  1. thanks firstship, what other data am I waiting for? as it doesnt appear from the letter from Santander that they willnot be sending anything else and it stated that they presume I require that data in order to reclaim my bank charges and have just sent a mini statment and covering letter.
  2. Hi I have just got back a mini statment from the old alliance and leicester account from Santander, the total debt is showing £418.69 and the bank charges I have calculated at £195. He was £223.69 OD when they started puting underfunding charges on at £5 these started on 3/10/08 and on the 3/4/09 they charged£60 for exceeding overdraft limit from 18 feb - 17 mar 12 days at £5.00 it appears that the underfunding charges they started adding sent the account into exceeding the overdraft, which we think was about £250 but cant remember. Hope you can understand this and can you please advise us what we should do next ? they also sent back the £10 postal order by the way.
  3. no they have not suggested he makes a payment via a credit card , It was my idea just to get this paid off once and for all as we want to get a mortgage in OH name soon, but as the default stays on the account until the end of the 6 years whether paid or not I doubt he will be able to get one.
  4. Hi all, I have now recieved a letter from Cabot Financial, infact this is the 2nd the first was just to acknowledge my letter and request for information and return the £1 postal order. Buth this is how the 2nd letter goes: YOUR REQUEST FOR INFORMATION UNDER THE CONSUMER CREDIT ACT 1974 We write further to your request for information under sections 77 and/or78 of the Consumer Credit Act 1974. Although Cabot has requested the information, the original lender is experiencing a delay in retrieving the information form its archives. Although Cabot has not been able to provide you with the information within the prescribed period, we would still advise that your debt remains legally due. We are still able to report to the Credit Reference Bureaux regarding the status of your debt and we would recommend you continue your repayment plan with us or alternatively you contact us to make payments towards your account if you do not have a repayment plan aranged. Thank you for your co-operation and patience in this matter. What do I do now folks ????????
  5. guess what ,sent the letter recorded delivery yesterday and today Cabot (not fire) have replied to my email they have ignored since the 14th June, saying they have spoke to the underwriters and are willing to take a f & f payment of £1500 so its gone down another £600 from the last f & f amount given which they said have to be paid by 3oth June. Should I still wait now for the response from the letter and ignore them for several days like they did to me?
  6. Hi all, posted the letter off today recorded delivery with the £10 postal order to Santander, so now I have to see what happens from here on, thanks for all your help and advise will get back to you when I get a response.
  7. Hi all, hanks for all your advice, sent the letter off today recorded delivery with the postal order for £1 to the PO box for Fire so now I have to wait to see what happens from here on.
  8. Hi all, printed out the CCA letter ready to send but not sure what address to send it to as it needs to be send recorded delivery and the current debt is with FIre Investigation and Recoveries who only give a P O Box any ideas what address I should use please?
  9. hi I will try and email the address for enquiries to you, I am new to this site too, they also gave me 3 phone numbers for courts Southend , Havering and Medway, you will need to book into your nearest court to give a statutory declaration and whichever court issued your fine will have to send the paperwork to that court if its not the same area. Do you want me to send any of the court numbers above if not just email that address explain your situation and ask for your area court telephone number. Good Luck
  10. Hi there, I have another debt question I need your help with please. We had an easyjet credit card with citibank back in 2007/08 what a load of rubbish it was too ( got points for spending to use against the flights then got charged loads of money to use the credit card booking them!) , what a con, other half fell out of work and the debt on the card grew, he ignored it for ages and now recently the debt went over to Fire from Cabot. They sent us a letter stating make us a reasonable offer the debt they say is £3592.11. As we are not in a strong position to pay a lump sum at present we replied we could only pay £500 as final payment as they needed to money paid within a couple of weeks. They replied saying they would accept £2100 if we paid by end of June. We emailed back twice asking if they could reduce it further as there is no way we could get hold of this amount of money as we are having financial difficulties and thinking of going bancrupt but they failed to reply. We did not disclose our telephone number and they are sending these letters to our old address. we could possibly afford to pay around £1000 in a lump sum and pay with a credit card but that would be our limit to the max. This is showing up on his credit rating as a default along with one other defaulted account which we are trying to clear too, we want to get his rating back from poor by trying to clear these debts . Please advise us what we should do next?
  11. why dont you try what we did , email the enquires department for the court area in question, you should find this if you google it. I got a response straight away with 2 telephone numbers for 2 courts one for my old area and one for new area I got through to a guy who probably works in the back office as I got answered straight away, it was not probably the actual court itself I didnt ask as I was so releived to actual be able to speak to someone, but he did all the investigations for me to find out about the fine and contacted the court where then fine had originated and got them to fax all the details over to the court which I wanted use which was nearer to me. He booked me a appointment to swear an oath that this was the first time we had heard about this fine , was in and out the court very quick and they just threw it out as it was 6 years ago. I dont know where these bailifffs are dragging all this old stuff up from, but they are just sending out threatening letters on the hope that some people pay up, when as in our case they really dont need to.
  12. should I then just find out Santander's main head office address and send it there to the Data Processing Team?
  13. hi, if you mean what name is it showing on experian as the defaulted account it is Santander. thanks for the advice on sending the letter firstship, do you know where I can find out the correct Santander address to send it to and also how to I send them £10? cheque, postal order, cash etc also should it be recorded post?
  14. Hi all, I am new to this site and need your advice please, quick detail other half opened an alliance and leicester bank account back we think in 2007, the terms if we remember correctly were you had to deposit £500 monthly and you were given free travel insurance and we maybe a savings account too but we just cant rememeber it was called a Premier current account. He also thinks he was sold some type of insurance for card fraud but again we are not sure, due to being self employed other half didnt keep up with the monthly deposits of £500. We are not sure if he went overdrawn himself or it was because they started to charge him £5 under funding fee for not putting enough money in , but the account went overdrawn and he just left the account and ignored the letters at the time GRRR!! we only have 2 statements to go by as we have moved house and lost paperwork the balance of one starts at £223.69 which is dated oct 2008 and the other dated feb 09 balance is £248.69. Moorcroft are sending threatening letters stating intended litigation and legal proceedings etc stating he owes them £418.68 as instructed by Santander. I wrote a letter to Santander asking if they could remove some unfair charges to try and reduce the amoutn but the debt had already been passed to moorcroft and we heard nothing from Santander. This is showing on his credit as an defaulted account and we want to get a mortgage in the next 6 months so really want to sort this out. Please can you advise us of what we should do? we have not contacted Moorcroft at all and they are still sending the letters to our old address.
