside because i didnt know who the claimant was, and at which point a hearing date was set and i got a form with the claimants contact details who i phoned, after a lengthy telephone conversation it was established he had got the wrong person and agreed to telephone and write to the court to tell them that it was a case of mistaken identity, and he had now found the actual person who owed him money. However, will this be enough for the court? Can the claimant remove the CCJ that is already in place or will there still have to be a hearing etc? If the claimant is actively telling the court he got the wrong person, i dont see why i should be put out any further for doing absolutely nothing wrong but all i can seem to find online is the ONLY ways a CCJ can be removed are to have a "set aside" hearing and/or pay it in full within 28 days. Surely the claimant telling the court that the judgement is wrong should be enough? Thanks
  11. This is what im asking, is it possible for a claimant to actually remove a CCJ that has already been issued? If they write and say it was a mistake will the courts accept that?
  12. Hi I'm sure this is in the wrong section but couldnt find an appropriate one and it does relate to mortgages to if a mod could move it i'd appreciate it. Basically, long story short, after applying for a mortgage a CCJ appeared on my file at an old address, the papers were filed more than 6 months AFTER i had left there, i applied for judgement to be set aside due to not knowing what it was for or who it was, the claimant (an individual) got the papers yesterday from the court with my application to set aside the judgement and gave me a call, after a lengthy telephone conversation it was established that this was nothing to do with me whatsoever and a case of mistaken identity. The claimant said he would write to the court to tell them this, does this mean the CCJ will be removed even though it's already on my credit file? I've read that the ONLY ways to remove a CCJ are to set it aside, or pay in full within 28 days, i couldnt find any information relating to a claimant retracting an already in place CCJ. Thank you.

Hi All Long story short(ish), around 5/6 years ago i held an account with Santander, at the time there were some charges applied to my account through no fault of my own, after a meeting with the branch manager he agreed the charges would be refunded, however after around 2/3 months still the money had not been credited back to my account so i opted to vote with my feet, i went into branch and closed the account. Around a year later, i received a statement for my account stating there was a credit balance of around £300. (roughly the amount of the charges). I went into branch with the statement to withdraw the cash to be told "the account doesnt exist" and that i should contact customer services, i duly called them again to be told "the account does not exist" and they could offer no further information. I wrote to Santander stating that i would like the funds returning to me, to which they replied again stating no account existed, and that the statement was sent in error and an apology. Now, that would be fine, however 12 months later i receive another statement advising me that i still have a credit balance. And 12 months later again advising me that i still have a credit balance. This has gone on for the past 4 years with the latest statement arriving yesterday, along with a completely seperate letter with "updates to the terms and conditions of my current account" (that's the account that doesnt exist!). Santander tell me no account exists, yet for the past 5 years every 6 - 12 months ive received a statement advising i have money in there available to withdraw, along with numerous letters in between these from santander advising of updates to account terms etc. I contacted the financial ombudsman who told me i have to give Santander 8 weeks to resolve the complaint, however Santander will not raise a complaint because i'm not "an account holder". I really don't know what to do, i've hit a brick wall, they are saying the account doesnt exist yet i keep receiving this documentation every 6-12 months for over 5 years now! Any help appreciated.
