  1. Miracles and being able to earn enough to clear my self from debt! On a more sensible note, which address would I send a SAR to BoS , I have an address for BoS Retail Banking, Tower House, Charterhall Drive, Chester CH88 3AN,

DX, The loan/agreement was via the internet/online documents were sent via courier signed and returned with same courier to BoS all letter headings etc. are with BoS, the agreement number on Lowells claim doesn't correspond to anything I have and the date they have is different only by a small bit but still differs. I had been making full payments on the original loan up to beginning of 2010, then with Payplan monthly at a reduced rate until Jan 2014 due to financial difficulties due to OH becoming ill and child with SEN sorting out Local Education Dept (still ongoing), then I became ill with a debilitating condition (cluster headaches) being self employed it has seriously crippled my work and earnings.
  3. Should have replied, finished this ages ago, I had the same response as WelshMam, no documentation and so claim was dropped.
  4. Name of the Claimant ? Lowell Portfolio 1 Ltd Date of issue - 20 June 2016 What is the claim for – the reason they have issued the claim? PoC as follows:- 1) The defendant entered into a Consumer Credit Act 1974 regulated agreement with Lloyds Banking group PLC under account reference xxxxxxxx ('the Agreement'). 2)The Defendant failed to maintain the required payments and a default notice was served and not complied with. 3)The Agreement was later assigned to the Claimant on 17/06/2015 and notice given to the Defendant. 4)Despite repeated requests for payment, the sum of £9222.34 remains due and outstanding. And the Claimant claims a) The said sum of £9222.34 b)Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, accruing at a daily rate of £2.021, but limited to one year, being 737.79 c)Costs What is the value of the claim? £9960 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Unsecured Loan When did you enter into the original agreement before or after 2007? 2008 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Lowell Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes Did you receive a Default Notice from the original creditor? Yes Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? No spare money What was the date of your last payment? Jan 2014 Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? I had in the past, used Payplan and ran out of money so not anymore. I do not recognise the Account reference number (the agreement) on any of the paperwork I have it doesn't correspond to any of it and the loan was with Bank of Scotland Any help/advice appreciated, am aware of timings so have already been to MCOL and acknowledged the claim and ticked defend. Not sure if I should CCA Lowell Portfolio and CPR 31.14 Lowell Solicitors
  5. I did eventually find a telephone number that got me through and the helpful person on the other end said the phones had been out of action for several weeks!!! He sent me the email address to send defence to, I have until the 24th. I sent the CCA and CPR off so at present defence relies on no paperwork being produced, unless I know what they have I have no defence?
  6. Why does the MCOL website have to break so I can't login or access it..............have to go old style now, as even the phone lines are down and apparently have been for several weeks

Amount Claimed 3830.00 Court Fee 185.00 Legal Rep Fee 80.00 Total 4095.00 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Debt Purchaser (Cabot ) Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes Did you receive a Default Notice from the original creditor? Yes Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? Unsure Why did you cease payments? Ran out of money What was the date of your last payment? Via Payplan december 2014 Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes I hope that is better, as I said earlier I have not been organised and managing it well and time is not on my side as usual, I have sorted out the CPR31:14, but did not know what I should put on the CCA for the account/Reference seeing as that is not mentioned on the Claim?
  8. Thanks, I went to the MCOL website immediately and acknowledged it and ticked the box intend to defend, hoping they do not have the paperwork!

I received the N1SDT from Cabot/Mortimer Clarke as I have been working away so only saw it yesterday morning, I have already Acknowledged it via MCOL I chose the option Intend to defend all. the Particulars of Claim as follows:- By an agreement between LTSB & defendant on or around 15/10/1998 ('the Agreement') LTSB agreed to issue the Defendant with a credit card. The Defendant failed to make the minimum payments due & the Agreement was terminated. The Agreement was assigned to the Claimant. THE CLAIMANT THEREFORE CLAIMS 3830.31 At the total cost Amount Claimed 3830.31 Court Fee 185.00 Legal Rep Fee 80.00 Total 4095.31 My question at present is as there are no account numbers on the form What should I put on a CCA in the Account number Reference to Cabot. Also sending CPR31:14 to Mortimer Clarke To clarify I do accept I had a card through Ltsb and also have been a bit of an ostrich in the past, due to various reasons I also have not been good with repayments since Jan 2015
