Hello everyone i have had no enforcement letter or note. I wrote numerous times to the solicitor who was telling me he was going to issue a ccj,i explained that i was an ex director,my home had only taken delivery of goods twice and has never been a registered office or invoice address. The registered office and trading address has always been clearly available. I sold the company on and the new registered address/trading address is also available at companies house. I had a letter from Martsons this morning saying i had to contact them to arrange full payment or a payment plan,i am going to write to them as i have been advised not to phone them as i will only be asked to pay the full amount. The only problem is despite repeated letters to the original solicitor they were all ignored.... I did telephone as well after the claim form arrived and discussed having the judgement set aside on the above grounds and they refused and terminated the call...

Hello all i was the director of a company last year,its registered office was in newton heath but i had 2 deliveries from a company to my home address. I sold the company at christmas lock stock and barrell and the company moved under its new owner to rossendale. I have since had letters from s solicitor and now a ccj,i have written numerous times to the court and the solicitor explaining that the ccj was not served on the registered office or the correct director. What is the point of having a limited company and an office if debts are going to be liable to me at my home address-there is no wrong doing and the company still trades under new ownership. I sold the company as i was to ill to work,i am now in recepit of dla and eas (support group). I have a balliff at the door demanding over £1000 without delay,i simply cannot afford my normal bills let alone this,any advice appreciated. judgement costs £1,145.26 interest £5.97 compliance fee £90 enforcement stage 1 £241 Total £1,482.66 Thank you for taking the time to read this..

Hi coughdrop thanks for the above,i have phoned and spoke to a lady who said this has gone to far.I was on a payment plan but simply could not afford £20 every week. They say I have broken the plan and no more offers,full payment via card/cash or a locksmith will be here Monday with the police. I am sat here with no heating(I had to make a choice between gas or electric and I am not even having my proper diet(I have to be careful what I eat)I simply do not have any spare money. I'm not even using my car as I cannot afford to run it,i have a blue badge displayed at all times. I hope to return to work in early new year when I am a bit better and would willingly make payment then but as stated there seems to be no alternative but to let them take what little of value they can find...

Hello all I had a man at the door this morning from bristows...I didn't answer but talked to him.I restated that I am classed as a vunerable person/disabled and also the stress of this is making me ill again-I have had 2 transplants. I have also missed vital transplant clinic appointments as I am worried about them gaining entry to my home. I had a letter put through the door stating he will be back 12.30pm Monday to remove goods...I have phoned up and been told there will be a locksmith in attendance with the police on Monday to remove my goods. Please can anybody advise where to go from here.....thank you.

No they would not break down the charges for me on the phone,they said they were only interested in full payment...

Yes she still has the letter,it says we are trying to contact the above named and any information can be given on the above telephone number. I wrote to Tameside council explaining my circumstances but was told there was nothing they could do. If I recall correctly I was parked outside the lines on a disabled bay,i have a blue badge. I accept responsibility for the offence but I am livid regarding my mothers treatment and their refusual to listen,i was polite but told if I was not paying by card there and then the call would be terminated..it took me 3 times to speak to a so called manager...

Hello I had an outstanding parking fine from a local council.The Bristow and sutor visited my old address(where my mother still lives)and despite being told I no longer lived there threatened to call back and remove goods. They left a contact number and I refused to give them my new address,this was simply due to their attitude,i told them I am in receipt of dla and esa yet they demanded full payment or they would return to my mothers and remove goods without further notice. I eventually asked to speak to a manager who wanted £20 weekly..i made a couple of payment but it was impossible to keep up with as I was taken into hospital and my benefits were stopped. Then my mother was given a letter by neighbours,it was a letter from Bristow and sutor given to her neighbours asking for details of my address and whereabouts-even though my mother explained I did not live there. I have now had a letter to my address-demanding the following: debt-£112 compliance stage fee-£33 total sum outstanding-£380 I have phoned for a breakdown of fees,this was refused,i've tried to explain my circumstances and was told they were not interested and I must pay the full amount within 7 days. I also have the message that all my goods are bound and I cannot sell or dispose of them. The baliffs have never been in my house,i will not open any doors to them and I have a blue badge displayed in my car(which is parked away from my house) Any advice welcome please how to deal with these rude ignorant idiots...

Im doing that now wd...i am furious myself that she did that,i told her not to pay anything out but mums are mums.. I was going to a door step lender but was told at the rate i would be paying back i was looking at a total repayment of 2,000 for 400.... Thank you everyone.

Hello seanamarts thank you for your time. The constant letters to my mothers house and the "balliff"or whatever he is/was turning up on her doorstep frightened the life out of her(shes 83 years old). I was never offered any payment plan just asked for my dla proof which also obviously includes my current address. Marstons were clearly told that i do not reside there anymore and were given my current address and telephone number.. She explained all i have tried to do to resolve the matter,i was not denying that it had to be paid i just wanted a fair way of paying. As stated she sold her wedding ring and handed over the cash,she was saying he was very nice and telling her to call the council etc but obviously he would be nice with 370 in his hand.....

Hello everybody after numerous calls from marstons and threats i sent in my proof of dla entitlement to there offices,registered delivery. It was signed for at 9.03 am on 23rd april 2013 by (printed-"MG" and a childish scrible). After another threat saying a high court officer was coming out i told them the postal recepit number as they said i had not sent anything in. They then claimed "NOBODY WITH THE INTIALS MG WORKS HERE"...when i pointed out i imagine MG stands for the Marston Group i was told i was being rude and the phone was put down on me! A few weeks later another letter,i phoned back and was asked to send my postal recepit in,i copied it and sent the original recepit to there offices,i still haven't got my dla proof of entitlement form back.. On Friday my mother had a gentleman at the door claiming to be from the high court demanding 370.00. This is despite numerous calls/letters telling marstons i do not live there anymore,every othere organisation where i have updated my address seem to understand that simple message. I was then told via phone by the "court official"to borrow off friens or neighbours to pay... In the end my mother has sold her wedding ring...due to a mistake with my sick note my claim was suspended leaving me this last month on 50.00pw.. When i arrived at my motheres this morning the recepit for the money is on a marstons letterhead/recepit...shouldn't this be an officail court recepit? If so i feel that a member of marstons staff has falsely impersonated a court official. Even if everything is above board it now seems that there is no course of reply,no so called rules of vulnarabilty,just pay up... I can't even get my entitlement form back..... Hello everybody thank you for all your replies,i have studied the advice and explained again to marstons that i am classed as vulnerable,the reply from the charming person on the phone was "thats nothing to do with me,somebody will be calling at your address". I explained i do not live there and was told "we will be calling at your address"..not sure of my next move although i have advised i am consulting with my local mp.... Martin EDIT:Marstons have just called me backthey have said there is no need to take any legal advice,send a proof of my dla income and they will arrange a payment plan...

Hi everyone i had a parking fine from manchester city council(my car was a touch over the white line when i parked). I am a blue badge holder in recepit of dla and esa which totals £120 pw. I contacted manchester city council who were unhelpful from the start and told me it was not there problem and to contact northampton cc. Northampton cc told me the same and passed me back to Manchester cc. Now i have 5 days left to find £93...marstons told me in no uncertain terms they will take my car,i live with my mother and have no valuable goods of my own(all have been long sold since my illness). I asked could any amount be taken out of my benefit weekly and i was told "yes,the full amount of £93 and given to our balliff). Is there any other alternative to the one solution i have left which is to borrow off a door step lender which obviously i do not want to do as we all know how that could end up. I have a letter from equita for an old parking fine.It has been delivered to me by a neighbour as my address is wrong(he has written just trying number 145 as my house is 45) ...for example number 45 anystreet instead of number 145 anystreet... Am i legally allowed to ignore this,i am saving to pay the debt(now £145 plus £11.20 fees)but it will take me another 2 weeks to raise it. Can they increase the debt if i dont respond(considering that technically i am not in recepit of any letter)? Thank you!

Hi not refused the medical but told it would be around october due to the waiting list,they will not pay me anything until after the medical. I tried to claim jsa but was told over the phone i was too ill to work and it is unlikely i would find any employer willing to take me on. As stated my housing benefit has been stopped and im left with my dla.... My specialist is the person who has told me i would be fit for work as i can do the basic tests they will ask,they will not take my blood results which i have done every 2 weeks at my transplant clinic or any form of examination. My own gp asked me if i wouldn't need dialysis as much aftyer i ahd my transplant.....i understand not everybody can be an expert in every field but i would like the person who examines me to see me on a bad day... Im willing to go for a medical today,but if i do have to wait i will be homeless by the time i finally go...
